EB2 cannot combine education or work experience. It must show a single source degree.
Note the following information from the 2006 annual conference of the American Immigration Lawyers Association (AILA) in San Antonio, Texas. "For employment-based immigrant visa purposes (aka green card), the U.S. Citizenship and Immigration Services (USCIS) will not equate a three-year diploma plus a post-baccalaureate diploma as being the equivalent of a U.S. Bachelor's Degree for either EB-2 or EB-3 classification. Additionally, the USCIS does not accept a combination of academic background and work experience as being the equivalent of a U.S. Bachelor's Degree for "green card" purposes"
This can be done for EB3 IF it was stated on the labor certificate.

Education evaluation was not done for bachelors because the Labor only required masters. My attorney is planning to use 2 years of my experience to compensate for the additional 1 year of bachelors degree

I was just curious to know and the reason why I asked was, if you read all the posts on this thread, one person (sheela) had a similar 'house visit' by an ICE agent...who was asking questions mostly on wire transfers...so, was trying to see if there was any similarity in both the cases?
The simplest and easiest case for transferring money is because we dont know if we will ever get GCs, and our jobs are not guaranteed as we are on H1, so we can say we feel safer to keep the money back in home country than in this country and hence transfer the money.
BTW, bujjigadu123 , your visit was scheduled for last week if I am right going by your OP, can you pls let us know what happened

My employer is not giving copy of my I140. With out I140 how to port it to an other job/employer etc ?

My company, which is a big one with more than 9000 employees tried to do the same with me. I've to do some sweet talking with my paralegal to get a copy of I-140, which was sufficient. Although, later I realized it was a notice of action but I think that should work too. Since, my company filed my 485 I did not have to worry much about that.

hey guys I think its OK now to call IV as Indian organization with this bulltin and per their statement there is a good chance that ROW will move ahead and we will be stuck EB3 India in particular
If you don't stop saying comments like this, you'll totally alienated people like me. It is a global issue, doesn't matter where you are from. People from all nationalities are affected. Oh guess what, it wasn't just Indian nationals who saw no movement.
Or, if you truly feel this way, I'll take my donations elsewhere, and I'll stop meeting with lawmakers on everyone's behalf.

The 111th Congress begins its lame duck session on November 15th. The major item on the agenda will be what to do with President Bush�s tax cuts which are set to expire on December 31, 2010. being on H4 for the past 4yrs scenario...?
what are the chances of the H1b approval being 4yrs on h4...? as in how strong is the resume being..?
will they question about the past 2 yrs of H1 status...asking cos I dint work for a while as I dint get a project..?
converting to H1 in such a situation, will this be risky and asking for trouble..?

They never felt the need of country cap. When non-Europeans started immigrating in large numbers, america suddenly realizes she has to be "fair" to all countries in the world and fairer to whites in particular.
It is such a shame that this country covers up racism with "diversity" in this 21st century.
Moreover skill has nothing to do with country of birth(EB category).

Ok, I've seen a lot of threads about go to the rally, actions items, I've reading a lot of guys saying dont ask for your receipt status, dont waste your time etc, etc.
Yes we did the rally we were great with all those signs, and appearing in the Indy TV but...
Question remains open:
1. When are they going to increase the GC quota?
2. When congress id going to do something?
I've the feeling that that's it we made our point but we are still with no GC, waiting receipts..............
Q. So. What is the result after the Rally?
A. 'ImmigrationVoice has arrived' and we have made a big impact by drawing attention of the lawmakers on our issues.

There is no law that states USCIS should not consider country quotas during the last quarter. As per AC21 law USCIS should relax the quotas if the numbers are getting wasted (not already assigned to ROW). If USCIS works efficiently and assigns the visa numbers to EB3 ROW - which is retrogressed - before the end of third quarter, they don't need to relax country quotas in the fourth quarter.
In a way USCIS inefficiency is helping applicants from retrogressed countries get GCs faster (4th quarter relaxation) :).

there should be a cap on how many H1's a MNC that's not based in US can apply. ex: companies(like wipro, infosys, satyam..)
for ex: it should be <= 300 per company.
These people consume lot of H1's when they could get their employee's on L1.
