I'd would definitely schedule a consult with another attorney. There is nothing that ties you to this particular attorney prior to the actual filing. I highly recommend getting a local attorney (same state as your employment location), they will be more familiar with state labor agency idiosyncrasies. Make sure to get a recommendation from a friend or colleague, don't pick a name out of the phone book or take your employer's recommendation.

It is very easy to comment on the forum and provide big ideas and direction, but I have seen that when it comes to walking the talk very very few have the will or interest to carry out their own suggestion. IV was created precisely for this reason. People were lurking on various forums before IV and hiding behind anonymity. They were scared to do anything and could only hope to GOD , lawyers or whoever could help them. Everyone was throwing ideas at each other and not doing anything. The whole community was screwed and nobody was even willing to even go and talk to the media with their real name, go to DC and talk to lawmakers on their own money and vacation time. People would not even open up to their friends and talk to their friends about green card problems and do something together. This community had to stop living a life of tail between the legs and blaming their fate for their own problems. IV is a platform where you no longer have to complain. Each one of us on this forum has now enough awareness, has seen what we all are capable of doing together in advocacy so there is no reason to not approach our employers.
These corps rely on EB2 and EB3 folks for innovation and technology. Corporations have a lot of power in pushing legislation.

I have received approval on April 04 and today I have received GCs for all my family but not for one of my daughters. I checked USCIS and I just realized her application is still pending. She just turned 14 on March and she only did FP 2. Do you think she has to do again FP or they just left her behind......
Same story here. They will send RFE for biometrics for her. Expect it within a month, if you do not get it in a month, take Infopass/call and ask for biometrics appointment. My daughter's I-485 was approved next day after FP.

The number of cases approved during 2002-2005 was at least 2-3 times what was being approved now(when recapture was in force)... improving efficiency will not give us any more visas... if there are 100k waiting for a GC they will still keep waiting no matter how efficient USCIS is. The fact of the matter is that they can only approve 3k per category per country. recaptured visas are free of country and category caps. It will not cause divisions or issues and will help unite everyone behind one cause. Other short term issues dont help(multiyear EADs or APs and such)...they just prolong the pain and drain money every year. The queue can only be reduced, by time or attrition or more output... we can all agree which is better.

My wife got her H1b petition approved but not the change of status, that is she did not get the I94 along with the approval (she was outside the country at the time of approval). I know that she should be going out of the country and get the visa before she can start working. But After some research I found that there is another option, which is filing "amendment petition".

No one is saying that IV is ditching Eb3.Everyone(at least EB3 guys) is saying that EB3 needs special attention because it's movement is dead now.
While IV has not lobbied for any particular EB category but I think that is what they should be doing. Isn't one of IV's goals is to end retrogression ... so shouldn't EB3 be at least lobbied for since they are in such a mess ... I don't believe it sometimes that we are still in 2001.. that is 10 years back.
In a couple of years EB2 will be more or less current. So that means a guy who came two years back will file in EB2 and get his GC and I who has been working here for 12 years would still be waiting in line.
Some people say EB1 are brighter than EB2 and EB2 are brighter than EB3 . I find that funny because no one Eb1 or EB2 or EB3 is brighter than anyone unless someone has an extraordinary PHd or is a scientist . Its the lawyers who are brighter and how co-operative your company is.

I am writing to the local congressmen, to request USCIS to apply the spillover visas to EB cases with older priority date first (irrespective of it's category or country). I hope this will help, if lot of these local congressmen/women contact USCIS to handle this spillover in a fair manner, allocating to older priority date cases first irrespective of category or country. All EB3 folks please take some time and do the same writing to your congressmen about this issue.

I did not write this bill. You should go to challenge Rep. Issa for that clause. In my previous post, I already said I am perfectly OK if the IV core want to modify the bill, so that the 55K can be applied to everyone. Is that very clear?
My friend there is no need for you to get antoganized with me because what i said in my previous post is more a message to everyone on this forum and is not anything personal against you. In fact i am surpirsed that you are even discussing opening up teh 55K to everyone.
