The sad part about the Brokow's report is that he focused on H1B issue and not the real problem which is the green card issue.
Yes, people come on H1B - however, for those immigrants to put down the roots, it has to happen through green cards and not H1B extensions (neither one of which was mentioned in the report). I am not sure if this is a two part series, but it should be.
IV members should write to MSNBC Nightly News to do a more in depth story on immigration problems of the high skilled immigrants.

My wife is from Bangalore, however since Chennai did not have available dates till Jan 20th she has scheduled her H4 appointment at New Delhi for Jan 9th. Please share experiences.

Hi,
I applied for my first EAD in May 2007 and had FP done in June 2007. I am now applying for my EAD renewal. Will there be another FP for the renewal?
This is really urgent as I am traveling to India in April for a month and I don't want to miss the FP appointment. Please let me know if you have info on this?

Hello all,
My EAD expired in late April
Prior to that, I applied for renewal but my old lawyer forgot to either include something with the application or made a typo, and it bounced back a few days ago (late May).
I got a new laywer to re-file the EAD, however I will not get my new one in time to start my post-college job in early July, as the process takes around 90 days from what I remember.
If I show up to the first day with a filing receipt, a written letter from the new lawyer explaining what happened, and my old EAD, will I not get the job?
How do employers handle something like this?

I am currently working for big consulting firm, they hold my H1 and 485 is pending for more than 6 months. i have valid EAD from pending 485.
I am getting full time opportunity, my new employer is ready to transfer H1 as well as they are willing to accept me using EAD. so its entirely my preference.
can you please tell me adv/dis adv of using H1 over EAD or vice versa. (my 6 yrs of H1 will finish in another 6-7 months)

Hi,
I would like to know that can I apply for EAD extension for me and my wife since my I-140 application was denined last year. We have already appeal for decision on I-140 application to AAO office. I am intend to get my wife's EAD extended by year end.

Is your 485 also denied? Most of the times when ever 140 is denied then the underlying 485 also gets denied and if that is the case then you cannot apply or extend for EAD or AP until your appeal is pending with AAO. I may be wrong so consult an attorney.

My company wants to transfer me to Europe for 2 yrs. Its a very good opportunity for my career. My I140 approved and 485 is pending. PD March 2006 EB2 India. It wont become current for foreseeable future. I am appplying for 3 yrs of H1B extension.
Can I be outside the US for 2 yrs w/o jeopardizing the GC process. Can I then come back after 2 yrs on stamped H1?
My wife used EAD to work. Can I apply her H4 extension with me and she foregoes her EAD? Will she get H4 status and extension along with my H1?
Can she then come back with me after 2 yrs on H4 and then revert back to EAD to work?
I need to make a decision soon. Any replies will be greatly appreciated!

I got married in 2008, but my wife came with me to the US in Dec 2009. I got married while my I485 was pending due to priority date backlog. I understand that I can add her to my I485 application when my priority dates are current (Jan 17 06). My questions are:
1. How many days do I have to file after my priority dates are current (in case I do get my green card in the interim)?
2. She being a non-Australian born Australian citizen can legally work in this country on a special E3 visa. But I am not sure whether she can be added on my green card application while working on the E3 visa? Few friends of my whose PD were in 2003 had got their GC no matter the current opening is for Jul2001, since you have already applied for ur I-485, I think it would be better for you to wait & watch for some more time and join company B on EAD with contract to hire position.
Or else you can start ur EB2 processing also through Company B and then later I think there is a way to make us of PD of EB3 when filling for ur I485.
