    I agree I too have never seen H1B only ad's anywhere even body shoppers never post this kind of ad which is blatant discrimination. .

    Pittsburgh computer consultancy is paying $45,000 in civil penalties over claims it discriminated against legal US residents by advertising only for developers on H-1B visas.

    The case was brought against iGate Mastech for placing an ad for 30 programmers between May and June 2006 "that expressly favored H-1B visa holders to the exclusion of US citizens, lawful permanent citizens and other legal US workers" according to the US Department of Justice.

    So-called citizenship status discrimination is prohibited by the US Immigration and Nationality Act. The DoJ said it is "committed to protection the right of all authorized workers in the United States against citizenship status discrimination".



    Get your facts right before posting. mastech is not the only firm that did it. As you pointed out, many of these fly-by-night operators (and bigger outsourcing companies) offer below market salaries, pocketing the difference like parasites.

    Don't drag me into this.. It is totally cool if you want get information from multiple sources.. IV intention is not to provide news updates..

    IV is a platform for fixing legal immigration.. That takes money to do that.. So there various innovative ways an organization can try get money to reach its goals.. This is one way..

    I support and understand this initiate and hence I am writing in Donor forum..

    I am not sure if u were born as an idiot or became an idiot after being turning a so called "donor".
    To be frank I stopped contributing as and when IV started having donor forums.

    There are thousands of websites and forums througout the internet to get info and what VKBris posted may not even come close to what Q and Teddy and so many others used to share as a group.

    Now coming on to freebies,What benefit does IV provide to past contributors.I have contributed in the past, have been active at the initial stages,have spent my own money and booked airtickets to meet senators.Been a leader in a state chapter.But later realised that it was not worth for this forum which has partitions among so called donors.

    Why the heck does any one want to see in a home page about posts on a donor forum.Just hide it and keep it among yourself and discuss .

    I don't mind, you just copied my post from another thread (http://immigrationvoice.org/forum/showthread.php?p=83656#post83656)(minus the links).

    What are you tryiing to say?

    I am speaking from experience. Download the forms needed for filing 485, EAD and AP. Then when your attorney send you his/her set ( normally they do this in 2 stages - one they will send you a draft copy to verify and correct all info - some have online questionnaire; stage two - they send the final forms for you to verify and sign again - this they may do paper copy or online PDF - that cannot be edited - not fill able forms).

    So, here I am providing links to all forms that I know are needed. These from uscis.gov site are fill able. Weekend is coming. Fill them, and print and keep them.

    When attorney sends papers, compare yours with their and do corrections in theirs ( usually it will have stamps of the firm)

    Application To Register Permanent Residence or Adjust Status - I-485

    Medical Examination of Aliens Seeking Adjustment of Status - I-693

    There is a supplemental 693 also for vaccination records.

    Biographic Information - I-325 A
    There are A, B, C and other versions. I filled A

    Application for Employment Authorization - I-765

    Application for Travel Document - I-131

    Affidavit of Support - I-134

    I completed all these forms with 100% correct info- still the Paralegal - made mistakes again and again ( I can't correct the PDF as Adobe PDF writer is 1800 USD). I lost ONE precious week. Hoping to file on 06/01/2007, filed on 06/08. Learn and be wiser from experience, yours and others.

    Just a silly question popped up in my mind...

    Doesn't DOL have a directive telling employers, they have to try to recruit US Citizens first, and only if they do not find properly qualified US Citizens they can go on to search for people having 'other work authorizations' . Isn't that the whole basis for the approval of our Labor certifications in the first place???

    So can the employers not use that directive as a legal loophole and try to prescreen the candidates and ask them whether they are US Citizens or GC or EAD or H1 and so on... as a hidden ploy to figure out whether you are GC or EAD while externally they can still put on a facade that they are just strictly following the legal directives that DOL has laid out?

    Doesn't this 'Try to hire US Citizens first' policy of DOL in total contradiction with the I9 statement of 'no discrimination based on work authorization' ???? I am a bit confused here :confused:

    If this indeed is a legal loophole that employers/recruiters can use in their favor, then admins please delete this post so that the yet unaware recruiter/employer perusing our forums may not get wind of this deadly legal weapon !! :)

    Hi thanks for the FAQ.

    I have question, really do we need to submit
    Form I-134 Affidavit of Support (notarized) or I-864 for employment based dependents AOS.

    Why some attorney are advising and some are not?
    If we follow 485 instructions we do not need to submit.

    Are there any body submitted with out affidavit of support to thier dependent's AOS?

    It looks like a good discussion. Please note i guess you are a highly skilled legal immigrant in H1B/EAD. What are the chances of you gettting a NOID and you would be back to your home country if you cannot keep a job in H1B.

    Do whatever you wish, Gain knowledge and don't sit in your house with morals. Later if u make good money (billionaire) donate it or send cash with a envelope, I was not able to sleep last night because i walked away from my home, but now i am a wealthy guy.

    Hey Buddy, as far as I know when you use AC21 you loose your non-immigrant status but start working leagally. So changing H1 to the new company is not needed.
    And as far as I can think, if you change your H1 to a new company at that pont it might even affect negatively on your green card process. Please check that with a lawyer.

    Total BS. Do you know how the market is. We have 2 open positions (dot net developers) that I am trying to fill up. We have got over 200 resumes in less than a week.

    So many consulting companies are offering H1-B resources at 40 to 50 dollars per hour.

    Wake up and smell the coffee.

    Did anyone see any Soft LUDs on their 485 or old EADs before their approvals/RFEs?

    My PD is June 7 2006, not current. Yesterday, I had a soft LUD on my 485 and my first EAD. These two haven't seen any activity since early 2009, and I'm wondering if this means anything or if I'm reading into this a little too much.

    Hi,

    Can anyone share their expert views on this scenario.

    Say, I have approved I-140 (current PD) from employer A (never worked with). Work with employer B in a different. Now if employer A applies for I-485 and after it is pending for 6 months, Can I invoke AC21 to continue the GC process while still with employer B ?

    Also is it possible to have 2 separate I-485 filed from different employers.

    I have heard the above is possible. But, I am curious as to how AC21 is interpreted. Isn't AC21 essentially an instrument to change jobs without hampering the GC process. In this case since one is not 'really switching jobs' how will this be treated or possible ?

    Finally received my passport this morning. Consulate sent it to VFS on Friday and I received it today through Blue Dart.

    Int Date: Dec 17, 2007 @ Chennai Consulate
    PP Rec. Date: Jan 28, 2008

    what was the approval date on ur h1b and what uscis center approved it? thanks
