There are really 2 sub-categories of EB-3. One requires a minimum of a bachelor's degree, or equivalent in education/experience. The other requires just 2 years skilled worker experience.
The question is what your position really is, and what the employer requires. If the position really requires you to speak Korean, it can get approved. However, adding a foreign language requirement definitely invites intense scrutiny, and it can really only work if you can show that you spend a lot of your time using Korean and the company could not manage without it. You also need to show that you use Korean with people who cannot speak English, not just that they don't want to speak English. You need extensive back-up documents to prove the foreign language requirement.

You do not even need to file AC21.. I changed my employer on EAD from H1B and no issue and got GC also.

What I'd do is:
Ctrl+click the channel (loads selection)
then go to the layers, and select the layer you want to apply the selection, then press Alt+backspace to fill the selection.
Then ctrl+D to unload selection...

I had filed my I485 directly at TSC , the address which was listed on my I140 Receipt on June 25th as per the advise given by IO when i called the 800#

H1B: 4th year running
GC process: 140 filed, waiting for priority date to become current and then apply for I-485
Priority date is Oct 2007, so not expected to be current this year.
Can I apply for F1 starting next year? This is for an MBA course.
What are the risks involved?

What are those little green squares that show up with our names when we post something?? When you hover over them you see a ToolTip message.
Are they supposed to tell us if we've been Naughty or Nice this year? :cool:
They represent reputation points.Everyone will have one at starting.As people start to add you the reputation points..The green squares will increase.Sometimes they depend on number of posts you posted in the forum.

My I-140 is applied during Jan 2007 under EB2 category. My LCA says Masters with 24 months experience amd alternative as Bachelors with 5 Yrs experience. As per the processing time updates, they are processing March 21st 2007. I don't see any updates other than Case is pending.
What should I do to get this processed?. Should I call customer service and ask for SR?

Since there is a mad rush of i485 applications , USCIS is going to do lottery to select applications for approval.Rest of them will be rejected.

My LCA appl has a priority date of June 2004; and so far, Dallas BEC has lost my resent-appl twice. Lawyers failed to retrieve any status after that, and suggested a congressional liaison enquiry into it. If anybody is aware of this enquiry, would you plz let me know? Thanx.

People made same mistake nth times. This text (last year bill) was replaced with new compromised text. Forget about SKILLLLLLLLLL
In CIR 2007 (S.1348) Title V, subtitle B is skill act of 2007 SEC.524 says about people with masters and higher degrees will not be counted against the numerical caps. This says it is amending Section 201(b)(1) (8 U.S.C. 1151(b)(1)) which is about the numerical caps. As this is in the section of backlog reduction does this mean that those who already are in the process and is backlogged will be given green cards out the numerical cap?
