    "non answer" meant they didn't answer his questions but rather gave some vague reply of how h-1 was good for usa.

    If I was on the receivng end of that response; I would have thought that these guys are playing with me and by not answering the quesitons; then they are obviously trying to hide something. Therefore, I will attack them in another way to make them conform to the behaviour I want.

    MSFT do not abuse h1b visa - they maintain their pay scales and follow all rules. When they say they want h1b visa quota available it basically means - they do not want to turn away a talented candidate because of lack of visa. All these companies are genuine in their usage. So they can definitely give a proper response.

    Now for a company like INFY. WIPRO, etc.. - h1b, l1b etc.. is a part of their business modal. They need some visa to bring people in and out as it is a big part of their business. If they really were serious - they must have presented their case and also work with US govt for a different kind of visa that allows them to do their business by convincing the govts about trade etc...

    Now comes the consulting companies. There are companies that genuinely bring people and rotate them at various clients for projects and people stick to them till green card. But due to sheer greed - some of these have abused the system - they have absolutely no sympathy for their acts of greed. The max they can do is threaten, usse small time lawyers, cancel pay, write letters to USCIS to cancel 140 etc... do you expect them to give a proper response to the Senators?

    congratulations..truly inspirational.. how did you acquire such phenominal emotional stamina?

    There were times when I was really depressed, specially when I got delayed in New Delhi with "Name clearance" for H-1 renew. However, I believed in higher power and never lost hope. My parents (mother US citizen,father GC) always kept my spirits high. I also got a lot of support at my job (when I got stuck in India, my chief pulled all strings possible to get me cleared).
    I also had a backup plan, where I could go to Canada or worst, can go back to India where I have an established practice.
    Botomline, do not loose hope and work hard.

    Sanbaj, Is there any update regarding your case ?
    None so far. No updates from the Lawyer or any LUD change. My I485 RD is 08/16/07, and NSC has not reached that date as yet. My lawyer's office called and the response was "The request is attached to the file (485)". I called NSC and the IO there DO NOT know the meaning of Interfiling and the IO I got was very rude and in a hurry to finish the call. She said that these officers should not give us (AOS Adjustees) any info, please inform me if any USCIS officer has broken that rulw. I said no one has and finished the call. Now, I am waiting, as have been for last six years for various things on the GC journey, for NSC I485 Processing status to go beyond Aur/16/2007. Once it does, I will call them again.

    Sorry, I was late in the response as I did not check this thread for a month or so.

    Hydboy, you make a good point. Does anyone know if this is how USCIS would do a Qtrly Spillover if they do it ? And do they have to make the EB2-I and EB2-C dates the same before they do a spill over like they do it for the yearly?

    Maybe it has no legal validity. But still why to accept it. If they ask you to pay the fine/penalty, you will have to fight it before winning.

    You can do one of these.

    1. Ask them to remove the clause from the letter
    2. Strike out the portion that mentions these and then sign it. Keep a copy of the signed document for yourself for future needs.

    If this is just a "standard", they should not object to one of these. By the way such open ended terms are not common in offer letters. It definitely sounds fishy.

    Hi,

    I have a three year bachelor degree + MBA from India with 9 years of experience. My labor was filed requiring Masters degree + 3 year experience with no mention of bachelors degree. Last week, I received I-140 decline (I-140 filed under EB2) citing that my bachelors degree is only three years.

    My company is planning to file an MTR with appeal citing 1) My labor only required Masters degree with three years experience and that I have the Masters degree with three years 2) I have bachelors degree equivalent with 3 year bachelors degree and 2 year experience equated to 1 year education equating to US 4 year bachelors degree.

    Do you think my appeal would have a chance of success? Please let me know your opinion. I have to file an appeal in next few days. Thanks for your help.

    I'm certain you cannot do that. While applying for H1B Visa, you can use experience in lieu of education, but while Perm/I140, they consider only 1 degree. Either its Masters or its Bachelors...even both of them are not considered as aggregates.

    If your attorney is planning that way, he may not have handled such cases before... :eek:

    You cannot substitute degree with experience while applying for Perm/I140.



    ... My attorney is planning to use 2 years of my experience to compensate for the additional 1 year of bachelors degree...

    Can i change my job from a biological researcher to a biostatistician? My current job is in the field of biology, which involves lots of experiments. If I change my job to a biostatistician, which is like a programmer, do i still qualify the "similar filed" rule? thanks for your help!

    This is the most bizarre thing I ever heard w.r.to immigration. Usually the IO schedules an interview at one of the local offices or at one of the CBP (Customs and Border Patrol) offices. Atleast in San Francisco, both USCIS and CBP offices are located in the same building.

    This happened to me and I may try to summarize my experience here. OP relax . PM me if you want to.

    I Filed EB2i AOS in 07/07. Got a phone call at home (sometime in sep07). I was at work so my wife was the one who recd call and gave them my work ph#. Guy called at work, introduced himself and asked for time to visit me. We fixed up next morning . It was a kind of tense night. I had not informed my attorney about this- thinking it a part of background checks.

    Next morning, an officer in plain bussiness dress showed up at exact time, introduced and gave me his bussiness card and presented his official ID card.

    He spent some 45 minutes or so., and had several questions of personal nature about family and friends and money transmitted to india over the years (He had a complete list of transfers)

    It was all serious questions but in a very casual/relaxed atmosphere (Nothing like allegations/judgemental).

    This all ended very well. Saying GOOD LUCK to GREEN CARD.
    Btw: I arrived in 2000 , worked for the same university until then.

    I have been resisting reading this thread until now. Had a gut feeling that something with such an idiotic title cannot have anything meaningful. Anyway, just read this and couldn't help rolling on the floor!

    So basically this crackpot "rajakannan" files in June and tries to con everyone into applying on July 31st, thus ensuring two things (IMHO):

    1. USCIS won't delay sending his EAD and AP due to deluge of I-485 applications.
    2. In case the dates retrogress middle of the month (mid-July) due to large volumes of I-485s from people (from other countries or those who don't visit here), then that reduces additional backlog for his case.

    Good job, "rajakannan", you have only managed to insult your intelligence by starting this thread. Members/Visitors here have noble intentions and hearts of gold not to wish bad things for your I-485.

    Crawl back under your mushroom and don't ever come here again.

    Fraud is usually about lie. If you hide a material fact from USCIS, that is a lie by ommision; and becomes a fraud if it was done intentionally. Changing employment while on EB GC application is a material fact and would matter much when USCIS decides on your case.

    Usually, this kind of ommision is found out when the individual applies for another immigration benefit or for Naturalization.

    biostatistician job position can involve analysis of biological data. That qualifies you still as a biological researcher. Biological researcher is a very very very broad term working from bacteria to human genetic diseases; deep sea fish to suspected life forms in asteroids and space debri (astrobiology). It is basically a straightforward description of what you are going to do as a biostatistician and justification of how this will still qualify you as a biological researcher. That makes it very much job specific: if you are going to use statistical methods to analyze GE's cat scanner machine performace it would not be biological research, but if you are going to use some statistical methods in analyzing cat scanned body images and tie your analysis to clinical conditions it would. If you could post both your current job description in your gc application and the prospective biostatistican job description as you see, I can try to help you.

    1. This is what I don't understand. The original discussion was that getting an EVL is a bother. Now are you saying there should be another document people would need to apply for as proof of identity? Wouldn't that be an even greater bother?

    2. Now, since the drivers license is used as proof of identity, it is necessary to ensure that criminal elements do not get it. Which includes illegal / out of status immigrants who could also be a security risk. Employment verification ensures that the person holding the H1 or H4 visa is in valid immigrant status. Which is why they ask you for the EVL even while stamping the visa. That is the security angle. Seriously...this is all fairly obvious stuff. The govt just wants to make it difficult for illegal / out of status aliens to get a drivers license. What is wrong with that? The funniest comment on this forum from somebody who was ruing that he couldn't bribe someone here for a license like he could do in India. Really? Do you want people driving on US roads who bribed their way to a license?

    1. Were n't you concerned with the security of this country. Have one more Id in your wallet. How does it matter? You are ready to do whatever this country asks you just because you are a non-immigrant.

    2. Again I don't get your reasoning. How does immigration status verification ensure the security of this country ? Come up with some logical points.

    Do you know that there are citizens from terror breeding countries roaming around in this country as citizens ( because they are not subject to country quota), whereas people from democratic countries like India being subject to all kinds of discrimination just because we are non-immigrants ( indirectly because we are subject to country cap) ?

    It took a Martin Luther King to liberate blacks from slavery.
    It took Mahatma Gandhi to get Independence for millions of Indians.

    I am not assuming all individuals will have the same level of dignity and self respect. If you lack enough self respect, you will probably say US can ask us to wear a chain around our neck just because we are non-immigrants.
