    Here is something interesting

    My wife got her EAD approved for 2 years, she is suppose to get her extension only for a year as on Sep 10 when they renewed her card the priority dates were current.

    USCIS an organization that is above and beyond the laws of this country.

    If one is eligible for eb2 their aiint anything thats gonna stop one from getting there..

    webm: what is the status of your application ( 485), is your NC, SC or fingurprints all clear. Did you speak to any IO about any update on your case as your PD is current ( 01 Oct).

    No i didn't speak to any IO..but FP cleared means the one we go for fingure printing isn't it??

    My PD is not current yet..just missed with one day lag..

    Cutoff date Oct'01 means they can/will only process apps whose PD's falls On/before Sep31st..

    I am opening this thread to bring focus to the real issues at hand and how to channel our energy (frustation) effectively for seeing postive results

    Primary Issue - In my opinion most of us are frustated not because our GC is being delayed. But we are frustated because we have no concrete information/data/stastics to reliably predict when our pending case will be up for review.

    How are we trying to resolve the issue?

    Currently we come here express our ideas on how to get bills passed, discuss solutions to fix the problems, organize campaigns, rallies, send flowers, etc,.

    Why we don't see much success with our current approach?
    Organzing a huge rally is not easy, making 25000 people send letters is not easy, organising 200 people to send flowers is not easy. We are unable to get our message across to the correct authoratives.

    So what can we do?

    As we all know most of call USCIS for status. And also we know USCIS has a limited number of customer service agents.

    I would suggest that we all call USCIS every month 3rd week from mon -friday and just ask for our case status and other things what generally our members ask. We should do this every month 3rd week. The goal is to increase the call volume.
    We can all call DOS starting 10th of every month to check about the visa bulletin until it is published. We can ask them for projections, predictions and all that you can think of with respect to visa bulletin. - The goal is to increase the call volume
    We should be polite during all our phone conversation with the agents.

    What do we get by increasing the call volume?
    All customer support call centers gather information on the type of support calls they receive. They use this information to address issues to reduce the call volume.
    To address the issue USCIS and DOS should try to give out more relevant information in their visa bulletins and also give more information in the case status online.

    What can we do with more information from USCIS and DOS?
    We can plan for our future better, since we have better information.
    IV can focus on real issues when we have the accurate information.
    We will have better information while we ask for reforms in the EB GC system.
    We will have less frustation because we have a clearer idea when to expect our pending case to become active

    hello all,
    Lets say you are a citizen here or your son is a citizen becasue he was born here.
    Then you decide to go back and he starts studing with the PIO, I guess that works till he gets to college(Govt colleges are NRI quota right?)

    Then when he want to work there dose he have to get a VISA like us comming here to work ?

    I ask this becasue a friend of mine said a major IT company in India said that such a person cannot work in India without a VISA and they are not sponsering any visa's now.

    so when he tried to come to the US, it seems that he had to pay for all his education as an NRI would have paid.

    also if you reject the US citizenship and US is not going to give you any visa..ever !

    PIOs are allowed to work without additional VISA.

    I have a strange situation where I was thinking of AC21 all the while since January (Jul 02 Filer, TSC with Receipt# SRC 0722...).

    Now, I finally made my mind and about to get an offer (after labor day, they say).

    The lawyer says "don't think about AC21 now, because most probably your GC will be here within 3 months"

    My PD is July 31st, 2006.

    Dilemma: I don't want to screw up (or stretch the case un-necessarily) by changing employment just in case if there is an RFE. But then, I have to stay with my current employer for 6+ months AFTER GC as well, to be able to prove "permanent employment" intent.

    please advise if the timing (within 3 months) makes sense.

    Please also shed light on the permanent intent thing .

    Not sure of terminology here, but some companies have policies to "go after" employees who leave immediately after getting their employment-based permanent residence. God knows there may be a law that allows the company to sue you for your "intent" of staying with the company for the sole purpose of getting your green card and not because you have a vested interest in doing your job for the company.
    While these policies/laws allow for the employee to leave the company after a "reasonable" amount of time (usually six months), if, however, the employee leaves the company within that timeframe, the company has good cause to argue that the employee had an intent of leaving the company from the beginning right after s/he obtained employment-based permanent residence.

    Not sure how much sense this made - the law is kinda fuzzy here, AFAIK. As is good with such matters, get professional advice from a good immigration attorney about what you need to do - always worth the money; the risk is not.

    Thank you gc_chahiye for you nice explaination. I agreed with your comment on completing 180 days....will do that. I may invoke AC21 afterwards with EAD rather going with H1B transfer as that make better sense to me.....

    Any sugessions.....???

    Also I heard that the time limit of 6 months to apply the I-140 after the labor is approved is only applies to people who substuting the approved labor. I am not sure how far that is true, any clarifications would be great.

    well, something similar is going on with my case,though mine is not i-485...

    I am waiting for H4 extension (7th year). Attorney had replied to RFE long time ago and I noticed that online message changed at one point last week, wording is not the same, but no LUD.
    Now the message says that they will notify of a decision in writing.
    No time-line any more...

    Have no idea what that means, but I hope they will soon mail the approval. It has been almost a month since they received response to RFE.:mad:

    To the OP, I have a suggestion for you. Please try this in very good earnest.

    Imagine in your mind, all through the weekend that your approval will come on Monday. Your priority date is current. You exhausted all options. You are very close. Maybe the IO has picked ur file & gone on vacation...maybe he will come back this weekend & just send an approval on monday. You have paid ur dues...u r very close....just relax. On renewing EAD & AP....just go ahead renew them...that will send another trigger for approval.

    But the bottomline is - just imagine that u have already gotten ur approval.
    Forget browsing immigration forums...forget logging into USCIS...forget about 'GETTING' the GC....just imagine that u 'ALREADY GOT IT'.

    It makes a huge difference. trust me.

    Im trying frantically to post this as a new thread but in vain . I would be ogliged if any1 of u can guide me through the process . Currently im facing issue with my h1 ie , my h1 was approved from this year lottery and it had a query which i have sent a letter to ins through my consultant , in aug but i have not recd any update so far . Im all confused as to what is my status coz at time im told that im on student visa and at time on h1 . Also if i find a job i will be paid only wen its valid . currently i stand on a crossroad of confusion , agony , pain and frustation . pls some 1 guide me thrgh this and if reqd i would apprecciate if u can also mail me .     Extension of H1B beyond six year, is possible only if any employment based greeen card applications (like Labor Certification and 140) is pending or approved. As your mom is not having any Employment based GC applications pending, she can't apply H1B extension beyond six years. The best advise is leave the country before expiry of I-94 and enter thro CP based on I-130; Dont count on 180 day period. If she want to stay in US to file AOS based on I-130, she has to find a way to change of other non-immigrant status like student etc..

    (to check your luck, apply H1B extension with a request that I-130 was already approved and PD is very close to become current and request to grant an extension for an year based on current family situation and to avoid leaving the country.USCIS may buy this request and but not gurenteed.. Any way consult a good lawyer for other options)
