    I tend to think a point system is better than what we have now. One thing though is that the points should be allocated "properly". For example, more points should be given to people with higher education, who earned a US degree, who have worked in the US for more years, who have paid more taxes, etc.

    Someone mentioned a good point is about the visa number limits. If the per country limits are not eliminated, the points system won't solve the problem. Of course, they should also give more points to people who have passed Labor and I140 and allow them to adjust status right away. Otherwise, we will further get stuck in all the backlogs. Poor us. :(

    I think if all the above issues are solved/cleared, probably a point system is good for us (i.e., EB based immigrants who are now stuck due to backlogs and retrogression). :p
    Once you have a point system , a whole lot of people will be qualified, many more than currently on H1B from other countries , it will again clog the system, remember for canada the waiting time in india is 5 years now for skilled people who have enough points.

    Again it goes to the basics how many skilled ot semi-skilled people they want in this country.

    If you look at THOMAS it actually shows that Yeas are 55 and Nays are 40
    So the bill passed the voting ....
    but it failed because it was ruled "out-of-order" and hence rejected ...
    I dont know why it was ruled out of order ... maybe because it was attached to the defence spending bill so it was not the right place to put in this kind of amendment....

    I hope that Yeas mean YES and Nay mean "NO" or I need to get my head examined

    This particular Cornyn amendment (S.Amdt. 2339) offered to attach to H.R. 2669 (College Cost Reduction Act of 2007 ), but the motion was failed due to lack of 5 votes.(55 YEAS and 40 NAYs. Require 3/5 majority) HR.2669 is passed by both Senate and house and sent for conference to resolve the difference between house and senate versions and president is sure to sign the bill and thus would become the law in another few days. This amendment does not have anything to do with defence bill or with SKILL bill. Following is the actions taken by congress of HR 2669.

    I am on H1 and my wife on H4. Can she apply for EAD while I do not ( I would prefer to extend my H1) after we both apply for 485?

    Yes. She will be on AOS Pending status while you can maintain H1 status.

    Does it mean they would stop processing I140 premium applications which have already been sent. My I140 was pending for 6 months and I changed it for premium after the dates became current, it was sent by my lawyer this Monday (25th) and received by USCIS on 26th. Does this mean it will not be processed or does this mean they will not accept any premium processing applications from July 2nd.

    Yours will be processed as you have already submitted. You should receive your decision in the next week. When you do, please let us know that it is approved :)

    USCIS just seems to be changing rules according to their whims and fancies. They are changing rules according to their convenience. What do these idiots think of themselves? One cannot plan on anything when we are dealing with USCIS. What's good today may not be good tomorrow. Do they expect us to be stuck in the backlogs and wait for years together for them to take their own sweet time to process applications? May be a case of job security for these lazy staff.

    Not entirely true, I switched job a couple of months ago - filed for AC21. I got an acknowledgment from USCIS for the same - stating that it will be added to my file, to be reviewed when my application is processed.

    Then you are a special case to USCIS. In my whole "GC career", you are the first case I am hearing about having AC21 related notification from USCIS.

    Chandu's comments are entirely truthful and your case is the special one as USCIS really does not have any sysem to account or to notify related with AC21 usage.

    Something I notice here and would like to get your opinions..

    People who donate their time and money to IV, understand and appreciate the efforts by IV volunteers to fix the broken immigration system do not usually get into this guessing game. Am I wrong?

    this is the highlight thread of the month... every month... this is the exciting, nail biting, end of the stick excitement that keeps me on this site forever... really...

    No offense to anyone, you are still free to discuss anything you want.

    The purpose of this thread was to get information from the immigration point of view and wether its ok to start your company if you have 485 pending and what effect it might have on your GC process and also to get valuable information from people who have already started their own company.

    H1b humane-hear my story..it cannot be as inhuman as it can be..(i have written the story in one of the forums before also..)

    My PD-Oct 2001..Eb3..My wife RIR-almost making it thru I140when all hell broke loose in our lives...my wife was pregnant and because of stupid gynaecologist..she ended up in hospital with complicated premature preganancy..guess what..as if it was not bad enough..her company got acquired just when she was admitted in hospital...imagine wondering about health insurance when she was kept to bed rest with no mobility allowed..we filed for insurance by mistake..which said that 20% in patient.....we were so shaken that even human resource did not advise us..guess what..baby was born..and it was surmised that baby will have long stay in hosiptal...2-3 months(eventually it was 4 months!)..somwhere around the first month..I realized that her insurance..will rip me off..I called right at the end of the first month..and tried several times to put my wife and baby on my insurance so that i don't end up paying 20%..it was lot of efforts until I found some desi in Blue cross insurance who put the whole family from the first initial month..when normally people get the policy for the following month at that time.

    one down --and then another came..my wife was called to her office from hospital saying that..since there was lot of work in her office..she could come for some days..guess what..she went back..thinking..she could finish work and then take extended leave....guess what..she was laid off..and with baby in hospital..and lay off..plus a rush to change her status to H4 visa..imagine the workload.....finally got her status changed..to h4 visa..with GC and labor in trash...

    I was so disgusted..that I started writing to Governor Shwarzenegger' office..who put me with Senator Diane Fienstein..and of course labor secretory Chao..after all the correspondings..all I got was my D number listed from Dallas..their sympathies...ALL I WROTE to them..Hey I want to change jobs because in those days I was commuting between LA to San Diego..where my baby was hospitalized...I wanted to be with my baby..and not work..but it was not possible..if I did..then I could get out of status...I even wrote to Department of Homeland security...and got no reply...they don't care..I ahve to be illegal to get sympathies..I guess!

    Situation was bad..finally baby was out of hospital and I weathered all with help of Almighty...and now I am so disgusted with system..that I am moving to vancouver...

    But I have another pleasant surprise..my boss wants me to work from vancouver and visit office once in a month...I don't know...whether it is possible...stay in vancouver and visit LA for 2 weeks and then go back and still maintain H1 status..

    what do you say..after all the stress!

    Sorry to hear your situation. There is you and several other members who I have had a chance to speak to, are going through a tough time in life (both on personal and professional fronts) due to not having a greencard. Such experiences are my motivation to work as a volunteer and core member for IV and do something to solve problems faced by several thousands of people like me. IV is currently the only organization in USA working for the cause of legal high skilled immigrants. This IV forum has brought all of us together on one platform where we can share our views and pain. Members have come up with ideas and helped this community in any way they could. Some members decided to join this effort as core members and pledged more time and effort in order to bring relief to all of us. It is not an easy job. There is nobody else to work on the issues we face. You have yourself seen how the govt. and lawmakers responded to you and still did not do anything when you tried yourself as an individual. When we try to raise such issues collectively as IV, lawmakers do hear us. With greater membership numbers and resources we can certainly do much more to influence them and get the laws changed. Members pls. help us increase our membership and funding so that we can all collectively bring about a change and provide relief to everyone in our community. desibechara, If you have decided to move to Canada, good luck to you and your family. Do keep in touch with this forum. Hope we all members of IV can collectively work soon enough to get something done for ourselves to end our miseries.

    AmitKhare77... apparently, the job title and job responsibilities have to be same as whats on labor until we get GC. otherwise no promotion.


    Actually, I believe that if the promotion is a "natural progression of the job ladder", you can accept it. What you cannot do is change the job ladder completely to a different track.
    Thus, say you filed labor when a software engineer, its ok to be promoted to "Senior Software Engineer. What is not ok is to change tracks to say "Product Manager" or a position as "Sales lead" etc...

    Of course, i'm not a lawyer, but this is what i;ve been told by other folks and lawyers at my company.

    India Was in 1998 for some time. Not sure if this is right "IN - 1/1/2002 7/1/2001" .
    Well in Jan 2005 VB IN was 1/1/2002.
    It was the time when priority dates were added.

    This is not 100% relevant to this thread but since we are discussing APs here, I thought I will ask the question.

    Do we need AP to go to / come back from US Virgin Islands? I know that these islands are U.S. territories and should be nothing more than going from one U.S. state to another. The reason for my question is that the DOS website states that for travelling to USVI, the U.S. citizens should carry a Photo Id AND Birth Certificate to establish the U.S. citizenship. Many websites state the same thing and some sites mention that this is because of nearby British Virgin Islands. As you can just take a ferry and come from British islands to U.S. Islands, the Immigration authorities on Mainland need to check your immigration status. This is not the case for travel to Hawaii or Puerto Rico.

    Does anyone know for sure or have personal experience visitng the USVI?
