If it is by and large the same business, their immigration lawyer will have to file some paperwork indicating the company has changed its structure and for the paperwork to be amend under the new name.

As you can see for my profile my labor cert was filed in Dec 2002 and I am Eb3 India. So all these years I have been assuming my priority date for I485 processing as Dec 2002. But now it seems there is a problem.
There have been two I-140 filings for me - first the original one which has the correct priority date of Dec 2002. Later on the company was acquired and the new company filed a successor of interest I-140 in Aug 2007. This I-140 was approved in March 2008. I have copy of this 2nd I-140 and didn't pay attention to the priority date printed on this I-140. To my dismay the priority date mentioned on the Aug 2007 approved I-140 is Aug 2007.
I wanted to find out what was the priority date in USCIS records and I called the 1-800 number. They asked me to meet the local USCIS office so took the Infopass this morning. The local San Jose USCIS office says that they would take the Aug 2007 as the priority date :( and have told me to contact my attorney.
As you can imagine I am quite devastated. Has anybody been in the same situation where the priority date on I-140 was different from Labor filing date? How did you get it corrected.

I don't think that would work. Here are a couple of articles that seem to suggest that you cannot create your company on H-1B (http://www.laborimmigration.com/2008/01/starting-own-company-on-h-1b-visa/) and also that you cannot volunteer to do a job which would otherwise by a paying job (http://www.laborimmigration.com/2008/02/unpaid-volunteer-work-on-h-1b-h-4-or-f-1-visas/)

thanks gcwaiting!!! I was so worried, my attorney told me that I onlyhad 45 days, maybe he wanted his payment in 45 days......
This is to complicated and INS take a lot of time to respond....By the way do you know aproximately how long will take to receive the I-140 approval? And if there is a chance to receive a DENIED notice? I'm so wooried about all this process and alo because I don't have the best attorney in th all world, and sometimes I don't know what to do...I'm learning a lot fom this forums. Thanks Again....

8th Year H1 extension applied by current company. Still in process, should be approved in Nov 2006.

There is nothing tricky, it is plain and simple: you want to switch jobs?
You have to apply for a new H1. You absolutely cannot use your current H1 to work any other job.

My situation is that Lawyer says I-485 appl. was hand delivered to INS at Nebraska on July 2nd morn. They had sent about 300 appls. July 2nd that way to avoid the change of dates fiasco etc.
Now, his office says that INS has not given any receipt for the delivery or acceptance of the hand delivered packages and there is no way to get a receipt etc. until checks are cleared. Since there is no tracking # etc. from fedex we are in the dark about the acceptance situation. According to him none of the packets have been returned either.
Is there anyone else in a similar situation?

If you have recevied at least AP notice, you can use that for 1 month or so till you get another card..
