I have a couple of questions, pl let know if you have valid info.

Situation: Spouse came to US on H4 and then got converted to H1.Due to delay in pay and not a strong case, she is not willing to go for H1 visa stamping next time when she goes to India. She wasnts to go for H4 visa stamping instead.

    1. Is it better to convert to H4 here and then leave for India? We feel that if it would take time to convert to H4, then instead of waiting she can work till the last day here and then quit and leave(because she wants to leave ASAP). Also changing from H1 to H4 here means submitting paystubs and other documents and more scrutiny. I think in Chennai consulate there will be less questions if applying for H4. Any thoughts, pl help?

    2. If applying for H4 in Chennai, will they ask for paystubs from her previous H1 status? They shouldnt since she is applying for H4, but I still wanted to know. If they ask why do you want to change back to H4, what is the best answer?

    3. Travelling on an expired visa from East coast to Chennai. If there is no time to get transit visa to travel thru Europe, which is the shortest route/best airlines to get to Chennai quickest from say, Atlanta? Pl help

    This is urgent, PLEASE HELP

In November 2006, Secretary Chertoff discussed a risk-based approach to homeland security threats, vulnerabilities, and consequences:

[T]he core principle that animates what we do at DHS . . . is risk management. It is a recognition of the fact that management of risk is not elimination of risk. There is no elimination of risk in life, and anybody who promises every single person protection against every threat at every moment in every place in the country is making a false promise . . .. What we do have to do is identify and prioritize risks -- understanding the threat, the vulnerability and the consequence. And then we have to apply our resources in a cost-effective manner, using discipline and common sense in order to minimize the risk without imposing undue cost on our communities and our families.

Despite Secretary Chertoffs continuing emphasis on risk management, USCIS performs FBI name checks without the benefit of risk management modeling. In recent visits to USCIS field offices, a number of leaders have questioned the usefulness of the FBI name checks citing some of the same concerns discussed here. The process is not working and consideration should be given to re-engineering it to include a risk-based approach to immigration screening and national security. The U.S. Government Accountability Office recently noted in a report that [w]hile the Secretary of DHS has expressed a commitment to risk management, DHS has not performed comprehensive risk assessments in . . . immigration and customs systems to guide resource allocation decisions.

Every effort should be undertaken to identify and remove persons who pose threats to the United States, which would include rescinding immigration benefits after USCIS has granted them. It would be irresponsible for law enforcement entities to stop their investigation of a potential crime merely because the person who is the subject of their investigation has obtained a green card or U.S. citizenship.

Similarly, it would be illogical to think that delaying issuance of a green card or U.S. citizenship will prevent a criminal from committing a crime. Considering the protection the FBI name check provides, the cost of government resources used, and mental and actual hardships to applicants and their families, USCIS should reassess the continuation of its policy to require FBI name checks in their current form.

    Pappu,

Please let me know your thoughts..
I-140 is approved. I-485 was filed in July 2007. I have an opportunity to move to another company for a similar job profile. But the new company wants me to work as a contractor (hourly) on W2.

Is that a problem when filing AC-21?

    Please advise.

You may be able to find answers in the IV wikki - have you tried it?

From Immigration Fight Goes On Without Some Troops (http://immigrationvoice.org/forum/showpost.php?p=171495&postcount=1126) By June Kronholz | Wall Street Journal, September 20, 2007

With a comprehensive immigration bill unlikely to be revived in this Congress, supporters now are trying to pass smaller pieces of the original.
Third could be a business-backed measure that vastly increases the number of visas available to highly skilled workers.
Meanwhile, NumbersUSA, which helped kill the overhaul bill in June, is at it again. Members of the grass-roots group flooded Senate offices with faxed letters of opposition to the bill last spring. Now, its urging members to call their senators, and offers talking points should they be connected. Among them: Illegal immigrants would get in-state tuition, while out-of-state citizens dont.

Thanks styrum. That sheds some light on the issue. From that I deduce that the only way to file an EB2 for jobzone 4 /svp 7 occupation, while minimizing the risk of audits, is for the advertised position to require an MS+0 and nothing else. If someone happens to have a BS+5 then they can use that as a substitute for the MS+0.

If anyone has been able to successfully file under circumstances negating the above, please do share the specifics with us .

If you are single and are in a position not to get married b4 August 17th please think b4 applying for 485. It is of no use to you unless you want to switch jobs on EAD which is a HUGE RISK!!My guess is you are going to get married at some point of time(Barring guys who are already in their midlife crisis b4 marriage) and would apply for your wife's Adjustment of Status. Please apply 485 togather when the PD bcomes current again. Bear in mind that even if you apply now b4 marriage you have to maintain your H1-B status. It will only make it worse when one had already applied for I-485 coz you could only get 1 year extensions as opposed to 3 years when you have an approved I-140 and have not filed for 485. Don't get overzealous and apply now and regret later!!

I am on H4 for past 2yrs. My H1 is valid since Oct07. I want to travel to India in Dec this yr. I have few questions:

    1. I haven't started to work. So, what is my status as of now, after my H1 being aproved and valid since Oct1 2007?

    2. My H4 is valid till Mar 2008. If I want to travel to India in Nov end and come back in Dec, do I need stamping on my H1 from the consulate.
    If YES then:
Do I need to show any pay-stubs?
    I NO then:
    a. At the port of entry what status is I am supposed to declare?

    b. If I enter as an H4 then does that invalidate my H1 visa?

    Plz help!!

The above mentioned case was later denied. AAO withdrew the approval. See this link -
    http://www.uscis.gov/err/B5%20-%20Members%20of%20the%20Professions%20holding%20Ad vanced%20Degrees%20or%20Aliens%20of%20Exceptional% 20Ability/Decisions_Issued_in_2009/Apr282009_01B5203.pdf

This was a good find. The decision actually opens up more doors then it closes.

USCIS in the past; and specifically Nebraska service center would deny I-140's if you did not have one single source degree equal to U.S. bachelors degree (ie., combination of degrees was not allowed).

this decision basically says that 3+2 will not be considered equal to masters but will be considered to be equal to bachelors degree. However, since the labor didn't allow for bachelors and five years of experience then they consider him to not be qualified for the position.

Looks like 3+2 will still qualify for eb2 but through the bachelors and five year route.

If you look through many of the appeals decisions you will even find contradictory stuff with regards to combination of degrees to get to bachelors equivalency for eb2.

That's why when you are first starting the greencard journey it is safest to go eb3 route and then later give it a try for eb2.

the reason it will never work is not the lawyers. the immig lawyers for the most part are honest people.

the problem is the employers. employee's loss is employer's gain. it is simple enough. if the point based immigrant is allowed in with a EAD or a green card (like in canada/australia), the employers lose out big time.

The only reason h1 exists is because employers want cheap labour. That is why they want more h1s. Because h1s are justified from business point of view, that is why it is illegal to charge the employee for the h1 costs.

But they never talk about how the h1s get screwed.

Because the h1s are screwed by them.
no matter what , H1 are for employers for them to be competitive, how come all of a sudden employers are talking about illigal immigrants these days, because they have found out that they can get them at a very cheaper rates, the moment you try to put wage garuntee in any of the immigration bills, this what kenndy wants, republicans run by big business are not longer interested in the immigration. perfect example of modern day enslavery. if they make 400K H1B's as per the strive ACT, Green card will lose much of its significance, because most employers will find easy to hire H1B raher than paying 20% or 30% higher to somebody on green card, that is the reason employers are after H1B.

    thanks
