    u can easily get an affadavit from someone with a business that says u worked there for a period of x days while ur h1 was with yyy company... that puts u into an illegal category too.

    Possibility of CIR happening diminishes each day passing by and as always every one acknowledge Immigration Reform as an important issue, but the reality, it is not as important as the other issues, economy, jobs, housing crisis, etc .

    Only window the Democrats have to do something about CIR is in the lame duck session, but it is easy said than done and could cause a deep divide among the parties that already have a bitter relation. If not in lame-duck session, then nothing untill after 2012 election.. that pushes to 2013.

    One of the promise Obama ran the first presidential election on was CIR and if none is done on that, he probably should write off the Latino votes, without which he cannot win again. Also getting a CIR through the Republican controlled house, that the Senate also agrees on -- don't think it will happen and well.. Also time now is to plan on re-election strategy for 2012 election for Obama and team.

    Only slim chance is before this congress term ends and not sure, if they can get something through. There is a very slim chance it might occur.. but again Media and special interest groups could blow it up too...

    Will have to see how it goes.. or if the blame game / finger pointing keeps continuing...

    I might be wrong, but I think the way it works is by supply and demand. If the supply of new visa numbers is much less than the demand, the dates might go back.


    They worked enough for this year and they have lot to do. According to my guess they have the following pending work.

    1. Issue Receipts (Sep/October)
    2. Issue EAD cards for approx 300,000 applicants? (October/November/December)
    3. Issues AP for 300,000 (October/November/December)


    On top of this they need to celebrate thanksgiving and christmas like every citizen. So don't expect too much from them for this year.

    If at all there is some momement in EB numbers, that will happen only between Jan-March(before H1-B madness starts).

    Yes I believe my attorney did provide the educational evaluation documents. It was the same documentation used for the H1B & the PERM Certification. Any idea of what my chances are with the appeal?

    i hate to say this, in my opinion, urs is a little tough case. This is just my thought. Other gurus here may have a better advice for u. But this is uscis, you are dealing with. So you never know. Provide a better educational evaluation and keep your fingers crossed. All the best.

    lol, i see fantasies are growing. A person may not have mother-in-law at all - why can't he marry to both: daughter and mother?

    i guess the formula becomes 0<=x<=20... this is sick...

    I beg to differ, he can definitely marry both, mother and daughter, but will end up with atleast one mother-in-law. the grandmother:)

    This type of clause is to protect employer for one year. Usually, it is not only trainig cost, it is business also.

    You can seek legal protection, complain USCIS and so on. When an employee joins contracts are for 12 months, when you work on niche technology, it will be confidentiality agreement for 2-3 years, and so on. Mostly they are goodwill agreements. If you have problem in signing for this 12 months, how would you be signing technology related agreements?

    I have seen business to business relationship broken due to employee running away from clients location. In the begining, even if formal training is not there, clients do compromize to bring to speed. Most of the consultant placements are business to business chains.

    Do you intend to break before 12 months?

    I have signed for confidentiality contracts up to 5 years, and refused to sign, when wanted not to honour contract, thereby not working for those clients.

    If possible avoid troubles otherwise, you already have several suggestions.

    That's a totally different story. It's normal to have non-compete clause and it is enforceable, but even non-compete clause will be hard to enforce if it sets unreasonable conditions (i.e. prohibits working for a client for more than 6 months). Also, if you sign a contract, it does not mean you are obligated to fulfill it. If contract violates US laws, it's null and void (i.e. you can sign a clause that you will be a slave for company's boss, but it does not mean company's boss can enforce it in court).

    I recant my earlier outburst at mercies since I realize that he was acting as a messenger to the problem. Sorry for the offense mercies.

    There are many people who would just run away from effort when doubts are raised and since people of afraid of being punished for just advocating a public policy or writing a letter to congress in the first place. I would request you to not reproduce posts here or on portal that would echo the material the plants fear and doubts among members. When the core group is spending 2-3 hours a day on top of their fulltime job plus the weekends, plus out of pocket expenses on travel to DC, its disheartening when a post on forum scares away sceptical members.

    Our goal from these meetings is simple: to get the issue on the radar.

    Remember usually when lawmakers/lawmaker district office staff hear "immigration" they think "illegal immigration." Our presentation is usually the beginning of their education -- we have no expectation that they have "deep" or any knowledge of the nitty gritty.

    All we want is that they send our material to their Immigration aide in DC, and recognize that there is an issue out there.

    I spent $500 for medical.
    Lawyer fee and other expenses (fedex etc) (around $2000) - paid by my company.
    plus $1500 is filing fee (which I guess should be refunded).
