Hi,
Couple of my colleagues from 10 Aug filing in TSC got 140 approval last week, same is the case with a few from Nebraska as well, I am still stuck waiting for my I 140 even though I filed ahead of others.

She can stay as long as she wants, but it is finally up to the port of entry officer to decide to let her in or not depending on reason for staying outside (while 485 is pending) is valid or not. After all AP is supposed to be used only for emergency situations.
Can wife stay in India for more than 6 months while 485 is pending?
What she have now is an approved AP till 2009 december.

With the opening of its first New Delhi outlet, ice cream brand Haagen Dazs adopted an interesting if not ridiculous policy: those with international passports were allowed in while Indians themselves weren't. Times of India's Rajesh Kalra provides a tale of a friend who was turned away by Haagen-Dazs enforcers. Here's a brief excerpt:
"I immediately called Ramit. 'You are an international traveler, and you have a passport, so you can go in', I said. Ramit's response was instant: I tried to enter but they said you are not allowed for you don't have an international passport. I am normally not given to immediate emotional reactions, but I couldn't resist this time. I was, to be honest, upset. How can they do this to an Indian, in India? Do a story on TOI or NBT? Do it for print or Online? Call other media friends and colleagues? I simply didn't know how to react. Print would have a better impact, but should I wait that long?"
Kalra didn't wait long. He contacted local authorities and used Facebook and Twitter to get the word out to the Indian community and as expected, HD's actions drew plenty of ire. According to BoingBoing, after a fitting public outcry thanks in part to Kalra's efforts, the operator of the franchise (who ironically is Indian) has axed the policy and apparently now claims it never existed.
Kalra, though, chalks this discrimination up to an age-old mentality of some Indian people. "I have often maintained that we ourselves are our biggest enemies. Our mentality is that of slaves and we think anything is good only if its approved by foreigners, or the 'holders of international passport[s].'"
You'd need to wait till you are a US citizen for that!!!

Yes there is. I paid for mine and got approval in 10 days. I did that because I did not want to wait.

There is 180 days rule for h1b without pay and also it is employers responsibility to pay when you are out of project. Also think about option of switching her back to h4.

In CIR 2007 (S.1348) Title V, subtitle B is skill act of 2007 SEC.524 says about people with masters and higher degrees will not be counted against the numerical caps. This says it is amending Section 201(b)(1) (8 U.S.C. 1151(b)(1)) which is about the numerical caps. As this is in the section of backlog reduction does this mean that those who already are in the process and is backlogged will be given green cards out the numerical cap?

My perm from May-09 went to audit & was approved in April-11. I noticed the dates for audited cases are moving forward quickly & jumped 9 months from March-09 to December-09. As your date falls in the March-December range, I would wait until the end of this month and then contact the DOL. My reasoning is that your application is sitting on someones table (waiting to be approved). Good luck to you.

Hi,
I was working on L1 before and my h1 was approved in october but i joined on h1 only in december before the 60 day grace period?
Now i need to visit to india so
1) Will there be any problem to get stamped in india if i travel in April ?
2) Can i get stamped in Mexico or Canada? How many pay slips n other documents do i need ? What is the process of getting stamped in Mexico or Canada?
3) Which one is less risky (going to mexico or canada) ?
Please let me know ASAP. I appreciate your help on this.

My wife is currently in the US and since my PD is current we need to file her I-485. We are trying to self file and would like to know what documents do we need to provide to prove that she successfully fullfilled her 2 year home residency requirement (HRR). She left the US in January 15, 2006 and came back on H4 in February 8, 2008.
The fact that she was granted H4 visa implies that she has fullfilled the 2 year HRR but our attorney said that she needs to prove that my wife did indeed fullfill this requirement.
Has anyone been in this position?
Please advise.

But it reminds us that there are bad actors out there and US consular officials have a tough job in trying to make sure that deserving applicants get visas while they ferret out the fraudsters. The $500 anti-fraud fee that accompanies every H-1B petition is supposed to help provide the funding to properly investigate and root out fraud. It sounds like the system is working.

Hi,
My H1-B got Accepted but I didnt recieved my I-94. I completed my masters here. There are no status issues. My OPT will expire on Dec 27.
I applied for H1-B amendment under Premium processing but i got query of Company documents and 2004, 2005 paystubs.
My employer answered them that employee is not there in the usa in those years. Below is the response from USCIS
Current Status: Response to request for evidence received, and case processing has resumed.
On October 09, 2008, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done. This case is at our CALIFORNIA SERVICE CENTER location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.
