    Thanks fromnaija, If she maintains any non-immigrant visa she can be added without any 'follow-to-join' petetion right i.e., she can be added to my 485 just like the normal process when my PD becomes current.

    Yes that's correct as long as the marriage occurs prior to when you want to add her.

    Returning to the US after living abroad for 9 years and need to know what is the best process for my wife to re-apply for green card.
    History:
    My wife and I have been married for 20 years, own a home in the US and have one child who holds a US passport. While living in the US my wife held a Green Card. However, when we moved she surrendered the card. Now we are returning to the US and she need to get the Green Card once again. Does she need to apply as if this is the first time or is there an application or process for previous residents or Green Card holders?

    Thank you for any and all help you can provide.

    JakeJake, am not sure but have heard from some previous GC holders that once you surrender then it is very difficult to get it back. She might have to start all over again. Have u checked with any attorney regarding this?

    I am not sure what is the process after fingerprinting. Can someone please clarify?

    I believe NameCheck must have been initiated. As far as processing 485 is concerned, does the PD have to be current?

    I am trying to figure out what is the tentative schedule for the "magical" GC to appear in my mailbox :) ?

    I would appreciate any pointers / links

    If PERM is pending for over a year, then the new employer can apply for H1 extension for 1 year. This whole PERM process will have to re-started with the new employer.

    Since this is a unique case, you should check with an attorney.

    Hello,

    I needed your advise whether i have a case to file an APPEAL to USCIS granting me 1 yr H1 extension (beyond 6th Yr) instead of 3 yr extension.?

    Recently my 7th yr extension was approved for 1 year in Jul'09 with petition valid date till june'09 (date in the past) . At the time of filling the 7th yr extension, my I140 was not approved but during the processing of my h1 extension my I140 got approved and i had sent the approval copy along with an RFE i recieved in May'09.

    Let me give my case background in details.

    * LC applied in oct'07
    * I-140 applied in May'08 after LC approval
    * 6th yr on H1 ended in June 08
    * had to return India since my LC < 1 yr and I-140 was not approved
    * Employer based on an attorney's advise suggested to apply my 7th yr extension from India once my LC is one yr old (i.e. Oct'08)
    � Mar09- applied 7th yr extension based on Approved LC (> 1 yr old ) and applied I-140
    � Apr09- I-140 approved
    � May09 � Received RFE on H1 extension, replied along with a copy of Approved I-140 hoping to get 3 yrs extension
    � Jul09 � Received approval on H1X extension for 1 year with petition valid till Jun'09 (1 yr extension)

    Appreciate your advise on the same.

    Most of us with English as our native tongue are spoiled and speak no other language well. And, as Fred says, some of us don't do well with English either...

    The mountains are nice, though, since both the foreground hill and background hill are the same apparent height, it does not have as much impact as it could have.

    The gull shot is sharp, but will appeal to people more if you get them traveling basically toward the camera, rather than away from the camera as is the case here. I have also found that I like to have some space in front of an animal/bird/fish so it looks like they are going somewhere.

    Just my opinion. The most important thing, of course, is that you like them :)

    I recently found a new job and they filed for my H1 transfer in premium processing. I am still working for my old employer. Now I have got an RFE questioning why my salary (in 2009 W2) which is less than what was mentioned in my previous petition. Even though I have all my paystubs I was on bench for few months between march - may 2009. I have a leave letter for 4 weeks vacation in may and my salary was reduced when I got new project. Which explains why it is less but may not be enough to prove it to USCIS. Salary in W2 could also be less that prevailing wage. Right now I have following scenarios
    1. WIthdraw application - not sure repurcussion of this.
    2. Respond to RFE with mentioned reason which can have following outcomes
    a) Appoved - (good i will be more than happy)
    b) Approved with consular processing - (I dont want to travel at this point of time outside US)
    c) denied - (not sure)
    3. This case goes to DOL and there may be investigation or indent of revoke sent to my employer. Can this happen?

    Here are my questions
    1. Senario 2.b. If I get "Approved with consular processing" do I have to travel to India for stamping immediately or just get new I94? What will be my current status then? What if I decide not to join the new employer?
    2. Senario 2.c. If I get "Denied" what will be my current status?
    3. What should I do so that I am not out of status and I dont have to travel to India for stamping?
    4. Scenario 3, Can this happen?

    Any response will be appreciated. Thanks!

    You can also extend the H1b...if your labor is filed 365 days prior to your H1b expiraton...
    You are looking atleast 21 months into future...there are so many things that can happen...
    140 rejection may not be an issue... but in case your worst fear comes true...you will be alright if it's rejected before feb 2008.
    Even then there are other ways around this problem...

    I am planning to visit Canada sometime in the summer, and being Indian, I need a visitor's visa.

    The Canadian consulate doesn't have much information about Advance Parole holders in the US applying for a visitor's visa, and it looks like the process is the same as for F-1, H-1B holders.

    I am wondering if I need to send the original AP (as a supporting document) or if a copy will do.

    I can't go to the consulate in person, and have to send my stuff in the mail, or this wouldn't have been an issue.

    Is it possible to have second H1b visa and Labor certificate approved for employer "B" while working on H1b visa and having Labor and I 140 approved for employer "A" ??

    Yes, that is possible. However, you don't need to have a second H1B with employer "B" in order for that employer to apply for LC and 140 for you since LC and 140 are for future jobs.

    Hi,

    My L1 and I-94 is valid till August 14th 2009 -- I want to know if I can travel India and come back before it is expired. Are there any restrictions on port of entry when visa is nearing to expire. I would not take chance if there is a porblem in international travel and if I have deportation issues at the point of entry then I am not willing to go. But I want to visit my parents as they are not doing well.

    Also, I am thinking once I am back from India then I can apply for L1 visa extension -- is it a good idea to apply for extension after I come back or I can apply and go to India for vacation.

    Please guide me as I am in a fix and I am not able to take any decession.

    Hi All..

    I am on H1 since Oct 07. I haven't left USA so far and so I haven't gone for stamping. However, I heard that I need to go to stamping before completion of 1yr after getting H1. Is this true? and to what cases does this rule apply?

    Please help. I am confused.

    If I file my I-485 during the next 2 weeks and assuming the super number of filings, what is an approximate date for fingerprinting. My wife has to visit India for her sister's marriage in Oct-Nov time frame.

    You are okay, when you leave current employer, make sure there is not an overlap in dates when you get paycheck from there and get paycheck from new employer. couple of days won't matter but if there happens to be gap of more than 2 weeks you will probably need to explain that later at the time of 485 approval
