    I wish they hadn't closed the blog, I wanted to post on there. I don't see any posts on the link you have provided for the H2B blog on WSJ. Am I looking in the right place?

    Undocumented Immigration can be solved within a week. But no politician or anti-immigrant wants to talk about it.

    SIMPLY PUNISH THE EMPLOYERS EMPLOYING UNDOCUMENTED.

    Just put some US citizens who hire undocumented in Jail and then nobody will hire undocumented. All undocumented problem will be solved. But nobody wants to enforce laws on US Citizens. But everyone wants to enforce laws on undocumented because they do not see these undocumented as human beings.

    Instead of deporting 14 million undocumented, and wasting money on this. Just punish 1 thousand US citizens for employing undocumented. I am sure you will see some hidden anti-immigrants being jailed too. The greedy employers promote undocumented immigration by employing them, exploiting them and paying less salary. Why not punish the employers.

    No anti immigration site wants to actively work on this action item. WHY?

    i am not sure why you think kavya wont excel in her life - she already has a great headstart with close to 40grand in winnings! i also dont know why you think she will end up working for a non-ivy league educated manager - & even then why its a bad thing to win a spelling bee..too many gaps or leaps in thoughts/logic?!

    If you come across and experience families who make their kids to go through the labor (hell) then and then only you would understand what he is trying to say. The other way of experiencing is to watch the pattern and construct of these spelling bees carefully and apply your own thinking process. Once you do this you would almost agree what logiclife was trying to throw to us.Spelling Bee competition, though make a child well aware about the roots of the words (latin, Greek roots) and provide enough exposure to the kid to understand the English language in its essence, it does not teach a kid how to think, how to become creative and innovative.

    Of course nobody can generalize that particular winninng kid will/may/won't/may not do good in life but more or less these are not the competitions through which parents with reasoning or thinking ability would let their children go. Yes there are some advantages but if you try to enlist then list of disadvantages would become lengthier..

    Thank you Chanduv23, for the prompt reply.

    Oh, I trust the attorneys to file it correctly, I was just wondering if there was any way of finding out if it was received and processed correctly. With the H1B, 140, 485, etc. you get a receipt notice, but I wasn't sure if that was the case with the G28, probably not.

    The thought of the remote possibility of any correspondence from the USCIS going to the old attorney (for whatever reason), and not making it to me/new attorney in time to respond to it, is a little unnerving.

    Well, anyway, no point losing sleep over these things, although it is easier said than done.

    I agree. And this has happened. This happens NOT because new Attorney's G 28 did not get filed properly, it happens because VO may mix it up. Usually when a employer requests a revocation of 140 - in real - what the employer requests is "As this employee has left the company the prospects of his future employment with us is not there and we will not support this 140 petition in future. In other words an employer is telling INS "They will never hire you in future".
    So the VO does two things here. They send acknowledgment letters to the employer and their Attorney on file and send RFE/NOID to you and your Attorney. In this process some mix up might happen. Remember, a lot of VOs are very ignorant about AC21 and they may not follow the guidelines properly. Under the AC21 law it is clear that all you do is to change job to a same/similar position. As long as you follow law nothing must happen.

    Check your online status regularly - if you see LUDs call customer service - verify your address. If you do not get mail in 5 days - call again - if it is 15 days past call and ask them to fax it.

    Sorry to hear about such cases. We all have to realize one thing here. The employers need us equally bad as we need them (more often than not, not talking about Indian consultancies here). If ever one encounters such racial discrimination and open abuse at the work place, the best recourse is to file a complaint with the higher ups in the HR, start searching for another employer and ditch the current racist employer at the right moment with an appropriate email sent to everyone detailing why the person is leaving at such an important phase of the product development. Yeah, this might sound un-ethical, but sometimes situations do demand such drastic measures to send the right message. That's when all these racist employers would realize the importance of the person that just left the company. Then they can try to fill in the position with their preferred race qualified person and see how difficult that gets!!

    Better still, please talk to your friends and family in other parts of the US and find the areas in the US that are cosmopolitan and try to move to those places. Yeah that is very difficult in the short-term, but in the long-run, you would have peace of mind and a good quality of life after making such a move. Fortunately, i am in the Bay area and i have rarely encountered such racial prejudices out here. Just my two cents.

    I did the same thing. I was under racial attack and complained to the HR, was on my 6th year of h1b. I did not get any justice, the HR was also having the same opinion, was talking about Indians in the company on h1b and all issues associated the and she said she has 14 years of experience dealing with this and knows how to fix this problem. I was kicked out of the company. No look back at all. I pleaded, told her I will take back my complaint and will not complain but no use. They terminated my employment and could never never fill that position again, but the company did not survive for long though.
    I moved to desi consulting after that and things started going a lot better with a understanding employer and I am doing better now.

    Fellas - watch out, especially those working in BPO etc.. where they have to deal with abusive clients...

    Recently, I stopped taking all these racial comments in a serious way, 2 days back my co worker made comments on how my "curry smells" when eat at my desk. My wife wakes up early in the morning and cooks the food with so much love and affection and I eat that, whereas he eats burgers and fries from cafeteria - look at who is commenting??????

    First your PD has to be current for USCIS to look into your RD.

    Not quite, as I understand it, if your PD is not current, your AOS will continue processing and will eventually get to a "approved, pending visa number" state. You can pretty much be in this state for some time, and then when PD does become current (as happened from May through July this year with the significant shift in PDs in the bulletins) there will be a massive approval rate of all those pending applications.

    USCIS doesn't stop the application process just because your PD is no longer current

    This is how USCIS got through 60k unused visas in a staggeringly short time. There were a LOT of applications that were ready to go, they were just waiting for those numbers. USCIS didn't all of a suddenly quadruple their efficiency in processing :)

But each person can modify their version based on what they think.

    I belong to an organization called Immigration Voice, a small group (and to my knowledge the only one of its kind) that is attempting to help legal tax-paying highly skilled immigration applicants who have been in waiting in limbo for many years.
    We are all highly skilled immigration applicants who are stuck in limbo, some for more than 8 years, despite being fully legal, tax paying and highly skilled.

    Currently, a bill that is under consideration by Congress called the SKIL bill will solve almost all of these non-controversial issues.

    You have 2 choices:

    1. If your PD is before 2003 they it may become current in Oct and you can file for her, but if not then it is highly unlikely the dates will move in the next several years. If you both are not born in India/China ur chances are better.

    2. She continues on her H1 and wait till your priority dates become current which can take upto 7 years.

    This is a very bad situation i would highly recommend that you move heaven and earth together to get married and file this month. Pardon me for saying so but ur stars are alligned till Aug 16th only. Good Luck!

    Hello,

    I am new to this site and had a question about the Nov. bulletin that maybe someone might be able to answer. I am EB3 ROW and I am still not able to submit my I-140 + I-485 concurrently by 5 days (my PD is July 5, 2002).

    Do you expect the EB3 ROW dates to move forward at all in the Dec. bulletin?

    I just need to know because my lawyer is pressuring me to submit my I-140 not concurrently, but I wondered if I just should wait for a month.

    Lately i see a lot of new members coming up in the forum, with lots of questions about their problems that they are facing. And lots of good hearted IV members also give their diligent answers for them. One hand I am glad IV is getting new members, on the other hand i am wondering where were these members all these days.

    Please don't get me wrong, As much as I like new members joining in the forum to get answers for their questions, I also would expect them to take part in any the activities or initiatives that IV is undertaking. Therefore I urge, every new member to volunteer in the IV activities and be an active member of IV and be a participating member, so that IV helps you and you help IV. Having said that, new members, WELCOME TO IV, post your questions and I am sure you will get good answers from many good hearts in IV.

    All the suggestions are good but think who gets to influence USCIS more ? It is the EMPLOYERS.

    Action Items are:

    1. We let our employers know the current issue
    2. Notify AILA , MEDIA that we are boycotting work or taking leave for a day or a whole week. This is the same day everyone takes leave and notifies the employer that they should do something
    3. Do some rally on the above day.

    I got your point and that of logiclife's and I agree....there is no need for them to mention the illegals (a cheap attempt on the part of WSJ). I was merely pointing out that WSJ technically does not say that we (high tech workers) are illegal.

    the usage of "But" to start the sentence in the WSJ article implies it is related to the preceeding line. hth!

    If both of you are Indian citizens then your only option is PIO as OCI needs atleast one parent to be a US citizen.

    If we move back to India on Indian passport and my son continues to hold US passport then he has to leave the country every 180 days or register with police under PIO card scheme. That is a very strange. Children of Indian citizen are at a disadvantage compared to those of a non-Indian citizen even in India.

    I thought i wouldn't marry till i get ma GC coz i didn't wanna gal to come n rot here without a job being on H4.
    but now i've gotten so freakin old waitin for the GC n still waitin that i might not get a gal to marry.:eek: :eek:
    well there are always other things to do for a H4 ..
    At present My wife on her H4 is pursuing her Master's degree ... I donot need to tell you that I got a deep hole in my pocket..
    Also I have heard some H4 spouses doing volunteering work..
    Also you can have kids and get another piece of 'work' out of the way...If anyone has more ways of making the better of the situation let me know...
