file it immediately and start working for C. If there is an RFE, it'd take few months by that time you just send ur current pay stubs. INS is generally flexible for a month or so..act fast
Do you mean start working for company C or D coz I wanna work for company D?

On Sept. 14, President Bush signed the Honest Leadership and Open Government Act of 2007, an ethics and lobbying reform bill, which enforces a number of new restrictions.
Under the new law, lobbyists are prohibited from providing gifts, food, beverage and travel to Members of Congress, their staff or employees. A violation of this law could result in civil fines and/or criminal prosecution for the Company and individuals involved.
?????
This is already known. How is this directly related to immigration or IV? Please make a point because I failed to notice it.

Did you find out the answer? The same content is in the tread "485 for working couple."
I have a question about multiple 485 filings.
My PD was Eb3 May 2002 and I filed my 485 last week. My wife was added to the application as well.
Now my wife's PD is current and her date is EB3 Jan 2006. Can we file her 485again and add me again as her dependent.
Attorney says no but I am not sure if I can believe them. Besides there is a risk of not filing again for her seperately as in the future the dates may retrogress. I would prefer that both of us have independent applications in as well so we can both fall back on each others application if the need arises.
Is any one else in my shoes and knows the answer

Can someone explain how the lawyer files I-485(Does she e-file? or mail it to USCIS?) and how we know about it? How long does it take to know you have filed it? and how do we know about it?Lawyer mail the package to USCIS. Good lawyer tell their client tracking number and then send email with case numbers and copies of receipt notices.

There are lot of discussions about this issue, and there seem to be mixed opinions so far. it may not be a bad idea to check with your lawyer, and post your findings to the group. AFAIK, it is possible to file multiple I-485 but interim benefits should be tied to only one.

A friend of mine told me that we do not have to pay Social Security Tax while working on EAD. Does anybody know if this is true ?
That would be a huge plus in case its true.
Your friend may have confused 485 based EAD with F1 OPT based EAD. On F1, you do not pay SS or Medicare. On AOS based EAD, you do need to pay SS/Medicare taxes.

Hi,
There is likely to be a change in my reporting manager. My current reporting manager will still be in the company in a new role, but I will be reporting to a new manager.
My PERM application (LC) was filed in mid Jan '09, and is still being processed. I would like to know if this will affect my PERM application in any way.
Nothing else has changed since i took up this position, same title, salary, location etc.,
I have not found much info on this topic and so, decided to post this question. Thanks in advance for your replies.

Folks -
We urgently need a few people from San Jose to talk to NPR about immigration issues. If you are available today (Sunday Jan 13) or in the next two days, please send me a PM with your phone number asap. Don't worry about what you will talk - I can help you with it.
I've already tried contacting a few people from San Jose who had previously volunteered to be available to talk to the media but probably because of the weekend, I've not been able to get to them. So please other people from San Jose, please step up and help us out.

The news from CIS brings joy for a lot of the IV members.
So, express thanks by donating as much as you can for IV to continue to work for our cause.
Comparing with the attorney & medical expenses, the donation to IV is a small amount, and it will be worth a lot more than you can imagine.
BTW, I just donated $100 from Google checkout.
-C.
Admins,
Please make this a sticky to keep in the top.

Got an RFE request on a I485 that I think is a huge problem.
I spent a year in the USA in 97-98 on J1 student exchange Visa.
I went back to Russia, and finished the last year of high school there.
Then in '99 I came back to the USA on an F1 visa, did a four year college. After that I have been continuously employed on H1b, filed for green card in 2007.
RFE is requesting information about Section 212 of Immigration and Nationality Act.
How big of a trouble am I in?

It is not clear if they are going to initiate a name check again. This could be associated with when your fingerprints get invalidated. If they initiate a fresh fingerprint (for what ever reason) without refreshing the existing one, that could trigger a name check. So that could be why they have a secondary check on preadjudicated cases.

The information that is provided in this post is relevant as of Friday May 15, 2009. This is coming from our local AILA chapter Chair.
As many of our readers know, at the conclusion of the Marriage based adjustment of status interview, the immigration officer, upon approval, used to stamp the immigrant's passport with the I-551 (Green Card) stamp. This used to be an immediate proof that the case was approved and the applicant could work and travel using this stamp. As the actual production of the Green Cards became so fast, the practice of stamping applicants' passports stopped as well in most states across the nation.
It seems that things are changing, hence the recent notice from USCIS. According to the notice we received, the Green Card Facility in KY is undergoing renovation. USCIS' card production capability will be reduced over the next several months. They will expand the use of ADIT Temporary Green Card stamps as temporary evidence of LPR status.
The Stamps will be valid for 12 months (previously only 30 days validity was given). Work permits and travel documents (advance paroles) will be collected at the interview from the clients. The stamp will be the only proof of work and travel authorization in such cases. It looks like this policy will continue for the next 6-12 months. This is a nationwide policy and is not taking place only in San Diego.
We will keep you posted with more information as it becomes available.

Hi gurus,
Need some help, I was in US working for a consulting company and a good client for 4 years then due to some family issues I had to return back to India in the beginning of last year 08. I and my wife has visa stamped in passport valid till the end of this year. Now I want to come back to US and I am not sure if I can enter US again with the same visa as I do not have paystub from my employer for last 1.5 years.
During this 1.5 years I started my own business and tried various options but didnt work out well so want to return back to US and during this time we had a son who doesnt have a visa. Does any body know how I can return back to US, are they really strict at port of entry and would not let me in without a project. I dont have a project right now and will look for it once I am in US. Any input would be very helpful.
