Thats what my Question is......how i am gonna prove it i paid 3k for my H1. They are deducting 500 (for my H1) everymonth from my paycheck in the name of CASH ADVANCE DEDUCTION.
I really want to teach them a lesson....so that they stop messing many vulenerable people like me who go to them every year. Could somebody tell me how i am gonna complain DOL in new jersey about this company and does DOL really takes any action.
Greencard is not i am much looking for......i am planning to go back to india after 2-3 years.

Here is the starting point. One way to do this to start from 'Wage & Hour Division' of US DOL. In NJ, this could be reported to the district office of US DOL at the following contact information.

Although, no one is going to dispute that, it is always good to keep it available to show it to DOL officer to put additional weight in your conversation, so that DOL officer knows that you have done your research and know the rules and regulations.

Also, DOL will tell you to file WH-4 form. They will assure you that you identity will will kept confidential. So you will never have to tell your employer that you are the one you cmplaint. Looks like a few people at USCIS know that some kind of masters degree from india with a 3 years bachelors unrelated to ones profession cannot be used in place of US masters. Did not realize that USCIS has some people who know the rules and play by them. If all USCIS people who approve these cases know about this and if lawyers stop justifying that correspondence masters degree is equivalent of US masters, bogus initial eb2 applications as well as porting could be stopped.

First of all, gun ownership is a right that is protected by 2nd amendment of US constitution, but the laws governing the ownership and usage are state laws.
So everything depends on the state where you live in. But in all 50 states, you have the right to own a gun because that right is protected by US constitution. You can be on H1 and own a gun, gun laws I think have nothing to do with your status, as long as you are legal.
Buying and Owning : Firstly, different states have different paperwork requirements to determine if you are legally present in US. If you are, then you have the right to own a gun if you want to.
Firearms ownership usually begins by you applying for a FOID card. FOID is Fire-arm Ownership Identification Card. You can find a form to fill out this paperwork at any place that sells guns. For example, shooting ranges, Sportsman's Warehouse, REI, they all sell guns and so they have forms that they can help you fill out to get FOID card. Once you get FOID card, you can buy a gun. FOID card may be called by a different name in different states, I live in Illinois, here its called FOID card. If you have a criminal history, then you may be denied this card depending on which state you live in.
Documents required for FOID card or gun permit maybe :
Passport, I-94, Alien number, valid visa, driver's license, proof of residence (utility bill). This list may vary, check your state's websites. Some states require you to live in that state for 6 months before you can own a gun.
Some states also have a one-week waiting period between applying for license and buying a gun. In California, you have to wait one week before you can buy a gun. You cant just go there, apply for permit and buy a gun in one day. This law may be there to prevent aggravated behavior as a person is likely to cool off anger or aggravation in 7 days. What kind of guns : In most states (I think all states), fully automatic guns are illegal and are not sold. Silencers are also illegal and not sold I think. If you saw it off, then its illegal. (because its easier to hide sawed off shot guns, hence illegal).
How you carry around the guns is also governed by local laws. There is a separate permit to carry guns in a concealed manner- concealed license. If you dont have such permit, then you have to carry your gun in such a manner that its visible to everyone. In some states, even that may not be legal, I dont know, check your states laws.

For example, in Texas, I think, (not sure) it is legal to shoot a person who is running away from your or your neighbor after stealing something or robbing you. I did not know unskilled workers can file for greencards in EB3. I think things are getting better and USCIS is now trying to stick to the rules.
"skilled worker" is where job requires two years of experience. They share same quota as eb3 professional worker (job requiring bachelors degree). Reason for so much retrogression is that there are many occupations which fit into skilled worker

For upper middle class, OBC shouldn't matter much since you can afford to enroll your children in private schools and have them work in private sector once they reach an appropriate age. If they are US citizens, they can come back to the US anytime for education and/or employment.
Talking of reservation and discrimination, what legal immigrants are facing in this country is not much different in my opinion. You can't even get your driver's license easily, let alone permanent residence. Most of us are here by choice even though we face all these issues in our daily life.

Me being an indian upper class guy, and this OBC thing going on back home, I dont think I belong to that country that much, where me/my children will be discreminated against!!!

I logged in this morning to get a regular update and came across this thread.
I am surprised to this discussion and the heated debate. Tides and Ebbs are a part of what we do. I think we must all be satisfied that we have IV to represent us. Think about it guys, we would have no voice if it were not for IV. I sincerely hope something comes out of all this efforts that all of us have put in. We have a good thing going here and lets not stop.
Even if nothing happens, I will be content that we have made efforts. Not just a tiny efforts but a big ones. Kudos to everyone who is contributing ideas and money. Keep the good work going and let us know what we have to do to help you all.

Dude I think you are thinking too much of it. USCIS is an organization that goes by a process. If they have a pending application, they have to process it. they decided in the summer of 2007 that they will hire additional contractors and process all the pending applications so that they reach their goal of 4 months processing times of 485.
Why will they waste their resources on your $325 dollars again dude? Is the amount that high that they will reopen the case at the time of finally alloting a visa number, and spend the money/resources on reviewing the case again?
Whatever be the PD, USCIS is all set for a month processing time of 485 by Sept 2009. All cases filed before Jun of this year should have been either pre-adjudicated or denied by that date.
I don't want to drastically oppose anybody's view or perceptions... But still I don't think that USCIS is an organization which goes with all the so called process models and they will stick with processing of the cases with priority basis - Yes, including all their country, category, etc quota fandas...
Otherwise we would not have seen people who are all with 2006 PD getting approvals where those who have better priority dates (with out tied up with any name check or other hassles) in the same cateogory and country are still waiting... Who knows whether they have some other agenda by getting 1000's of $325 from each applicant upfront, even they very well know that they would not able to do anything for those people in the near future? So why do they worry to take a few contractors for the time being and say bye bye after some time to them. By those uneducated contractors we have suffered a lot of back and forth mailing of the applications during 2007 July, there by making good business for Fedex and USPS. Anyways by that most of us got EAD... Thanks to such an act by the so called organization run by process model :D
Needless to say the small efforts as preadjudication or so will hopefully shed some light for our endless wait. I appreciate it... Better late than never. Atleast if they stop kicking the processing dates back and forth, just what we have seen in the last couple of months and offcourse in the past also, I would say "God Bless USCIS" for not making us fools again and agian.
