There is a question on part 7 of AP efiling. I guess, same question is also there in paper form as well. Could somebody please explain as to what to do about this. Here is the question:-

I have notice one more soft LUD on new I 129. I don't know whats going on.
Any one with same or similar experience?

In a way it is always RD, even if it is retrogressed, they process by RD within the eligible cases with some exception scenarios.
I think when its current then its the I-485 RD. If its retrogressed then your PD is very important.

I do agree with your thoughts to some extent.
1) Unless we get lot more folks involved, it will be a tough task. A small number for a DC rally or a phone campaign will not do much.
2) Indian community (including GC holders, Citizens and highly placed individuals) would need to be involved if this has to become a visible voice.
The best way to achieve these objectives is by taking it upon ourselves and reach out to these people. Unless enough awareness is generated, our campiagns will not generate enough heat to power the bills forward.
People like pappu and the rest of the IV leadership have been intact "without" losing track or scope and have always believed in getting things done and not getting influenced by the negative vibes.
These are the kind of people who lay a strong foundation and hold the walls intact.
We need more and more of believers in the community

FYI, I got my RFE today too and it is for the same exact thing as my wife's, which I shared yesterday below.
I got LUD 2/17 and 2/18, same for my wife, 2/17 was RFE message, got my wife's RFE in mail today it was for a serological HIV test which was supposedly required but was not done.
Have yet to receive my RFE yet, hopefully tomorrow.

Nag, u r in a bad situation no doubt. But u had every chance to apply for labor via PERM as well (many of my friends did that) just to be on a safer side. So u r partially to be blamed for ur sorry state.

Hydboy, you make a good point. Does anyone know if this is how USCIS would do a Qtrly Spillover if they do it ? And do they have to make the EB2-I and EB2-C dates the same before they do a spill over like they do it for the yearly?
The quarterly spillover is still a myth untill we see it happen one time. I don't recall a big movement in any quarter in the last few years.....except the last quarter of the year when they have done the annual spillover.
That said....I would obviously love to see a quarterly spillover as I think it might make my date current a few months earlier.

India rejected both Boeing and Lockheed Martin's proposal of fighters . I am not debating the reasons or the merits of this decision if this was right or wrong . I am just discussing the potential repercussions this has had so far and might have .

1) The issue is so serious that Tim Roemer , US Ambassador to India submitted his resignation immediately since he was on the hook for making this deal work .This shows the measure of disappointment they had.
2) India was seeking US assurances in security a Permanent Security council seat , which looks far fetched now .
4) Pentagon , Whitehouse and the DoD very upset that deal fell through . This sentiment will certainly percolate to the USCIS and the State department and might embolden Anti Immigration senators whose measures will get more support in the house and senate.
5) Prosecution of companies entangled in cases like Infosys might find more support and favor with the Govt.

Is your NC cleared? If yes, shouldn't you have received your gc in early 2007 itself before July 07 messed up EB3?
Even if its not cleared, you would have surely crossed 180-day barrier, yes?
I'm not EB3 but if you can post updates in this thread related to your case, it would satisfy some of my curiosity.

We got FP notices for me & my wife on 01-25-08. Finger printing date is Feb 6th, 2008. Same date, same time for both of us. Just perfect!
We filed our I-485 application/EAD/AP on July 6th, 2007.
Ours is a transferred case (NSS-CSC-NSC).
Did not open any service request.
Looks like they started processing transferred cases.
People who have been waiting should be getting their FP notices now.

Trust me. You would see an approval this month. Most of the people who got an LUD on their approved I-140 on 07/13/2008 are seeing their GC approved. Only uncertain people are those who hasn't seen any such light.

Thanks. she is still working for the same employer who sponsored her H1. Now, she needs to continue maintaining relation and continue working working them.
I am still worried though.. I read in this and other forums that USCIS may issue RFE asking for proof and if says medical leave, then asking for medical records etc.. So, better to prepare for some 'solid' answer with any loopholes by being honest. I do not think lying would help and may lead to more troubles.

Just curious, why would any one file again just because they did not get the receipt for the first one (unless there is a legitimate concern like no Fedex/currier tracking for the first one , change of conditions like have second/better LC etc)?
What guarantees the second one will be accepted ? Just improving the odds ? Then, why stop at filing two applications ??

I saw lud chnage on my 485 on 2/5/09. How long the finger prints are valid?
Is any one's LUD changed recently?
Would you mind updating your profile. The 4 or 5 posts above yours were about LUD's. I am not sure what else you asking for. ??
And, finger prints are usually valid for 15 months, and there is no definite trend as to who is asked for finger prints again and who is not.
