- What does corruption-back-home has to do with it? There is a more open political discourse here. We should either participate and let them know what we want, or they will do whatever they want ( like they tried to reduce EB quota to 90,000 in the last CIR).
- I have been to many lawmaker Offices in Michigan, I have visited several lawmaker offices in DC (both in and out of Michigan). Over that, I went and testified before MI Senate Transportation committee when they were denying Driving Licences to all foreign workers.
If you think they delayed your EAD for 120 days, why do you think they approved mine in 2 months flat, for full 2 years, even synchronizing the expiry date of the EAD with the validity of the new one (meaning, I didn't lose a single day)? May be they were angry that you weren't trying hard enough? :-)

We don't all have the resources to hire powerful lawyers and fight for a couple years. Did they take 120 days to renew my EAD because I visited my congressional representative's staff? Maybe.

1.Apply for new H1 petition(premium processing) for you before July 31.
2.On approval send the H1 papers to your wife so that she can get H4.
3. On her entry to USA apply for her I-485.
Then you can live happily together in america.
P.S: Even when you have used AC21, in hindsight you should have got H1B instead of using EAD.

Just imagine what will happen to the market flooded with EADs. Job market for H1Bs will totally be down. No US companies will hire H1Bs if they get somebody with an EAD. Tonnes of Junior developers and S/W testers will in the market driving the billing rates down even further. It's better to pack up and leave. I have heard from one of the forums here that an estimated 500K people will file this month since all PDs are current. EB-3 mexico + phillipines togther alone will be close to 300K. God help the Job market.
Also minimum wait time will be 500K/140K ~ 4 yrs before they get to process your GC. Add to that the time for namecheck backlog 2+ yrs. So total 6+ yrs before getting GC........

I read somewhere that doctors abroad who do the tests for consular processing cannot be used for AOS medicals.
u'll get RFE only if theres is a mistake in medicals, if there is NO medicals in the 485 packet, i think ur appln will be outright sent back.
whats ur PD, if its in the range of 2000 u still have hope that in next few months ur date becoems eligible for AOS.
ive heard that there are some doctors out there (of questionable integrity) who accept cash and give out medical reports. even tho this is a backdoor approach, u can make a few calls and give it a try. to make ur case more genuine, try to get a list of all attributes recorded in the blood and skin test, and get those done promptly done in india. atleast let the doctor copy over ur wifes actual stats rather than inventing it. If ur case is genuine, may be someone will be merciful to help u out of ur predicament.
Preponing visa interview without very valid reason cud be harmful. u never know, if they catch ur wife telling a lie then ull be walking on thin ice.
last year my friend visited india...he is on 7the year H1, and got 3 yrs extn based on 140. he had attached copy of approved 140 as proof...the chennai visa officer only asked him "is ur company paying for ur GC or you urself" ..he answered Company is paying full amount. and they gave him the visa. :-) if Govt is using approved 140 to give 3 yrs extn, obviously they know the intent to get GC...i dont believe telling truth that ur company is processing GC for you is going to harm you.

Section 245(i) is a part of the INA. In 2001, this section was updated to allow people present illegally to submit a labor certification. This resulted in the DOL getting 6 years worth of applications in April 2001. These applications led to the establishment of the Backlog Elimination Centers and the PERM process. The applications filed 6 years ago are still being processed by the DOL.
Btw if you do not support DREAM ACT than you shouldn't be on this forum...

It doesn't make sense anymore when you've so much retrogression.

1. They will get constant flow of applications rather than all at once. Plus they can control it by regulating the flow of I-140 approvals.
2. They will be able to better predict the visa movement based on their inventory.
For people like me, it will be good for two reasons:
1. I'll enjoy similar EAD/AP benefits that most of the people enjoy who filed during July 07.
2. No more H1B stamping.

This is wrong. The 7% limit applies independently to FB and EB. A country could have no demand in one area, and enormous demand in the other and the side with the excessive demand would still be limited to 7% of that quota - not 7% of the combined quota.
Also, I think that their estimates for China and India EB2 are too pessimistic.

Well, what is the point in saying it now, he should have said it in the 90s and early 2000 when industry was booming and people found a career path in coming to the US.
Right now, so much work is outsourced and it is continuing. Very difficult to get a IT job in US on h1b and IT consulting on h1b also facing so many hurdles. For any new immigrant on a software job who wants to get a h1b visa and green card - it is not an easy task.

Mine was filed on July 17th at NSC with RD Sep 10th. It got transferred to TSC, I received EAD,AP for me and my wife but havent recd FP. Opened service request 3 weeks back of no avail....:confused:

Do we have to attach photographs when we e-file for AP ?
For E-filing AP, you dont get any Finger Printing, so you have to send 2 photographs with your application.
Please make sure you write your name and Alien Number (A#) on the back of the photographs.

If you have red my posting clearly, I wrote, I don't bother about RED's/Green's.
I was hurt for the using bad language by an IV member on a matured immigration forum.
You responded to my post having not read it properly. This is what is called interpretation issue with the language. This is what I wanted to convey.

OK, they'll raise the fees (I can live with that). But how do we improve the chances of better services?
USCIS is asking for comments....If IV would be so kind as to submit comments for the raising of the fees. I humbly throw these out for discussion:
Accept the fee increases providing:
1) That USCIS propose public standards of reducing processing times to 30 days+10 day security check.. Automatically produce an EAD if it takes longer. Hey. We're all still in the country whether the process succeeds or not right? We would just appeal, submit more info or beat it until it's done. Who's any safer?
2) That RFEs not be used to manage work levels. Plus they ought not to reset the 90 day clock to zero if they issue one. That is ridiculous and unheard of.
3) That they simplifiy applications (a la Canada) so that "lay persons" can (carefully) fill in the forms. Lawyers not required.
4) That the USCIS abide by the laws. Especially regarding FBI name checking. We have a duty to follow the law. I'm careful to do so. The government should be careful to do so as well.. Call me a radical.
5) That they publish proposals to stream line the process with modern business methods and concrete goals. The increases should be tied to fulfilling stated goals of improvements of service. Otherwise they roll back. Have a 3rd (independent) party decide if the goals have been met in three years.
If we tax payers are giving them extraordinary increases in fees, we should at least expect some meaningful process improvements. Simply claiming that they need-the-cash-for-process-improvements is not sufficient. What is to prevent them from using the money to give everyone big raises and bonuses and a nice fancy new office, and big fancy new computers if they're going to continue to use paper and use the computers to access rickety old systems with terminal emulators? I'd love to deal with happy USCIS employees, but I'd love it even more if I had to deal efficient USCIS employees. (Give them the tools and they'll be happier!)

My manager surprised me today saying that I was promoted yesterday from a programmer analyst to a systems analyst. I have an approved i-140 and have filed my 485. My priority date for EB3 is current. I also have a 3 year extension of H1B.
There is no change in the job responsibilities.
Question:
1. How soon should I file my AC21 request?
2. What is the impact of this promotion on my H1B?
3. I have waited for 7 years and I may be close to getting my Green Card. How does the AC 21 impact my pending 485?
I declined my promotion. My manager said that it would take a lot of effort to unwind this promotion. He was not pleased with my request.
Any ideas?

We can get a employment verification letter. But now a days you need employment verification letter for many things. Just recently, jan 2009, I carried EVL for visa stamping. Now, my DL is expiring, should I ask them again for EVL. It has become more like HR nightmare for having a non-immigrants in the copany. These taylor made rules are not appropriate. When driving is a basic necassity, I could not comprahend why they need all additional documents. Any ways if this is true I have to ask my HR again to provide me one. Hope they do not get mad at me.
My HR already mad at me. Because
(1) First EVL - for AC21 job change
(2) Second EVL - to answer NOID
(3) Third EVL - for travel on AP
All the above in 3 months gap each after joining. Now if I ask for one more saying I need it for driver's license - she may ask if I also need an EVL to go to six flags or ride the NYC Subway
My HR already mad at me. Because

My lawyer is against re-filing. She said we could do it if I wanted it, but she did not support this idea. My package was complete 100%, so I should not worry, that's what she said.
