    Hi,

    Currently i am working as full time employee on H1B, receiving W2. I have EAD valid until Oct 2010.

    Can i use EAD to work part time and receive 1099 as income statement? If i use EAD / 1099 will this cause an issue for I-485 approval (AOS is pending) ?

    WASHINGTON, July 19 � Arlen Specter is a senior United States senator who expects to be allowed his say on the Senate floor. So he bristled when Senator Harry Reid, the majority leader, brusquely cut him off at the end of the Iraq debate.

    �The leadership is setting a dictatorial tone,� Mr. Specter, Republican of Pennsylvania, said Thursday, still furious over his treatment the day before. �Senators didn�t get here to be pushed around.�

    It may seem small-minded to bicker over a few words at the end of a 24-hour debate. But the clash between the two veteran senators is evidence of a larger breakdown in relations in the Senate, a deterioration in cooperation that is hobbling the Senate�s ability to get things done. The situation is not likely to improve with a presidential election on the horizon.

    As the cots were rolled away and lawmakers left for a decent night�s rest after the around-the-clock debate that ended � like others this year � in stalemate, lawmakers of both parties said they had rarely seen the tone so poisonous and the willingness to work together on the floor at such a low ebb.

    �The last vestiges of courtesy seem to be going out the window,� said Senator Trent Lott, the Mississippi Republican who has served as majority and minority leader. �Every time I think the Senate � Republican or Democrat � has gone to a point where you can�t go any lower, we go lower.�

    It is hardly startling that members of the two parties do not see eye to eye. And the spirit of bipartisanship in the Senate always rises and falls depending on the subject and the election calendar. But seven months into the new Democratic regime, the environment seems unusually hostile. Occasionally, senators do, too, as exhibited in a Sunday television exchange between Senators Jim Webb, Democrat of Virginia, and Lindsey Graham, Republican of South Carolina, that looked for a moment as if it might turn physical as the two men argued about the war in Iraq.

    The angry attacks nearly spiraled out of control Thursday night as the two parties lobbed political bombs at each other during the windup of work on an otherwise popular higher education measure.

    After Republicans brought forward proposals intended to embarrass Democrats on terror detainees and union elections, Democrats countered with a resolution urging President Bush not to pardon I. Lewis Libby Jr., a former top White House aide. Republicans struck back with a resolution deploring the pardons issued by President Bill Clinton.

    The floor descended into chaos as members of the two parties glowered at one another across the aisle. Evidently recognizing they had gone too far, party leaders pulled back and agreed to try to finish the education bill as Democrats struck their Libby proposal from the record.

    Hard feelings have consequences. Without agreements between the leaders of the opposing parties, the Senate has been plunged into a procedural knife fight, with Democrats forced to scramble to find 60 votes not just on contentious issues like an Iraq withdrawal plan, but on once-routine matters like motions to proceed to a spending bill.

    The feuding has spilled into subjects that would seem to hold the potential for common ground, like antiterror legislation and lobbying reform, and will doubtless tie up other measures to come.

    Democrats contend that Republicans have embarked on a strategy of delay, using Senate rules to chew up scarce legislative time and deny Democrats any accomplishments. Republicans complain that Democrats are trying to jam through objectionable bills and are mainly interested in building a political case for 2008. The relationship between Mr. Reid and his Republican counterpart, Senator Mitch McConnell of Kentucky, has cooled after it was initially thought the two Senate tacticians would be able to do business.

    Senator Edward M. Kennedy, the Massachusetts Democrat who has been in the Senate for more than four decades, said he was not sure bipartisanship was at an all-time low, but acknowledged things were tense.

    �The fact the Senate is so evenly divided makes big causes out of smaller events,� Mr. Kennedy said.

    Besides the narrow 51-49 majority Democrats enjoy, lawmakers and others attribute what senators deplore as a lack of comity to various reasons, including the emotions surrounding the Iraq war debate, a Republican payback for Democratic stalling in recent years and pure political maneuvering in a hot-house environment.

    Mr. Reid on Thursday blamed Republican ideology, saying the Senate�s conservative contingent was unwilling to swallow legislation sought by most Americans.

    �Republicans in the Senate do not represent mainstream Republicans around the country,� he said.

    Members of both houses have been contending for years that the sort of personal interaction that can lead lawmakers to overcome partisan differences has been on the decline, leaving Congress polarized.

    But Mr. Kennedy, Mr. Specter and others say they find that committee leaders still tend to be able to work together. And a bipartisan group of senior lawmakers put together the Senate�s immigration proposal, though it went down in flames to the broader political divide in Congress.

    Senator Carl Levin of Michigan, the chairman of the Armed Services Committee who has been in the heat of the battle over the Iraq legislation, said he did not believe feelings were frayed beyond repair.

    �The Senate is a unique place where wills are tested, and this was a very important issue that people have very strong feelings on,� he said, referring to the Iraq debate. �Instead of fighting over it physically, there are battles that are fought on the floor of the Senate. But these are important disagreements and they should be aired.

    Hello All,

    The officer at the SSN issuing center told me since my passport and the stamped I-94 have my maiden I will get an SSN also in the maiden name and not my married name.

    However I had already filed for my EAD (form I-765) before getting this information with my married name which I need to change to the maiden name. I have received an appointment letter for biometrics/finger printing (FP) . What should be done now? Should I wait and tell the officer during the FP about this name change that I need or how should I go about it?

    The expiry date of B1/B2 is printed on the visa. Getting F1 does not invalidate B1/B2. Unless the visa issuer put a stamp on the B1/B2 as "Cancelled", it is still valid!

    Guys,

    My company is forcing everyone to fill I9 form. I have EAD but maintaining H1 status and did not use EAD. I did some research on I9 and it is no where mentioned that only people with EAD has to fill this. I need Guru's opinion on this.

    I just don't want to loose my H1 status in any case.

    Hi,

    I sent my EB2 I-485 application on July 5th, 2007. Didnot receive any rejection or receipt number.

    My question is can i send my wifes application immediately without getting my 485 receipt number. I have the copy of my I140 receipt number. Can i add this to my wife's application and send?

    What will happen if i send without my 485 receipt number? will i get a RFE or a rejection?

    What is the undisturbed and unaddressed source of many of the nation's current difficulties? It's the Constitution of the United States.

    The Constitution has become a secularly sacred document, as though God handed it to Moses in a third tablet on the Mount. The 2008 presidential candidates have been offering us prescriptions for everything from Iraq to health care over the past several months. But here is the problem: Their fixes are situational and incremental. In the meantime, underlying structural problems with America's governmental and political system are preventing us from solving our most intractable challenges.

    If progress as a society is to be made, it is time for elemental change. The last place we look to understand why the U.S. system isn't working well anymore - the Constitution - should be the first place. A careful look at constitutional reform should begin now and culminate in a new Constitutional Convention.

    Does this sound radical? If so, then the framers were radicals, too. They would be both disappointed and amazed that after 220 years, the inheritors of their Constitution had not tried to adapt to new developments they could never have anticipated in Philadelphia in 1787. Urging his future countrymen to take advantage of their own experiences with government, George Washington declared, "I do not think we are more inspired, have more wisdom, or possess more virtue, than those who will come after us."

    Thomas Jefferson insisted that "No society can make a perpetual Constitution. ... The earth belongs always to the living generation. ... Every Constitution ... naturally expires at the end of 19 years," the length of a generation in Jefferson's time.

    The overall design of the Constitution remains brilliant and sound with respect to the Bill of Rights and the separation of powers. But there are numerous archaic provisions that inhibit constructive change and adaptation to a 21st century world unimaginable to the framers.

    Let's explore a few: More than 14 million U.S. citizens are automatically and irrevocably barred from holding the office of president simply because they were not born in the United States - either they are immigrants or their U.S. mothers gave birth to them while outside U.S. territory. This exclusion creates a noxious form of second-class citizenship. The requirement that the president must be a "natural born citizen" should be replaced with a condition that a candidate must be a U.S. citizen for at least 20 years before election to the presidency.

    Both the Vietnam and Iraq conflicts have illustrated a modern imbalance in the constitutional power to wage war. Once Congress consented to these wars, presidents were able to continue them for many years long after popular support had drastically declined. Limit the president's war-making authority by creating a provision that requires Congress to vote affirmatively every six months to continue U.S. military involvement. Debate in both houses would be limited so that the vote could not be delayed. If either house of Congress voted to end a war, the president would have one year to withdraw all combat troops.

    If the 26 least populated states voted as a bloc, they would control the U.S. Senate with a total of just under 17 percent of the country's population. This small-state stranglehold is not merely a bump in the road; it is a massive roadblock to fairness that can, and often does, stop all progressive traffic. We should give each of the 10 most populated states two additional Senate seats and give each of the next 15 most populated states one additional seat. Sparsely populated states will still be disproportionately represented, but the ridiculous tilt to them in today's system can be a thing of the past.

    If someone purposefully tried to conjure up the most random and illogical method of nominating presidential candidates, the resulting system would probably look much as ours does today. The incoherent lineup of primaries and caucuses forces candidates to campaign at least a year before the first nomination contest so they can become known nationwide and raise the money needed to compete. Congress should be constitutionally required to designate four regions of contiguous states; the regions would hold their nominating events in successive months, beginning in April and ending in July. A U.S. Election Lottery, to be held on Jan. 1 of the presidential election year, would determine the order of regional events. The new system would add an element of drama to the beginning of a presidential year while also shortening the campaign: No one would know in which region the contest would begin until New Year's Day.

    Excessive authority has accrued to the federal courts, especially the Supreme Court - so much so that had the framers realized the courts' eventual powers, they would have limited judicial authority. The insularity of lifetime tenure, combined with the appointments of relatively young attorneys who give long service on the bench, produces senior judges representing the views of past generations better than views of the current day. A nonrenewable term limit of 15 years should apply to all federal judges, from the district courts all the way up to the Supreme Court.

    This all is just a mere scratch on the surface in identifying long-overdue constitutional reforms. There are dozens of other worthy proposals than can and ought to be discussed, if we but have the will to imagine a better Constitution. No rational person will rush to change the Constitution, and it will take many years of thorough-going work. But let's at least start the discussion, and begin thinking about the generation-long process that could lead to a new constitutional convention sometime this century.

    I'm working on L1 & have H1 petition without COS.

    Can my H1 employer apply for COS, so that I can change my status from L1 to H1 without visiting India?

    Also, I've an offer from a third company... can this company file for Change of Status from L1 to H1 & transfer the H1? I've the H1 petition I129 number, but no paystubs on H1. I've paystubs on L1.

    Can I transfer to H1 to this third company? Will I have to get my H1 stamped frmo INdia then join this third company?

    If not, is there any other option?

    Please reply. Help appreciated.

    Can someone comment on how the recent trend has been for a PERM application that was applied under EB2 for a Software Developer position?

    My employer is planning to apply one for myself and was wondering if it's a good time to do so?

    I've heard that DOL is blatantly denying a large % of applications that are in the audit queue. Is this true? :(

    Is it ok to transfer H1b to different employer after using AP? I resumed work with same employer on H1b after entering with AP recently.

    My H1b is valid till 2010 . H1b was last exteneded an year back, inside USA, before I left to India.

    I am going to get info from lawyer, but I wanted to be sure..

    As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.

    The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

    I have changed to a new employer and have mailed AC21 documentation to the nebraska service center at the following address using FEDEX.

    It is 2 weeks now that the mail has been delivered. So far I have not seen any soft LUD's on either my pending I-485 or approved I-140 cases.
    - Would the LUD's be seen at all on these? How many days after sending the docs would you see the LUD typically?
    - Is there any way we can call and confirm that the new employer details are applied on my I-485 case?
