This type of clause is to protect employer for one year. Usually, it is not only trainig cost, it is business also.

When an employee joins contracts are for 12 months, when you work on niche technology, it will be confidentiality agreement for 2-3 years, and so on. Mostly they are goodwill agreements. If you have problem in signing for this 12 months, how would you be signing technology related agreements?
I have seen business to business relationship broken due to employee running away from clients location. In the begining, even if formal training is not there, clients do compromize to bring to speed. Most of the consultant placements are business to business chains.

Re-capture, STEM un-capping, "one visa number per family" or other such legislative action/executive order is the ONLY way any retrogressed EB category will see relief.
Recapture too is a one time solution that will just get rid of the CURRENT backlog. In future, EB application numbers need to be tied to number H, J, L,O and other visa types

India was demanding latest fighter jets (F-22) but US can offer only old version F-16,F-18 to India. Basic reason for US denial to latest technology because of India -US relation and their status .US only offers new technology to its close allys. I think it was prudent move from India’s part to get latest and greatest technology. To get these new technologies US congress needs to pass law and define India as close ally.

Guys, wakeup! He isn't telling anything wrong - just a different opinion, very valid for a great percentage of Indians - not everyone can/is going to land in US and wait eternally for GC? and nothing wrong in what he is saying - to go for a better long term India than a spurt of growth. Why ridicule the other guy for giving a genuine advice to youngsters - how many of us haven't almost given up on our careers just for the same of EB GC? Are we just afraid of losing out to our brothers in India in future, rather than them joining our batch in the eternal wait? If we want to make US our home, at least we should start respecting another person's right to his opinion, even if we disagree. Why would it be called a gimmick?! There is no other way - if its not India, it will be China, Philippines etc. Look at the way the general product industry went? The same will happen unless there are restrictive trade policy - which, not only would be against the "US" principals of free trade, but would also automatically be harmful for the US economy.
I personally don't see anything wrong in the article. He puts forth the right things that can be done to improve the life of Indian generations - now and for future. And if that happens, there would be a benefit for us in particular, and US economy and US jobs in general.

I would not call you pessimistic. You are SELFISH. Sure you do not share the same enthu because this announcement does not offer you anything. Grow up and feel for others. Everyone knows that there will be a backlog and that is an issue we have to deal with once we get there.
You are more SELFISH than anybody else and you lack farsight. You are the one just thinking about yourself only. What will happen to all those old guys whose labour is stuck in backlog centers. If they can't get to file this month, they have to wait for another 6 yrs before visas become available. What will happen to new filers who plan to file GC soon. They have to wait forever.

Did you do anything to expedite interfiling to use new I-140 for your pending I-485?

For expediting Interfiling, nothing in specific. I called USCIS 3-4 times and did one infopass visit. Everytime, the answer was same, "No Information". Few times it was difficult to explain to them what interfiling is. Then, I learnt to say "PD Amendment" (My lawyer used that term) with the two separate approved I140s. I called USCIS last Friday (Jul/18/2008), and they told me to wait 4-5 MONTHS. You can see how much off they are and IIO and IO work for the same USCIS. It is Ludicrous.
Best of Luck to you guys. Hope your GC is approved soon.

Considering the current economic situation, i donot expect much progress in addressing country quota elimination/CIR's.
We should atleast try to get our issues addressed in bits and pieces. Overall, anything to address retrogression should be welcomed! rather than 'debate and beat the horse to death.'

I think most of EB3I and EB2I are missing one point.
EB3I didn't loose anything by the change in spillover policy few years back.
It is EB3-world who lost. Obviously EB2I and EB2C was on the gainers side.
EarlierSpillover EB1row->EB2row->EB3row->EB1I/C->EB2I/C->EB3I/C
CurrentSpillover EB1row->EB1I/C->EB2row->EB2I/C->EB3row->EB3I/C
(or to be more precise, it is currently EB1->EB2->EB3 since spill overs are not considering country based limitations)
Either way EB3I was last in the que. So nothing changed for EB3I or EB3C.
EB2I or EB2C on the other hand moved ahead of EB3row, that is very noticeable.
EB1I/C also moved ahead of EB2row, by this is not that noticeable, since all these categories were close to "current" either way.
In summary, you change the spillover whatever way.... EB3I is always going to be at the end of the line, least benefiting from any spill over.

I filed on july 23rd got ead & AP but did not get FP. After reading this thread and seeing the patterns i think that if your application is processed by the center where it has to originally go then you get your FP quickly but in cases where your application went to original center and then that center sent to other centers for EAD and/or AP then their FP's is getting delayed, like my self.
I also have another problem. I changed address just after applying for I-485.I think FP is NOT dependent on PD's and or address change.
This is just my 2 cents.

Filed paper renewal on june 12th, Received card production ordered email today.
Ap was submitted 2 days ago. PD is May 06. Spouse's app was filed same time , no update yet. No FP notices.

Received 2 year EAD card in email. Card is valid from jul 30th 2008 to jul 29th 2010. My PD is current.(May 06). Dont know if this is good news or bad news.
