You cannot claim a cousin on F1 status to be your dependent.
The most important point is F1 students have to file their own 1040NR and are Non resident aliens for tax purposes and cannot be dependents on Resident alients.
More over You cannot claim the tuition deduction for her because
(1) she showed proof of financial ability when joined the school.
(2) AFAIK, Tuition deduction can be made only for people either you/your spouse or your dependents
I know this because I paid tuition for my own sister and I was told that I cannot claim her as a dependent. Some CPA might say the contrary, but if you want the exact info call the IRS 800 829 1040

Hello,
First of all, I really appreciate your efforts to help people in their immigration issues.
Currently, I am on H4 visa. Recently, I was offered employment and got my H1B approved.
But, my new I797 approval notice does not contain I-94 part.
Do we need to apply for Change of Status from H4 to H1B now while I remain in US? Do I need to do it or my employer needs to do it?
I would really appreciate your help.

You need to go out of US, preferably to your home country, get an H1-B stamp on your passport, and reenter US using your H1-B visa stamp.

I always wonder these ARAVAS deserve GC?
Because where ever they will make lot of fuss there and cause so many troubles to hosting country...
Srilanka they made a beautiful country as almost ash because of their perverted intensions..And Singapore they will never go with country's best interests...and Malaysia....
And even in India see the support to LTTE (Openly)
Also all most all these ARAVAs are blue collar cheap labor, I don�t know how a considerable number of Tamils getting h1b

Position, title, location and job description are the important variables as far as PERM is concerned. It is your manager's circumstance that changed and not your job situation, so your PERM should not be affected.

My friend has a GC since Sep 2004. He recently went to India and married a person who has a stamped F-1 Visa though she has not entered the USA yet. They are planning to enter US this month. Is this legal? What should they be worried about and what are my friend's options if he wants to settle down with his wife in the USA. Will there be an complications if he applies for her GC or should he rather wait till he gets his Citizenship. Any comments would be appreciated

To answer your questions, In first place this program comes up with few clauses. Your eligibility to apply for this program is contingent upon the fact that you hold a current H1B and are working on H1B for atleast one year. It is also important to prove your H1B status when you get your permanent residency with Canada. With the over flow of applications, they added another clause in the form of eligibility which will make only "IT Managers" eligible for this category. They were taking applications with all NOC codes but offlate around May 29, the eligibility is dependent on your IT Manager role.

I have been arrested on Domestic Violence call by my wife ( of cource false allegations) about month back. Police investigation did not find any evidences and never sent file to DA for filing hence DA never filed charges.
Now USCIS requesting following
1) Please submit an arrest record and final court dispositions for each of your arrests. Court dispositions must be in the original and bear the stamp and/r seal of the appropriate court or clerk. If a court disposition or police record is not available, you must provide official or certified evidence from the appropriate law enforcement agency or court confirming the record in unavailable. Please note, these documents must either be the original or certified copy.
How to get court deposition or evidence that no charge are filed against this arrest?
I have filed petition for expunging arrest record but that will take a while to conclude.
Please advice what proof I can send to USCIS that this arrest did not even result in charges in court.

No, you do not need to file I485 for child, who is a us citizen. No medicals exam required, since they get everything here after birth.
But you have to mention child details on your I485.

But this time there are 90+ dems and Reps co-sponsored this bill..so chance of this getting passed is enormous and I was hoping since this is the child of those claiming to be the champions of the legal immigration ..could probably insert something to bring relief to the legal community..

Hi all:
I entered the country on Advance Parole and so now I am on EAD status because of that.
I am on my 8th year of extension. My H1B was valid till 2009 but now it is not because of my EAD. Its been more than a year since I applied for 485 and My I-140 has been approved.
Q.1 Can I join another employer based on a new H1B so as to reinstate my H1B status? I plan to file for AC21 if I change employers.
Q.2 Can I apply for a new H1B with my CURRENT employer based on my current job?
I would really appreciate your input.

1. You cannot file I-907 yourself with the USCIS to upgrade to Premium. It has to be done through your employer or Attorney.
2. However, it is legal for you, the beneficiary, to pay for it ($1000 fee), i.e., you can write a check that is payable to the "Department of homeland security".
Form I-907 is a fairly easy form to fill. Fill it out, get it signed by your employer, and send it to the service, on behalf of the employer.
If you know the receipt number of the H-1B application, it shouldn't take you more that 20 minutes to get it all out.
PS: If the post helps you, how about contributing a fraction of that $250 to this noble cause :)

I am asking this because my attorney is charging a ridiculous attorney fees of 250 USD on top of 1000 USD for upgrading my case to a premium!

I did not know that ... So the company contracting someone has to maintain an I9 information?
