Lack of awareness and information is a big problem. Starting the process early is better. I have seen some people undecided about GC and waiting till the end of H1B to start. It is at that time they discover retrogression. Some discover retrogression only after 140 approval. Until then they are not even aware of IV.

i had a GC of a priority date 01-13-2003. Then my employer was kind enough to do one more simultaneous application with a date of 11-15-2004.
The attorney we were working with at that time exchanged the I140 between apps and he screwed up big time on my 2003. So we had to withdraw both my I140 approved 2003 application and the 11-15-2004.
Then we had to go back and apply for Perm and start the process again. I spent 5K and my employer about another 5K on 3 apps so far.
if it is fate on one side it was USCIS on the other, but god was on my side, and hence i am still in this country!!!!

My take on this situation....ask your freind to apply for concurent H1b's..it works out well with concurent wives...!!!!:):):) He can bring one wife on each visa..!!!!
Yeah right! Do you really think that these women would qualify for skilled labor under H1?
Anyway, they could try getting their LCA with following information and apply for H1.
Client � Husband
List of duties - Nagging, sobbing, yelling, demanding, gossiping, fighting, scolding, complaining, irritating, urging, nerve-racking, tormenting, annoying, upsetting
Work location � His peace of mind
Work duration � Equivalent to his lifespan
Prevailing wage - Equivalent to his entire earnings
Finally a kind hearted IO might think that they are really something and approve the petition ;).

How about taking out US Masters off all the queues for a while, that will as well speed up the GC process for others. :D:D

That is already the law. But this law has been proved to be virtually impossible to enforce. The only practical solution is to deny H1-B's to consulting firms (at least for the positions that require the employee to work at the client location).
All this consultant bashing aside...and while 70% are indeed crooks....there are a lot of Fortune 100 and 500 companies where the entire IT staff is on H1B visas through these same firms.....I wonder who will handle operations if this is banned outright.....there is a reason it is still being allowed despite the abuse....

I am in exact same situation. The company that is going to sponsor my H1 checked with two attorneys and both said that I will need a fresh H1 in April07 and I can start working from Oct07. Even I never got to work on my earlier H1. I guess this is because you need previous paystubs for H1 transfer. Let me know if you hear otherwise from your attorneys.

Just a quick update on AP Case- Today the e filed application got approved The total time it took is about 10 days from filing to approval.
