My lawyer sent out the LC Substitution/140/485/EAD on July 2nd and said that all these can be filed concurrently and he wanted to take advantage of the dates being current.
I read in several forums that it's necessary to have the LC substitution stage completed before filing for 140/485. Is this true?
Is it possible that there are more chances of LC substitution denial? If so, what are my options?
Thanks!
PS: This is a genuine LC substitution case!

thanks for your reply.what do you mean by consular processing?
could i do anything to retain my L1 visa status?
my current H1 employer is least helpful.i am getting worried and would like to continue in L1 for few months until i get a suitable opportunity.pls tell me how i can do that.
pls help.
Consular processing is requesting that the H-1 be approved and you will go to the consulate in your home country to pick up the visa and come back on a new H-1, in this situation, you are not requesting for a change of status when you file for a H-1. Your attorney will know how to file a consular processing case.

As per my knowledge as long as H1B extension is applied and is in pending status you can stay/work. Is it a perm or regular case? I had my perm approved in 2 weeks. Last time my employers did a regular and it took approx 3 months.
If it gets rejected then you can use EAD, if you have one. Otherwise i think you have to leave the country in 30 days (or 15 days, i am not sure abt this).

I also have a similar case like the original poster (TexDBoy). I want to move from Boston area to somewhat warmer area.
I have not asked my employer if they would allow me to do this, but my family wants to really move out of Boston (too cold and tough winters). While, i do have a nice job where i see stability (I have been in the company since 8 years now), I would also like to see if I can get to some good companies in the southern places like Dallas, Austin, Raleigh, Atlanta...
What do you guys think?
The last poster mentions getting a LCA.. Does that mean we have to file another Labor? I already have labor and 140 cleared and my 485 is pending with June 2003 date (EB3)

I will be filing my 485 due to the current changes.
I am getting married in December 2007.
1. I am goin to file for my spouse at that time. Is it necessary that the dates should be current in order to file this amendement?
2. I understand that one can file amendment before or within 180 days of acceptance of 485. is this correct ?
3. Is there anyway to know that I am nearing my acceptance of 485?
Your comments are appreciated.

The regulation bans improper commerce and payment for labor certifications. It bans the sale, barter, or purchase of labor certifications. Employers cannot seek or receive payment of any kind for activity related to the labor certification. This includes payment of the employer's attorney fees and costs. Individuals can pay for their own legal fees for separate representation, but the labor certification is regarded as the employer's cost. If there is dual representation, the employer must pay the attorney fees and related costs. This applies only to the labor certification stage.
Applied I-140 and I-485 in EB3 this month. New employer might agree to apply in EB2 category. Assuming I have to pay all costs for EB2 PERM processing, what's the average cost in Manhattan area?

Im confused about using the EAD. Someone please clarify me.
I already received the EAD for me and my wife. Currently, Im in the H1b which is expiring on Sep 2008 (6 years are over). My questions are?
Can I be in H1b and still work another job as a part-time?
If my wife wants to work using her EAD does it have any effect on her h4 status?
If my wife loose her job during the use of her EAD what will be her status?
I applied my I485 in July 2, 2007. As I already received my EAD, can I be unemployed after 180 days and start a business by myself?
I know after receiving the AP I visit any their country. What will be my status after I come back? Still H1b or anything else?
It will be very much appreciated if some can answer my questions?
Thanks ahead

Switch from Adjustment of Status (AOS) to Consular Processing. The caveat is you lose your EAD and will have to wait for your PD to be current before you can work in the US again. Unless you get a new H1 and want to start over!

I've also heard about these two attorneys, one from Reisterstown,MD and the other from Arlington,Va.
I am myself starting the process, and I've heard mixed opinions on these two. i would appreciate anybody that could chip in.
