Hello all...
being on H4 for the past 4yrs scenario...?
what are the chances of the H1b approval being 4yrs on h4...? as in how strong is the resume being..?
will they question about the past 2 yrs of H1 status...asking cos I dint work for a while as I dint get a project..?
converting to H1 in such a situation, will this be risky and asking for trouble..?

How long we are planing to wait to get stories ? What if we dont get enough numbers to come upfront and be vocal in media ?
I think still problem is there and people who were stuck abroad now have decided not to travel untill they get GC but they are not standing up and joining hands to stop this process.

I will use it surely when I come across a good opportunity. This is a provision provided by USCIS just for the specific purpose of changing jobs, so why do you anticipate any issues with using AC21 with in the guidelines for using it. I would also consult some one (best one will be a lawyer in my view) who has done this and has good knowledge of this to make sure everything is in order. Best of luck and enjoy the little flexibility AC21 provides.

It would be interesting to see how Infy, Wipro etc... will do business when $ == 32 Rs, they will start looking for offshoring to African countries where $ is cheaper.

Great! I sent individual messages to all senators through their websites and was able to send a 'hand delivered' message to Jeff Sessions for $8.95 through following website (https://ssl.congress.org/congressorg/mailapp/).

You mean to say that "Those who have EAD with PD 2006/2007" needs green Card and you dont bother about PD 2000-2005 from Backlog who never got a chance to apply i-485 ?

I have old I 140 approval notice, Is it necessary to send the old I 140 approval while interfiling. What if the old company withdraw old I 140, How can I interfile in that situation.
Doesn't matter. You interfile based on priority date and once a 14 0 is approved, your PD remains yours - even if it is revoked later.

Very good point logiclife. what happens in this following scenario when 140 is approved and when 140 is pending.
Person X has completed 180 days after 485 filing, used is 6 yrs of H1 and now he got a 3 yrs of H1B from the same employer. If this person uses AC21 & EAD and joins another company and after 1 yr his 485 is rejected for wrong reasons, will this person be out of status(since used EAD) or will be in status since his H1b is still valid with the old employer (Assumed the employer has not revoked). Will it be safe to come back to the same employer.

IV is not a help group. If some one want to join a help group then go join a "Depressed people Organization". This is a make happen group, where we all fight for what is right. But unfortunately, we are just as strong as number of people actively supporting.
He did everything right and followed the process but now for a VERY stupid reason, he has to wait for 6+ years now. So, the simple question I ask now is what justice it is by having such a complicated Green Card process full of so much uncertainity and unfairness.
Thus, this guy of course should do all what you stated but must do much more, which is stand up for himself.
How can you be so mean specially at a time when he is under tremendous pressure. IV should try to comfort him and suggest him some alternatives. Contact your attorney ASAP and ask him to try to have a good write up and send the application again, who knows USCIS might accept your application (worst case ur app will come back again), but make it fast dont delay anymore.

There is a quota for masters in H1B.
There should be a similar quota in GC for masters.

Piece meal is our best/only option for the next 2 years. We have to keep track of the legal bills being introduced and campaign for them. I don't think CIR will make it in lameduck too. Republicans would like to enforce border security and employer, internal monitoring, before any king of path to legal status for illegals.
lets stop this rhetoric on repubs, what about bobby jindal, marco rubio & nick haley and plz don't give explanations to distort the reality, many in the republicans sincerely support legal immigration, tell me few good things dems did to legal immigrants, aint regan the one who gave amnesty to illegals in 80s, aint bush the one who tried more than once to pass CIR, who opposed h1b fee increase recently?

I feel republicans would sincerely welcome qualified immigrants. Some of their views on protecting the border have been distorted out of propotion due to politics.
What we need to do is enhance our reputation with both Republicans and Democrats and get them to help us.

What if we used so much of our time and energy in finding jobs in India/China and moving back, instead of going after media/govt? :confused:
Some of us have spent $35-40 on sending flowers, if we gave a internet job board that kind of money to send our resumes to prospective employers and headhunters in India, we may have a chance in finding a job in the emerging economy of India/China.. that will be THE biggest impact on US Govt... To add to my opinion, I would like to direct your attention to Microsoft... They didn't waste their resources on fighting the media, govt.. they just moved to Canada.. And believe me, there will be more such instances...
Agreed totally. Indian economy is booming and will last for another 5 to 10 years. Waiting for green card will make you lose out both the Indian opportunity as well as the "so called" American dream. People with decent experience are making good money and nothing better than living closer to friends and relatives.
