Your input and suggestions are excellent. IV (Immigration Voice) is working on the exact things you pointed very clearly. We will together make the difference with the upcoming bill. IV is today 5 days old. I think IV has made very good progress in last 5 days given the fact that most people are in holidaying mood and not paying much attention. But there is a long way to go. I would urge you to please actively participate in discussions and other activities to spread the word around to your friends and family with the request that they as well send the same message to their friends. You could help by posting the flyer in the attached file in places like Indian/Chinese/Philipino stores/restaurants/other meeting places and request your friends to do the same. This is the first step towards creating awareness to bring everybody facing this problem on common platform.
I agree 100% that misinformation, stereotyping, unorganized campaign with hastily typed faxes/messages by individuals hurt us in S1932. There were a lot of motivated individuals but most of us were not unable to create a concrete strategy to make the dent in S1932 as there was not platform to join hands. We are all on H1s/EADs and facing severe problems due to retrogression. We are all learning as this campaign is picking up steam. The idea is to be more organized. We have received personal emails and phone calls from lot of motivated individuals spread all around the county. All of these individuals want to see solution to retrogression issue. We need more individuals to come forward to actively participate for this cause.
Please continue to provide your input and contribution for this cause. Please invite more individuals to participate on this forum. We are a very young organization and maybe after 6 months, once all this is over for good, we will look back and thank individuals like yourself who�s encouraging words and support are so important for the success of this cause.

You nailed it man. As i said in my post yesterday what you described so well is exactly what happened and so my explanation of just 140 substitution was not accurate.
Please note the response I got from the attorney of my previous employer (the one who revoked)
This is exactly what I previously explained and what XX verified for you. The I-140 was revoked/withdrawn and the labor certification was substituted. If only the I-140 had been revoked/withdrawn then you would still be portable. However, as XX confirmed, the company used the case to substitute another employee.
Clearly the ex-employer and USCIS are at fault. I have the approved I140 and to date on my uscis portfolio it states that my I140 was approved in Feb 2005. I changed jobs in June 2006.
I am so &^^%$#@ tired, that if this does not work....I am going back. Enough is enough.
Don't loose your heart. I know this is a serious situation but do not become emontional, just stay calm. This is clearly a confusing situation and a bad move by your employer. Have you got a good attorney? Just consult a good attorney and go with what s/he says. This is not your fault and before thinking of going back, fight for yourself and your family. I am saying there are problems with USCIS not just the one you are pointing out.
My point is if more and more people like you file lawsuits against USCIS for the different kinds of injustice they think USCIS, DOL and DOS had brought on them, we ( all EB categories)will be in better shape to fight together for the bigger cause which is more predictable process and processing and closing as many loopholes as possible in the employment GC journey.

Hi All,
I got the I-485 approval/welcome notice from USCIS for myself and my spouse today. But the wierd thing is that my NSC online status still shows RFE response received and case pending (from 2008)...the welcome notice says I should expect to receive the card in 3 weeks...guess I am greened.
Anyone else face a similar situation?

Does the letter need to have the same information as the LC. I can get a non I-485 related employment verification letter but here is the catch. The employer is dilly dallying on filing for I-485. The employer can give a letter with my job title which is "XYZ Developer" include salary, length of employment etc. But the "Final Determination" copy that I have says occupation: Computer Software Engineers, 15-1031. Does the letter have to state "Computer Software Engineer" or can it state "XYZ Developer" ? If it has to be the former that will only alert them that I am bypassing their stonewalling and the employer is only likely to refuse to include that as the job title. So which is which ? The job specific title ie "XYZ Developer" or the DOL title per the "Final Determination"
Does anyone have an answer or idea as to the job title employer verification letter question ? I didn't see any response as yet so I thought I'd repost the question. So far I've only seen some suggestions on other forums that suggest filing anyways without the letter and waiting for an RFE which might then coax the employer to do the necessary then, waiting for I-140 to be approved and then filing with W-2's (or paystubs -- I don't recall) or waiting 180 days, filing without the letter, switching to a new employer after the 180 days pass and then submitting the new employer's letter.

EB1 visa never belonged to EB2 or EB3 category. What if there were enough genuine EB1 people to claim all the EB1 visas. There won't be any spillovers. Spillovers are bonuses. It is never our right to claim those.
If you want your GC faster, work with IV for country cap removal and recapture.
Have you donated a single dime for IV's cause ?We always find it easy to go against fellow immigrants than fighting the injustice at root.

You may be ok with the fraud being done by many of the L1A visa holders and their sponsors. However I am not and I shall support any steps taken by the IV member "L1Fraud".
You may think that the spillovers are bonuses and it�s ok if we do not get them. I differ with you; I feel if someone using fraudulent methods takes our bonuses away we need to protest against that.

I don't want to be a spoilsport.
But there is a possibility that EB2I has not yet retrogressed (inspite of heavy porting) because USCIS knows EB1C 12000 will flow to EB2 right. In that case we may not see movement of dates in par with 12000 spillover.
Maybe I am pessimistic.
In all calculations, it is mentioned that porting at max could be 6k/year. How did we come up with this number? Any proof or just a guess?

I keep reading from the forums that some apps with PDs as late as Dec 2004 and a couple of Jan 2005 got approved. Wondering why the earlier (eg. mine is July 04) not approved yet. Could we all join togther and write a letter to Napolitino(Thanks to SoP for the idea) and ask her to take some action on our cases?

Only thing I know is that if you come before me in the line I am affected. It is not a DMV line where every one will get their License, it is a ration line where the items are limited.
Call it selfish call it any thing else but these are the facts after being in the USA for last 12 years and two different labors.
You have every right to look after yourself. But it should not be at the expense of your comrades who are affected by this unjust system more than you are.
Solution: direct your ire against the system that is unjust to you. ( USCIS, DOL, Gov etc). That is what IV is trying to do. Let them give enough visa numbers for EB based applicants.
If many of the great leaders of the world were as selfish as we are, we would all be a herd of animals.

I have all the approval Notices and I -04 that came at the bottom of 797. I traveled back and gavce my first I-94 back at air port, I do not have copy of that I-94. Do I need to have it to File the 485. Or my Current I-94 is good enough for filing?

My priority date is current now. I read somewhere that I have to file I-485 between June 1st and June 30th. is this correct?? what if my medical exam results are not ready and I am not able to file before June 30th?? can I still file during following month, July?? Please help. Thanks

The last updated on my and wife's files were on 05/12/2009 (after the RFE Respnose)
I Went to the Local USCIS center on 08/02/2010. IO mentioned that Name check and FBI check had cleared. But he could not tell if my case was assigned to an IO. He asked me to open an SR. I called the 1-800 number and opened an SR on 08/03/10. I got a standard email from USCIS for the SR I opened, on 08/11/2010. It said that my case and my wife's were both were under review and it would take up to 60 days for them to process it.
On 08/13/2010 8.03 CST, I got a SMS on my cell that My case status was updated. I had received that Card Production was ordered on 08/12/2010.
Now, I am waiting on my wife's approval.

According to the report Mexico EB3 has 2240 pending cases till the end of 2001
and India EB3 has 1630 pending cases till the end of 2001
Then according to current visa bulletin why does PD for India way behind Mexico???
and even China is behind Mexico when they have only 108 pending cases till end of 2001.
Something is wrong with the numbers or they mean something else??

Clearly the USCIS and the DOS have absolutely no clue as to how to manage the visa regime.
On top of that these smart asses think they are answerable to none - since this is just a matter of 'to be' immigrants.
Now the class action suit proposed by AILF will surely shock them from their oblivion and bring them down to REAL world.
All said and done...anyway the gates will open in Oct 2007 !!! Guys and Gals...go enjoy your week end !!!

Why dont USCIS clarify on the report they put out
1. Lack of description and detail about what it is ?
2. No time stamp on the report
3. Provide some commentary and detail about the parameters used in the report.
