All,
My 4 years and 2 months on H1B will finish in this November and we are in the process of applying for an extension. I have my 140 approved and waiting for my priority date to become current.
Can I apply for 3 years extension based on my 140 approval? or do I have to apply for 2 yrs extension to finish my 6 yrs first and then eligible to apply for 3 more years (if my priority date is still not current by then?). My HR is under the second impression (2 yrs and then 3 yrs).
Also, please can you specify the USCIS rule under which it is applicable?

You can apply directly for a 3 year extension based on your I-140 approval.

I want to apply AP for my daughter without lawyer's help. I didn't apply for her when I applied my 485 and AP but her 485 has been applied and I have the RN. Is it straightforward process. Since I applied for 485 July 2nd can't file electronically and must use old fee?.

AP is comparatively simple. You don't need to have a lawyer. Please go through all instructions carefully.
Yes you need to write a brief letter explaining why you need AP. You can say for family visit, family function ( if any ) etc.
I recommend applying online.

It looks like you are getting glare from glass or something. Get as close to the glass as you can and the lens as perpendicular as possible. A dark cloth and duct tape to put it up with would get you two things: (1) ability to block glare from lights behind you and (2) hide you from the birds so they settle down.
I've actually put the camera on a tripod and draped a large towel over it and my head/torso for camoflage, which let me stand outdoors and get closer without scaring them away. But I don't do that much because it's really tiring standing there, motionless :)
For the most part, a flash doesn't seem to bother birds much and it's a great help - you get better contrast and a faster shutter.

Guys,
I sent my 485/ead/ap filing fee as one cashiers check.
This Cashiers check was created in end of June 2007 ( generaly validity till Sept 07 (90 days). Application was mailed in end of July by Attorney.
Now based on general application process, i am worried about my cashiers check being invalid before USCIS cashes the check and they may cancel the application.
Has anyone else had such an issue, & what is solution to this problem.
Please suggest.

I'd mentioned the Silicon Valley India Community Centers (http://indiacc.org/Default.aspx)here before. They are apparently large, well run and well funded.
They put us in their Feb 23 newsletter (http://app.e2ma.net/app/view:CampaignPublic/id:866.206866750/rid:9942a913fae5c7ff928f6dce7356fc38). They got the description a bit wrong (workers on temporary visas), but hey they put our link in there.
I'm also working on having IV appear at some of their other events in the near future.

You can port to a new employer after your 485 has been pending for six months (from the date USCIS recieved your application). See IV threads on portability for more information.

Sorry you cannot claim. You have been a resident of GA, so rent/meals/commutation/laundry cannot be claimed as deductions in Tax return. You never had a home in NY/NJ. You will surely be a RED flag for IRS. Dont do wrong things to get some money. State the truth and be satisfied of the tax return you get.
However, you can surely ask your employer to give a part of your salary as expense reimbursement, which is legal.
Trust me, you get more tax return here in US, than in India.

My wife came to US on H4 and changed to F1 status thru COS. She is doing Masters 2nd semester and went for F1 visa stamping this week in India. She got 221(g) pink slip asking explain her projects, plans afer study etc. Visa officier withheld her passport and I20.
BTW the way I am on H1B and provided all the financial support documents.
I searched the online didnt any F1 getting 221(g) pink.
1)If anyone else got this for F1 please share your experiences and any tips.
2)How long it takes after repsonding to thier queries
3)what are the chances getting visa after getting 221(g) pink
4) Do you suggest getting any professional in drafting the reponse to te queries.. if so do you know any one in Hyderabad, India

Hi,
We had been to Canada in Sep, 2003 for our Canadian residency stamping. While on our way back to San Francisco, US immigration did not stamp our passports or take back our I-94's. Prior to this trip we had been to India in March, 2003.
Now I am confused as to what should be our last date/port of entry to US? I-94's/passport stamp still indicates our March, 2003 trip and Our Canadian PR stamp does indicate date PR was stamped in Canada. But there's not other stamp/proof on passport for our entry to San Francisco.
Any pointers/suggestions?

Travel to contiguous territory such as Canada for a period of 30 days or less does not count as last Port of entry because they dont take your I-94 or stamp your passport. Therefore you have to put your Prior trip of March 2003.

Not a lawyer- but my guess is that the date of validity on your H1b (First H1) is the day you can start counting your 6 years. This is regardless of when you started working for your employer.
Example: Employer sponsored H1 for Mr.X on April 2nd 2005. H1 approved with validiity starting 1st oct 2005. Mr. X flew to the USA in december 2005. Started working 15th jan 2006. The 6 years are counted from 1st Oct 05.
Now one can recapture all the months that the employee was on vacation. But I am not sure if this is still an option.

Right - You will have to wait to apply for 485. You can do so only once your Priority DAte is current on the VISA Bulletin.
You can file for i-140 though.......I guess you have a long wait to file 485 and EAD/AP

An H-1 would give you more flexibilty to change employers once you are here. However, the earliest that you could begin work here in H-1 status would be Oct. 1st of this year. With an L-1, you could presumably come right away. If an L-1A is possible, that could pave the way for a significantly easier and faster route to a green card.
Also, it is possible that in the not too distant future Congress could pass legislation to allow same sex spouses to confer derivative immigration benefits on each other. Check out the website: www.immigration equality.org

I am working for a company A with whome I have gone ahead and resigned with them i also filed my GC and 485 is still pending with them and also have EAD through them, recently i got offer from Company B which i accepted and they have gone ahead and filed my H1 Tranfer but recently i got one more offer from Company C which is much better.
What should be done in this scenario,should i again file for H1 Transfer through Company C or will it mess up my case even more
Join Company C since it is better offer. Look for your benefits..always.:)
