My freind is about to file I-140 application but his family is in India, does his family needs to be here during I-140 filing? if no when does the family need to be here ?

Hi,
I am planning to travel to Indian in coming months. However, I have a stright outright dismissed CMIT case back in 2007. I got the non convincted case expunged. I got FBI finger print results and they say no records were found. I got BCI from state which states no records were found. Last time , I travelled abroad was in 2006. I have a valid AP.
Do you see any risk of re entrying US on AP?.
Your help is much appreciated as I have to have to be there in India.

I was just checking my H1b extension status and it seems that it got approved (3 weeks time). while looking for my H1b extension status i happen to find the link below,
USCIS: National Processing Volumes and Trends (http://dashboard.uscis.gov/)
It gives the processing trends by month based on trends or volume of application processed. This dashboard is for all applications forms submitted to USCIS, you can select form type, office and chart type. Data can also be downloaded in CSV raw format for analysis.

I am a July filer and have the option of working for a reputable company as expert consultant for 6 months (initial offer). Yates memo indicates that self-employment is possible. Here is my question: Do we need to register a company to be considered self-employed? As a consultant you may not have a customer for while. Isn't it better to register a company if you want to claim self employment? What are the pros and cons of registering a company?

My wife will be coming back in April 2nd week through Denver. CO POE. Her AP is valid until June 3rd week.
My question is that is 2 months of AP validity / cushion enough or safe to enter the US.
Will she get a 1 year I-94 validity from the date of entry or only until her AP expires?
This question has also been posted in the member forum and I have posted it here to get advice from the eminent lawyers from a legal standpoint.

When I joined my employer, I had MS+2 years of experience, but my lawyer applied to me under the EB3 category which had MS+2 as an alternate qualification. I submitted the experience letters from my previous employers.
Now, my company is willing to upgrade from EB3 to EB2 and have a position that requires MS+2, but the job responsibilities is a little different from the EB3 job.
If I apply for this position, will the USCIS accept the experience letters submitted earlier?

I am planning to invoke AC21 thru H1 Transfer and then notify upon H1approval.
Do we need to make sure while filing H1 transfer, job duties on H1/LC should exactly match Labour Cert job duties?
I know while notifying it has to match.
Appreciate your help.

C1 applied for my H1B last year and application is still pending + also added Premium Proc. last week, Application Still Pending
At the same time company C2 applied my H1B last year and H1B approved but did not get the documents from USCIS, and applied for "Response on Approved Petition", That is still pennding(But Yes The petition is approved)
But Fortunately or Unfortunately , I got a permananent job with a new company.
I can start working with that company on OPT, and he will apply a new H1B this year.
But , Instead of that Can I get one of my H1Bs transferred?
Or is there a better way to handle this situation?
I know its a mess... Can some one suggest me how to clear this mess?

For an individual, let’s say an I-485 was pending since July 2007 (I-140 approved) with current employer A and she moves to an employer B on a similar job on a H1-B transfer invoking the AC21 portability.
1) After the move, if the I-485 gets denied, can the person still retain the priority date of the underlying approved I-140 in any new application if she files with the same or a new employer.
2) After the move, if the I-485 gets denied and the person loses her job with the employer B, can she take a job with employer C by transferring the remaining time on her H1-B visa.
