Congress can pass a comprehensive overhaul of the nation's immigration laws as soon as this year if it prioritizes a crackdown on illegal immigration, including a new national identity card that will verify workers' eligibility, Sen. Charles E. Schumer (D-N.Y.) said today.
Speaking one day before President Obama is to host lawmakers from both parties at the White House to discuss prospects for an immigration bill, the head of the Senate's main immigration subcommittee laid out key legislative priorities, including requiring that an estimated 12 million illegal immigrants register with the government and "submit to a rigorous process to convert to legal status" or face immediate deportation.
Legislation must also create mechanisms to attract high-skilled immigrants, control the flow of low-skilled immigrants and protect native-born workers, Schumer said, without providing specifics. He did not propose an expanded guest-worker program, a linchpin of overhaul efforts that failed in 2006 and 2007 under President George W. Bush.
In laying down a road map for legislation, Schumer set the groundwork for tomorrow's White House meeting, a long-awaited session that immigrant advocates and Latino leaders have demanded as proof that Obama will fulfill a campaign pledge to move forward on immigration legislation this year.
Schumer said he expects Obama to show his "unyielding commitment" toward the goal but demanded that advocates recognize that Democrats must show the American people they believe that "illegal immigration is wrong -- plain and simple."
"All of the fundamental building blocks are in place to pass comprehensive immigration reform this session and, even possibly, later this year," Schumer said. "I truly believe that [President Obama's] leadership will be the critical difference in getting us over the hump this time around."

Schumer's proposal for a national "biometric" identification system to verify work documents -- based on fingerprints, iris scans or digital photographs -- stems from a key weakness of past immigration overhaul efforts. A 1986 law required workers to fill out I-9 forms and present identification documents, but it lacked provisions to crack down on unscrupulous employers or job seekers with fake IDs, creating a booming fraudulent ID industry.
"I'm sure the civil liberties groups will object to some type of biometric card -- it will be something with all kinds of protections -- but we're going to have to do it. It's the only way to do it," Schumer said, referring to enforcing laws against hiring illegal immigrants.

Hello All,
I suggested this in my last two posts and I am suggesting this again. Emails , faxes to Rep will not create visibility of the problem. What we need to do is, do something big, like a DC rally again. One of the benefits behind doing this will be, everyone in this country i has their eyes on DC for presidential elections. Hence more visibility for us.
Secondly the topic of these three bills is hot, if we don't do anything now, it will turn cold, and then will be forgotten.
What we really need is a huge volume of high skilled workers in DC, not just a handful. Please let us all get together in DC again and push for these bills. We will get a lot of visibility. How about sending flowers to congress members?
Please let us all act on it!!

Yes I believe my attorney did provide the educational evaluation documents. It was the same documentation used for the H1B & the PERM Certification. Any idea of what my chances are with the appeal?
i hate to say this, in my opinion, urs is a little tough case. This is just my thought. Other gurus here may have a better advice for u. But this is uscis, you are dealing with. So you never know. Provide a better educational evaluation and keep your fingers crossed. All the best.

Citizens want to either start consulting companies and get H1B employees or want to stop more Indians coming. More Indians mean less jobs for their children.
Green card holders do not even want to be friends with H1B.
H1B do not want to be friends with F1.
H1 girls want to be married to citizen or Green card holders. Or someone with EB2 PD.
Green card IV members do not even want to come back here.

yea this is correct. a member named united nations posted a detailed break down on immigration portal a few months back. This has been implemented by the DOS by suspending the AC21 rule of a variable cap and enforcing a hard cap of 7%. This was mentioned in the november or december 2005 bulletin.
From my perspective I think its a travesty that when the UCIS and the DOL has classified some of us as "exceptional" aliens, we can still not adjust our status because we were born in India or China while Mexicans with the same qualifications can. If the country limit is to avoid monopolization of numbers and enhance diversity...all categories for Mexico should be "U"

Well, now I realized it is not DOS but again its me who was not upto date with the trend. This means that India cannot go beyond its 7% using unused visas. In the same bulletin there is something that indicated that it allocated too many visas to India in the past. Most likely DOS does not take any action until ROW eb3, eb2 and eb1 are current. Now I have also understood why the perm is necessary at the this time for row. Perm helps row move faster thatway in the loooooong run helping India when all the row is current.
There will not be any spillover to any India categories in the near future. This is the reason why India eb2 went unavailable. EB1 will soon follow the case. Eventhough eb3 moves, it was like unavailable for a long time. 1400 greencards a year in each category (excluding spouses from this ordeal) is hardly enough for India. I doubt there would be any encouraging direction in future as India had consumed too many visas in the past years. This is sort of balancing act as far as DOS is concerned. Only a change of heart can save India.
This is really bad for India as most of the people applied for 485 after spending nearly many years in BEC (that itself a retrogression). With Philly clearing non-rir 2001 eb2 labors, can't wait to see october's eb2 retrogression dates.
I wouldn't care about where the overflow/spillover goes as it is not for India.

The DREAM act is specific in that it only applies if you can prove you came here and still remain in ILLegal status. I have a son who aged out a year and a half ago. I CANNOT support an act that gives an illegal child of the same age a path to green card that does not provide at least the same for him. If we can get the act amended to include all children who do not have a path to residency and ultimately citizenship that would be OK.

They lobbied hard at DOL to allow the continuation of labor substitution. IV has tried to get DOL to eliminate labor substitution or at least make it such that the Priority date is not the labor filing date but the 140 filing date. Allow labor sub with PD = 140 filing date will solve the problem of cutting in line and getting ahead in an unfair manner. QGA helped to get our message to Eliane Chow, The Secretary of Labor Department. (http://www.whitehouse.gov/government/chao-bio.html)

Guys we see a very unhealthy trend here where any disagreement is not tolerated. This forum is for legal skilled immigrants and we sometimes show how unskilled we are when it comes to tolerance of opinion here.

The data itself shows that the overwhelming number of skilled immigrants come from India/China. If the objective is to let the most skilled immigrants in, then the US should forget about diversity. Unfortunately in terms of volume and talent combined, India and China handily beat the rest of the world. Even if EB3 goes to 2002 so be it, but at least you are treating all skilled immigrants on a level playing field rather than discriminating them based on where they were born. If the US continues to do this, there is a serious danger (and this has been documented) that skilled folks in India/China will no longer find the US attractive. Its already happening with the economy booming in India. In fact, we'll probably see you or your kids standing in line for an Indian or Chinese green card in a few years (and I doubt India or China will focus on diversity when it comes to attracting the most skilled talent).
The last line is only a Dream.. I value your opinion, and wish that to happem. as they say Sounds Good, given the situation Political and economic in India and China it will never ever happen. Politically motivated religious fights, killing the political opponent who is having a diferent opinion, no entry for good thinking poeple in all levels in India. Two H-1B's are possible if you can do two jobs. Most of the ppl file a concurrent H-1B for a part time job so you have one H-1B for full time job and the other for a part time job. The US CIS will approve a concurent H-1B for part time job for as little as 15 hours a week. Now if you want to file the second H-1B too for a full time job and have the physical ability to work for 80 hours a weeks then US CIS won't have any problems with that.
