Hello Sir/Madam,
I came to US on H1B visa and recently i switched my job.My previous employer (INDIAN Employer) is asking me to return original H1 petetion which they filed.
Can anyone please help me with below queries
1. Do i need Original petetion from previous employer for Green Card processing ?.
2 Should i return H1 petetion or not to my previous employer ?.
2. Is it legal requirement that i need to return original H1 petetion to previous employer who filed it ?.
I would really appreciate and thankful , if you clarify my doubts.

Hello - I have a unique situation. I'm currently in the US on H1B, and my fiance is in India working for a reputed software company. We are planning to get married by end of April.
I want her to come to US on a work visa (hopefully H1B). I got to know that to make the FY09 H1B cap, she has to apply for H1B on Apr 1 2008, and wait till Oct 1 to travel if her visa gets approved. But since we are getting married by end of April, I don't want her to stay in India till October while I'm here.
The other option I was thinking was to apply for her H1B on Apr 1, but still go ahead and apply for H4 in early May, so that she can travel on H4 in May. And once her H1 is approved, she would already be in the US and can start working from Oct 1. Is this possible? Will this plan create any problems for her H4 or H1 visa application?
If the above does not work, what are my other options? If I miss the Apr 1 2008 deadline, the next earliest she can apply for H1 is Apr 1 2009, and work from Oct 1 2009 - and I don't want to wait that long.
Another option is to get married before Apr, get her to US on H4 before Apr, and apply for change of status to H1 on Apr 2008. But the marriage plans for Apr is made and to push the dates back would not be easy.
Any help in this matter is appreciated.

I need your expert opinion.
While setting up an appointment through VFS for H1B stamping in Mumbai, I am asked the following question:
Are you applying for the same class of visa which is currently valid or has expired within the past 12 months?
Should I answer Yes or No? I guess the answer is Yes since I have a valid I797 H1 approval. But, I need expert opinions from you guys as well. Here is some background:
I have H1 visa stamp through my old employer "O" (with an expiry of March 2006). I changed employer "X" in Nov 2003. My H1B has also been renewed in Nov 2006 (with "X"). i.e. I have had two valid I797 H1 approval notice with "X" since Nov 2003 - one for change of employment through my current employer from Nov 2003 to Nov 2006 and then a renewal from Nov 2006 to Nov 2009 (this is currently valid). I have not been to India since July 2003.

they are issuing EADs for children....it will help you get SSN for them

I filed 485 in July 2007 and got the 485 receipt nos for myself and wife and my daughter. Both my wife and myself got EADs too. Though i applied EAD for my daughter [who is under 4 years at the time of application], i neither received EAD reciept nor the application back. I saw in some other threads that kids under 10years are not getting EADs. Is it true?
I know some may ask why we need EADs for kids? My daughter 's I-94 is expired on Oct 10th 2007 and i applied EAD for her in july just in case though she cant work.
Any ideas?

I have a big problem that I got approved on the H1 Recapture to get back into US on January 15, 09 though my attorney screwed up by putting someone else background into the Petition Letter submitted to USCIS with my application. The petition letter to USCIS is all wrong. It states the wrong education, work experience and job duty. They put somebody else background into mine. They put the correct sponsoring company on the first page of the letter though at the end of the second page they put the wrong sponsoring company. In this case, what should I do and what should I answer at the US Consular in Malaysia to get my H1 Visa? What should I do now? Please advise. Do I have to resubmit the application back to USCIS? Will I get rejected? Please help. Thank you very much.

This question is for an attorney:
My spouse's case is this: She has applied for AOS I-485 (India) based on an underlying EB3 I-140 (PD feb. 2007) petition during July 2007. At that time she had also applied for an EB2 NIW self petition, which was recently approved in April 2009.
Two issues arise now:
a) The PD date of the newly approved I-140 is August 2007.How do we inform USCIS to capture previously approved EB3 I-140's PD. She has used AC21 to port to same or similar job, but he previous EB3 I-140 has not been revoked. Is it possible to capture previous PD?
b) Do we have to send new I-485's or can we ask USCIS to interile newly approved EB2 NIW I-140 to the already submitted I-485s. If yes, how do we do that ?

• Filed I-140 with PD March 2005 (Substitution Labor) - I-140 Approved.
Questions:
1. I would greatly appreciate if you can let me know what are my options and any relative information (Letter formats etc.)
2. Can Info-Pass work instead of writing to USCIS?
1) Send letters to the service center explaining your situation and the priority dates + 140 approval LIN#(NSC) or WAC# or whichever approval numbers you have. You need to stress that your dates are current and that your AOS applications have to be approved based on the current 140 (irrespective of which approved 140, the 485 apps were filed).
2) Send faxes same as the letter.
3) Call the NSC/TSC IOs. (If you reach the national customer service center, no luck).
4) Take Infopass.

we applied ap in octoer and we got receipt on oct 24th but we found a typo error on my daughters receipt instead of 'ekthasruthi sakala' it was ektha sakala' will it be a problem at the port of entry . please suggest me.

Why didn't you ask what the interview was about and why the Welcome was issued when your priority date was not current?
In immigration matters it is best to be open and clear lest you fall in situations where you have to hibernate because you can't raise the issue for fear of rejection.
