    I guess this bill passage is a trigger to all skilled workers to do the following.

    Option-1: Become Illegal and get a Z visa.

    Options-2: Go back to home land and live with dignity and peace of mind. (This is the option I would take). I am thankfully to the congress for helping me to make a decision, rather then wait for life time.

    Options-3: Re-apply in merit based system and wait in line for 4 to 5 years, until some other similar bill comes and says you to restart again in some other system.

    If I send some information to USCIS that I am invoking AC 21, they would not allow my employer to revoke I 140?

    Leave on good terms with your current employer. If that's not possible and you have a good reason to believe that they'll withdraw I-140, conduct a pre-emptive strike and file AC21 papers with the USCIS (a new employment offer listing job title, duties, salary). That will eliminate or at least minimize a headache associated with I-140 withdrawal. Employer is free to withdraw I-140 at any time and the USCIS cannot prohibit it. However, even if I-140 is withdrawn, your I-485 remains valid if you have a new employment offer. So no worries, just plan for it and act according to your gut feeling :)

    it talk about people being "otherwise deportable"
    someone needs to clarify with an immigration attorney or something
    I emailed my attorney to see if she could clarify whether legals are able to benefit from this bill...I'll post an update once she replies. Have a good weekend!!!

    I presume that ROW would be significantly impacted by this as India & China would not benefit a lot from it now because of PDs being badly retrogressed. I'm afraid that this has the potential of exhausting EB3-ROW row numbers for the rest of the year. Am I wrong to assume this?


    I am trying to figure out the impact of this ruling on the current usage of visa numbers.

    I am from ROW so I would like to see how many more from ROW would demand visa numbers due to this new ruling.

    Obviously this is important to India and China as well because the only way these two categories would get more visa numbers is from ROW overflow this year as these categories have used up most of their visa numvers for the year.

    Any ideas guys??

    One important observation is that EB2 India/China shouldn't celebrate until State changes their planning style. If CIS wastes visas due to swing movement by State, EB2 I/C doesn't move so much and numbers will be wasted. So it is important that IV push state to incorporate long term planning and add the CIS processing as a lead time to calculate visa dates movement at least for post July 2007.

    go check the tri state poll, see if it's crossed 50 responses out of 3,500 + members. to have a poll and make it meaningful you need willing participants. that means many people need to spend a whole 30 secs not thinking about receipts. everyone worries about them- i'm talking here about the significant number that obsess about them. do note that the July 2 thread dies after work hours. so most people who refresh all day do it only at work.

    nah! we can't have a poll. it would be a meaningless exercise. my guess is that we will only get people to understand what the problems really are when another knock like July 2 comes along. and that is just too sad....

    ....I am not sure why someone is portraying Infy or Wipro as companies that go for "Easy money..." that's completely ridiculous. Agreed they are not doing lots of so called high-end R & D projects and majority of thier revenue is still from service industry. But that does not make these companies any lesser.

    I am not sure how much insight you guys got into these companies, but they are doing quite a lot of good assignments. Also, the processes they got in place & the maturity they show in execution of assignments is definitely on par with any other software services company in the world.

    Probably a bunch of you folks are frustrated with these companies because the billing rates are driven down & opportunites in US (for consultants) are becoming less due to these companies' offshore model - but that does not make these companies shallow as you are trying to portray.

    PS: I am not an employee with either of these companies. FOr that matter, none of these offshore-based companies. But the facts are to be accepted.

    You may admire them as much as you want but fact is these are just "glorified" bodyshoppers. I meet many workers from these "great" companies at my workplace and see them being treated just as "low cost alternatives" and nothing else by this huge financial company in NY/NJ area. Because of their (INFY, TATA, Wipro, Satyam) "low billing rates" these guys cant afford good lifestyle. And back home in India INFY and TATA CEOs make billions and talk BIG. I've not met any TATA, Satyam guy here who is happy with their employer. They just hate their employers and always looking for a change. I wonder where they stand in terms of employee satisfaction? They treat their people like slave and send them as low cost labor. Not only that - they exploit US immigration rules and make use of L1 to keep their people long term at cliant place when they dont get enough H1.

    No difference from local bodyshoppers! Dont think they are great companies. You may say "you folks are frustrated with these companies". But this is the fact. Period.

    I am also an NCS-CSC-NSC transfer. Got LUDs on 2/10 on my/my wife's application. I just got an email saying an RFE was sent just for my application.

    Anyone else that got RFEs after getting LUDs at the beginning of Feb? What were the RFEs for?

    I got LUDs on 2/10 on both mine and my wife's 485. My wife got an RFE email on 02/13. I do not know what this means either...

I don't want to commit the deadly sin of predicting but there is hope that EB3 India might move albeit slowly :p
    Yes that's true. Wonder why the "current" level of demand for EB2 India is higher than that for EB3 India.

    BTW, current for USCIS means you have to do significant travel in time backwards. :)

    Thanks for doing this. I would suggest you to collect more data with real life stories and create a template, post it here. Then everyone can send the same to senator and white house. Anyway thanks for your work


    I'm done. I posted whatever I had on WhiteHouse.gov and wrote to my Senator. I think the strength is in numbers - so the effectiveness of this depends on the number of people that write in - Even if people dont include their personal stories, just the fact that you will include your address when you write to your senator makes it personal. Just my 2 cents!!!

    Still your I 140 info does not show up. Also, my pd is of april 2006. But I -140 not approved yet, pending since june 2006. Ur new update is only giving me a good hope.
