Name Check is usually sent a week after ones I-485 ND.
I have obeserved this for several cases including mine.
Contrary to popular belief, there is no relation between the time a Name Check is initiated and FP. They are independent.
How did you know the Name check status ? Did you call USCIS ?
It is interesting to know they start the name check before FP.

Hi!
My name on the birth certificate is "girl". What should I do correct it. I was reading on the forums, that we can get a written statement saying that the name was not decided when I was born. And submit that along with high school mark sheets etc. Are there any other things that could rectify this error.

senthil1 is one of those who is "shut the door behind you" kinds folks. He has been consistent on his stand and he wants to side anti immigrants. He is a disgrace and shame to your community. I had a feeling that sometime back he was 'reformed criminal" but does not seem so anymore.
I have been watching his postings for sometime now and his messages closely matche with the antis. He may be working for the losers guild or a hira in the making. Unfortunate.

please ignore the dots...the important thing is to make the lawmakers aware of the issue. As mirage mentions we should send a letter to the rep Logfren, (i have mailed the letters), we just want them to be aware that there is an issue, ROWs please send them too, you will also be impacted. Nothing against EB2's or the comments they have passed so far, we dont want to undermine your visas, the idea here is simply to make the lawmakers and DOS/USCIS aware of the problem.
In a way DOS/USCIS have opened a pandoras box because EB3 as a whole will see slower approvals leading to a larger number of countries stuck in the process across a spectrum of countries. earlier it was mainly india, china and mexico. If visa allotment policy holds then you will see more countries getting retrogessed.
Some one gave me this comment saying
Show me where have I undermined IV efforts? And show me nonsensical or counterproductive posts that I have made -- that is, nonsensical or counterproductive to the cause of upholding the law (not pandering to a particular employment category/chargeability area).

I have time and again given logical proof, along with the text of the law, as to why EB3 is eligible get the EB1 numbers at the same time as EB2. On the other hand none of the detractors have provided proof, or material that shows EB3 does not qualify.
And for all those holier-than-thou EB2, what is about the letter campaign to get NSC/TSC to process application according to PDs (no lawful basis for that), and asking the removal of NSC bosses and what not. You seem to have different standards when you are suffering, and when others are suffering. There is a word in the dictionary for that, look it up.

Indians do not need a visa to go to Hong Kong also and these days Singapore for those in transit (upto 96 hrs).

i do not expect a gc tomorrow. i did not ask that july become current. but it did. and i lost a lot of money, time and effort to catch the window for an EAD. my family and employer scrambled with me. and got throughly screwed. not by senthil's "mistake", but coldly calculatedly so. in your wonderfully fair world, where does that rank?

Today i received a mail from NVC to pay immigration processing fee of $794.
Does any ones what is this for ? does it help to know the demand ?

Though you are processing through consular processing, can you please verify if you have any reasons ( Birth country, spouse birth country) etc.. to get charged against a category that is current now. If so, it is business as usual, else not sure.. you just got lucky your case is approved, but again .. with pre-adjudication, etc.. we never know.. Anything requested from USCIS, do respond in time.... On the other hand makes me wonder, if the EB2 dates can really advance that much ???? Significant forward movement based on other thread... Anyway good luck.

Thats correct. I came back from India yesterday and i used H1 but my wife used her AP to enter at the POE.
Thats the right way. Probably I should not have told him that I have AP in my hands. This is what my attorney said. But now I have no idea if my h1 will be extended or not once I have used the AP.

Is it possible to file a class status suit?
Maybe IV can cooperate with AILF/AILA and file a classs action? I know that I-485 class action initiated by immigrationportal.com in 2003 has failed, but it could be a different story with IV.
In the meantime, I encourage everyone to fight for your rights individually. The number of favorable decisions similar to what posted above is close to 100 for AOS cases.

Hi Ron,
My Priority date is Jan 2004, EB3-India category and i have an approved I-140 and have applied my 485 during July 07. I have sent my EAD and AP for renewal which expire in last week of September. My spouse is in EB2-India having pd Dec 2005, also applied I-485 (140 is approved) during July 07 and has applied for EAD and AP renewal, which expire in last week of October. We both applied independently and are using our H1bs and not EAds.
Since my spouse's PD is going to be current in August 2008, I was planning on applying for a second 485 as a dependent on my spouse's application.
I know that two 485 applications causes issues. I want your recommendation and also will my application affect my wife's processing time or create issues for her.

You don't need to file a new I-485. Make the CIS aware of your spouse's case and your eligibility under it as a dependent. Ask them to cross reference to the two cases.

I just don't get Ron. He's very vocal about how incompetent CIS is with regular applications......not sure why he would advise you to complicate matters with CIS.

I thought uscis generally followed 'first-in-first-out' rule. That is one reason I-485 receipt notices never show PD. Am I right?
I doubt the USCIS has any rules regarding processing queue. Some people are waiting 10+ years, others receive approvals in 2 months.

Good talent also needs to make up its mind as to which company to stick to. The "future job" labor petition is so full of holes that its misused lot more than its used.
Its not so simple though. Even after finding a good company to stick to, you should not make up your mind to remain stagnant. When you work for about 5 years, you will be faced with a situation where you are asked to take on more responsibility.
The way things are with the current process, if you want to progress in your career and take on a new challenge (eg: database programmer to a DBA/architect), that would require a new LCA since there is a significant change in the responsibilities.
Also at big companies, there are several lines of businesses which are structured as if they are companies by themselves. If you want to shift between LOBs within the same big company, that would also require a new LCA.

BUT regarding the L1 violation we have decided and this time the vendor is exposed to the authorities and justice is done. We have the support of good client managers who understands visa regulations.

4) All Pacific stopovers - Tokyo, Seoul, Kuala Lumpur, Singapore (China Air, JAL, Korean Air, Malaysian Airlines, Singapore Airlines)
