If LOA can stop the old employer from revoking I-140, I would say, go for it. But just make sure you don't land into any other trouble (like non-competent etc. just an example, may not be relevant in your case, but you get the idea...).
Also, discuss with the new employer and make sure they are ok with supporting you in case of an RFE. From your response, looks like they might know what it is. What I can think of is, consult an attorney and discuss what kinda RFEs you can get that needs employer help (mostly EVL, ability to pay), prepare a sample response letter for both and check with the new employer they are ok with providing them if necessary.
DISCLAIMER: I am not an Attorney and this is not a legal advice
the new company has no clue about visa/h1/gc issues. they have never hired a "brown" guy and they do not even know that i am on ead..even if i told them they wouldn't know wht to make of it..so the only letters i can get will be generic letters stating my occupation and salary with a very brief description of duties. i know someone said loa is not a good idea but i think it just gives me a back up.
thanks evryonr for responses..

What are you talking about? Let me have two of whatever you are smoking or drinking.
You have it all wrong. Your experience or qualification DO NOT QUALIFY you for EB2. It is the requirement of JOB that matters. GOT IT.
Now go scream your lungs out in front of the Capitol, Yelling "DISCRIMINATION".
Instead of finding his faults, wouldn't it be easier to show some empathy to the point he is raising?
IV has to do something specifically for EB3 I soon or else we'll lose the confidence of a lot of supporters. 2001...are you kidding me?

A month is a good time, but who will leave one month's pay for nothing knowing that it will have bad affect on US congressman and politics and will act negatively on any provisions that are being planned in CIR. And on top of it most of us are single income family's because of the so called H4 status being continues for decades. :--) with no hope and sight for EAD.

I respect all the holidays and I would like to celebrate with you guys, but what is the meaning of Diwali?
Diwali (or Deepawali) literally means the festival of lights. Traditionally it has symbolized the arrival of Ram (a Hindu mythological figure often perceived as God) back to his kingdom after completing a 14 yr exile.
However other religions in India (notably Jainism and Sikhism) have different reasons for celebrating the same day.
Notwithstanding the different reasons it is commonly perceived as a festival of lights and of the victory of good over evil.
Hope it helps.
Regards.

May be some one who has already renewed their AP can answer this:
I am about to renew my AP. What will be the start date on the new AP. Is it the date after the current AP expires(like with EAD) or the date the renewal application is approved. Appreciate any responses.
I assume, you are asking for "Date of Intended Departure". Please use specific text from the form you are talking about. You can find some answers here (http://immigrationvoice.org/forum/showthread.php?p=256903)

My understanding was that once the 485 is filed, you go by RD. It doesn't matter what your PD is...
Does anyone know what the legislation is?
First your PD has to be current for USCIS to look into your RD.

Dear friends
For every one of us getting GC is a nightmare. Though USCIS follows a system, I feel it is not correctly followed. Also I noticed that people who have filed before the PERM process are really suffering. There are people who are in EB3, waiting for more than 9-10 years, keeping hope and anxiously waiting.
I feel that we should write to USCIS to clear all the pending GCs (EB2, EB3) filed before PERM (March 31, 2005) need to be processed before they take up any cases filed in PERM.
This will certainly make the process rational.

Think of it this way. Conservative estimations say that in the recent application rush, USCIS received 300K applications.
That is 2 year's worth of applications alone, not including those already at USCIS.
If you compound that with the asinine 7% country limit, and assume that there are MUCH more than 7% of that 300K from Indian nationality - I'd say you are looking at much longer than a 3 year wait on average. I'd guestimate 7 years.
The only way this will change is to support the DC rally. We are getting major traction and positive news on this and it's potential affects. Please do everything you can to come.
There are people offering to pay 100% of airfare, there are free buses being set up. There are very few valid reasons not to come!
Be part of history!

Exactly yebo123.
That is what employers want. To hold you till you have no more juice left.
When in your prime you have given all you got for 5-8 years who cares about you after that, not the employers not the system.
It is all part of the plan. When u are on H1, you have to be 200% productive. That benefits the economy. All and sundry here know the game. So they like you to be the way you are for a long long time.
Contribute to Social security with no benefits, pay taxes, buy cars
etc and boost the economy.
After 5-8 years if you still have the energy left to wait, then sure, you stand a chance after perhaps everyone else gets a GC.
"Good morning, Rhodene & Stockton. How may i help you?"
...
"Yes sir, we do trade in the futures market"
...
"Certainly sir, what would you like to put up?"
...
"So you would like to bet your family's future? No problem"
...
"Non-resident alien, 5yrs H1B... ok"
...
"EB-3? Oh, well, yeah ummm. That complicates things a little. Let me check with my supervisor"
...
...
"Hello sir? You see, the problem is your official odds are sitting at 1:12000. We are not authorized to trade at those levels. However, if you will include your pets' future in the deal we can offer you 1:3 odds."
...
"Don't get upset it is a very reasonable offer. How about if I include a jam donut?"
...
"Great. I will have the paperwork out for your signature in the morning. Have a nice day"

Everyone is acknowledging that Recapture Bill will help everyone, but no one is willing to do anything.
Next month, Congress will be in session for a very small interval of time, then why not try to do our best as much as we can regarding this bill.
EB3-I/04-2004.

Too late.
EB3I dropped out of school already!
Or watching cricket matches during exam time. :)
EB3 folks need to be the most worried people if they do not have Greencards. Unless there is any sense of desperation and expressed need, do not expect any lawmaker to vote for any greencard bill .

people we are coming close to the situation where it is "do or get fried :)".
I disagree that the situation is very bad.
It is bad only for those that are laid off on H1B. All others have EAD and are happy. They will realize the bad situation only when they cannot take a promotion or salary raise or cannot change job due to same and similar. Or if I485 gets an RFE or denial.
If the situation was bad, more people would be serious about your idea including you. Even you are not willing to do anything yourself other than asking others to do it. So this is the fate of immigrant community. We all do not want to do anything ourselves unless we ourseves are in a bad situation.

I am not sure about this but one thng can certainly happen with Admin Fix.
Porting of applicant who have stayed long enough in (EB3 to EB2). EB3 15 years experience and still counting and stuck and uncertain porting rules and AC21 doesn't make sense at all.
Or
AC21 rules or some other fix giving relief to people stuck in GC unnecessarily.
USCIs can make these fixes but they dont want to do it. Its simple
That would have been a blessing for EB3 India and China, if it EB3 + n years of experience could be ported to EB2.
But if visa capture (which is not braking any laws or rules but is simply making sure visa do not go unused) requires a legislative fix, I would assume your suggestion (porting EB3 to EB2) would be even more difficult to achieve with an Admin fix.

Thank you for expressing your concerns regarding the Department of States visa policies.
You raise compelling points, and your argument is an illustration of why we should work to ensure our visa polices are sound, reasonable, and equitable. Until we enact comprehensive immigration reform, we are likely to be faced with similarly difficult situations. Should legislation relating to this issue come before the Senate, I will certainly keep your views in mind.
Thank you again for contacting me.
Sincerely,
Sherrod Brown

Could be -ve too .We will all be surprised if we see a +ve movement.
We have been watching VBs ever since Jan 2005 when priority dates were added.
. 1/1/2005 10/1/2008
------------------------------------
All - C 1/1/2005
CH - 1/1/2002 10/1/2001
IN - 1/1/2002 7/1/2001
ME - C 7/1/2002
PH - 1/1/2002 1/1/2005
ROW has shown some progress, but CH, IN, ME is behind what was in 2005. Thats almost 4 years after re-introduction of priority dates.
We need a solution now.

As a response to an RFE, following evidences were submitted:

2) List of courses completed (Just a list without any course by course evaluations)
3) Education Evaluation Report (Re-submitted)
