    I understand that. However, apart from canvassing the support for CIR by writing to senators, lawmakers, in what capacity can IV influence USCIS to take up EB-3 cause?

    Even if IV has intentions to ameliorate our pain, is it truly capable to influence the agency to do something for only one specific category ? At a micro-level, we EB-3 need to do something about changing our situation ourselves, lest we stand in the filthy excreta for eons. :mad:

    I truly believe, though IV's efforts can impact a little bit, they have to join other organizations to strengthen the efforts and results.

    Expat�s Voice: Representing the Expat Community

    We at Expat�s Voice ask for your support in achieving genuinely comprehensive and fair immigration reform.

    Our organization represents thousands of members who have legally immigrated to the United States, including immigrant and nonimmigrant visa holders, and those that are awaiting immigration. The diversity of our membership means we truly understand first hand the problems with the current immigration system.

    We commend the work of the Government in attempting to bring in much needed reform. However, the rights of many, specifically of children and of legal immigrants are being overlooked, and we want to bring the pertinent issues to your attention.

    First, we ask for a much needed compassionate visa. Many of our members, due to immigration related reasons cannot leave the country without repercussions for their visa status. They have elderly Parents and other relatives in seriously ill condition. Similarly, our own families have not been allowed to enter the USA on a compassionate basis. My own husband passed away last year, but my son was refused a temporary visa to pay his last respects because of problems with �immigrant intent.� The US Embassy showed no compassion or common sense. Yet due to the unfairness of the system, many families have to suffer this type of humiliation on a regular basis as a result of the system, largely because of reasons of mere technicalities. This has to change.

    Second, we support all measures that protect children. They are innocent in the whole immigration process whether brought to this country legally or illegally. The US Government has failed repeatedly to bring the Dream Act to fruition. We ask that ALL children, whether having entered the USA illegally or under legal nonimmigrant status, who can bring so much benefit to this country�s future be recognized and protected as soon as possible. There is ambiguity as to whether the Dream Act protects all children the meet the criteria or only illegal children; if it is the latter it needs to expanded to cover legal migrant children, whose Parents have respected and abided with US immigration laws. In addition, the legislation would not prevent certain nonimmigrant dependent (such as E dependents) from aging out at 21 unless they meet certain criteria. Therefore, we also ask for an amendment to the Child Protection Status Act of 2002 (CSPA), if not in the Dream Bill, to prevent these families from being separated when the child reaches 21.

    Third, many children �age out� due to the long waiting periods involved with family-based petitions. The Child Protection Status Act of 2002 (CSPA) was intended to address many of these issues, but the legislation has simply failed in this aim. Many of our members are now stuck in their country of residence, despite their Parents and younger siblings having already immigrated to the USA. The CSPA was designed to ensure children who aged out were awarded earlier priority dates associated with their previous petition to prevent being forced to the back of the line with a new petition and new priority date (and, when taking into account the waits associated with both the original petition and the subsequent petition after aging out, this can cause waits in excess of 30 years). However, the failure of the USCIS to apply this law correctly, because of an ambiguity in the way section 3 (INS, section 203(h)) is drafted, and the fact no visa advisory opinion nor any rules have been issued after four and half years since the CSPA was enacted, means many families remain separated.

    Fourth, many of our members are E2 and L1 visa holders. They contribute millions of dollars to the US economy and provide employment to many American citizens. However, despite being in this country legally and providing many benefits, they are treated like second class members in the USA. Our E2 members have to return to their country every two years to renew their visa, with no guarantee of visa renewal putting their investment and the American employees at serious risk. This is compounded with severe delays in visa processing times, particularly in London. Despite providing these benefits, often for more than a decade, it is very disappointing that our members do not have a direct path to citizenship. What is even more surprising is that despite having abided by and respected US laws, it is the illegal immigrants who stand to directly benefit from the Strive Bill with a direct path to permanent residency and citizenship.

    Our members, many of who are British citizens, feel cheated by the US Government. Much is spoken of our �special relationship,� but in practice it seems the rights of illegal immigrants take priority. Further, many have suffered from poor treatment by immigration and enforcement officials, but we remain patient and respectful. As an organization we are neither for nor against the rights of illegal immigrants. We simply ask that our commitment and duty to this country be recognized with at least equal reward and that you support Rep. Heather Wilson�s proposed E2 Nonimmigrant Investor Adjustment Act of 2007. We do, however, believe the 3,000 proposed figure will create a backlog of investor immigrants and so urge you to remove the proposed cap, or support a larger number and/or also introduce an annual increase to meet market demand.

    In sum we ask you for fair reforms: to recognize the principle of family reunification through amendments to the CSPA; to reward those who abide by and respect US laws to at least the same level as those that don�t; to treat the children with compassion and open arms by giving them an opportunity to remain in and benefit this great country; and to show compassion and prevent humiliation to many thousands of families, by allowing family members to be with their loved one on a temporary basis in their time of need and often in their last moments, both in the USA and outside the USA.

    Unless one has studied in the US, one will not realize the worth of the US educational system. One clear attribute of US educated professionals is their superior written and verbal communication skills. Not to mention the enhanced ability to culturally fit in a diverse environment.

    If this were the case why so many "US educated desis" work for so called "body shoppers" and stay in "Guest houses" provided by these desi consulting companies.

    I am from Chinese community and registered IV just a couple of week ago. There was no email message to me regarding this movement, and some other registerd users may encounter the same situation. You may need to resend them. Only when I opened IV website yesterday did I know this recurring program and current situation. I am assuming IV is the only group who are pushing to get the I-485 relief for high skilled workers with advanced degree. There are MANY MANY Chinese in the same situation but I guess there might not have so many Chinese in IV. IV core group may think of some better way to reach more Chinese or other communities. Basically, we are on the same boat for the same direction. Better to concentrate all resources to reach the same goal. I would suggest IV to setup a seperate Chinese (or Hispanic) contribution page to diverse the culture background of IV members.

    PERM approved in EB2 today after 4.5 months...now I'm officially EB2 and in the long wait line. Glad that my PERM got approved.

    Congrats on your approval. My EB-2 PD is Mar 30th 2010, still waiting...What were the minimum requirements on your PERM.

    Immigration Voice: Announces Advocacy days in Washington DC in April.

    Immigration Voice in its continued efforts to find legislative and administrative fixes is holding Advocacy Days in Washington DC on Monday, April 4th and Tuesday, April 5th.

    2011 is a crucial year to get the fix needed to clear the backlogs and allow for our high skilled immigrants to get the relief needed. We need to capitalize on the opportunity to push for legislation now, as it is unlikely to have any favorable immigration bill to be brought for the next 2-3 years (Primary campaigns, Presidential campaigns will take priority).

    IV’s vision is to hold more than 400 meetings with the legislator offices both in the House and the Senate. We will also be holding meetings with senior administration officials working on immigration issues. As a grassroots organization we need members from all across the country to register, participate in the advocacy event, bring awareness on our issues and seek a positive vote on our provisions from the legislators.

    We aim to resolve this issue but we cannot do it alone and therefore it is imperative for everyone, and by that we mean EVERY ONE to participate in one way or the other. If you wanted to be a part of the past events but couldn’t, then now is your chance to make your voices heard and fight for a fair system and just process. Always remember, we are in United States at the invitation of our employers and our employers have filed our green card petitions in order to retain us. It is only fair and only just to ask for a system that achieves that objective without delays and without putting the immigrants in probationary limbo for 6-12 years. And it is your obligation to yourself and your family to stand up for your rights and ask Congress to legislate and fix the system so that it works the way it was originally intended to work.

    Our previous efforts such as the June Advocacy 2010, September Advocacy and Rally 2007, Flower campaign, San Jose Rally, and many intermediary mini advocacy events in DC has allowed us to be one step closer to the goal. We need to make this upcoming event as a final push for reform. The President’s STOU address and feedback from Lawmaker meetings have provided us the encouragement to pursue this endeavor. As many of our members know, the efforts in our last advocacy days are consequential in how we are perceived by the lawmaker offices. IV calls upon members who participated previously to provide their input on the need for advocacy efforts and persuade many others to join in.

    Immigration Voice will arrange for meetings, advocacy material, and other logistics necessary for all the events during the Advocacy Days. All you have to do is show up. We request our members to come in on Saturday, April 2nd for orientation and training. Please make arrangements to carpool (for driving distances), book airline tickets, and contact friends in DC/MD area to host you. IV will not sponsor your travel and stay for this event. We expect each one of you to take the initiative and stand up for yourself and your family and use this opportunity to ask lawmakers to act on high-skilled immigration issue.

    Our efforts have to be of a massive scale, we need members from every State to participate in the event. To be successful we need more than 200 members attending meetings. We also need to know in advance on your attendance. Please take the time to talk to your employers, arrange for a leave of absence, and register for the event as soon as possible. Make every possible attempt to be in DC.

    To conduct such an effort, IV also needs contributions. Our estimated cost is around $50,000 for the event. We need generous contributions from our members, especially from members who are unable to make it to the DC event. To be clear, all one time contributions starting from February 1st will be considered as a contribution to the advocacy event. All the recurring donations will continue to go towards Donor forum access. Our advocacy event costs will be on top of our regular costs and we need to pay for both.

    I quoted a fact (rational and valid) to argue your assumptions. I never even claimed to know what USCIS would do and how they would present the data. It was you who presented a theory to justify that we should not go with any change in the spill over. I want to know why you dont want EB3I not to proceed with this measure. Is it because you believe it will take away numbers from EB2 or EB3I is doomed with plenty of cases and any amount will not make any changes. I believe its perhaps the earlier than the later. See, we all have our needs and we all want to look for ourselves first (including you and me). Its basic human nature. We all can generate obfuscatory facts to push our agenda. But at the end does it justify the means ?

    I just presented a theory. Right or wrong is upto you to decide. I never said EB3 should not do anything for or against spillover. All I am saying is spill over either helps Eb3 from 2001 - 2003 (perhaps some 2004) or helps Eb2 post 2005 now for all other Eb3 folks the hope lies in PD recapture or upgrading to EB2 ( if spill over rules benefit EB2 only).

    What about all those visa subs in July 07 with PD in 2002 - 2004 who are waiting less than EB2 2005 cases? Is it legal for them to get GC quicker the answer is YES. Is it ethical? I would leave it to the readers to decide.

    why would EB2 retrogress to before 2003? It was at 2003 for a long time (8 months?). The only people still with PD of EB2 2002 are the ones just getting out of BEC, there cant be too many of them...

    There may be some EB2 Indians with PD in 2002 and 2003 (with traditional non-RIR LC) got out of BEC recently. If 1,500 Indian non-RIR LCs (with EB2 PD 2003)certified recently from BEC, that is sufficent to move the date back to 2003 for India again. Having said that, it is all prediction. No one knows, except USCIS. My prediction is just based on the magnitude of 485s (800K) filed recently, as is has all kind of composition in huge manitude, apart from so many 485s already pending due to name check.

    I agree, this is the way politics works most of the time. lobby for votes, etc.

    But isn't it also their job to do what is in the best interest of the Nation. Everything isn't decided by lobbies.

    Maybe we're approaching this the wrong way, in trying to build competing lobby. it needs a new approach. Congress should be convinced in a different way.

    Lobby is for optional, nice to have things, which will not be generally missed if they fail.
    Legal immigration is none of these and is almost mandatory. Imagine losing for eg. 200K EB3s. another 50K doctors.

    yes, they do think for the betterment of THEIR country. you and i don't fit in THEIR model of GOOD for their country.
    your average low information "american" voter lacks the thought capability to process what you are saying.

    Having spoken with several congressional aids I can say that such issues are well received. The specific issue that I have raised (it does not affect me) is examples of people leaving USA and having to explain to their US born children why mummy and daddy are not welcome in the USA, and thus why they have to grow up in a foreign country.

    I have also given examples of one sibling being born in USA and other aging out.

    However, I have only raised this where law makers are known to be sympathetic to family immigration, e.g. support DREAM.

    I think that the best we can do is:
    Get wait times down (and reduce impact of this).
    Use this as an argument with those who support family based immigration (and may even be hostile to EB otherwise).
    If we have an opportunity to address this as part of other EB legislation we can.

    It is certainly not forgotten by me.

    I do think that it would be helpful to have a list of people in IV with this problem (with ages of all children plus relevant dates). For the moment I'm too busy to organize this (busy with IV work -- like 4am bed times).

    More active help (not just forum discussion) with IV is always welcome, so you are welcome to step up and help (e.g. compiling a list of such members etc.). Politics is personal so being able to present personal cases is helpful.

    CSPA LAWSUIT TO BE FILED ON MONDAY

    June 21, 2008

    We will file our CSPA lawsuit on Monday. We have another plaintiff thanks to Atty. Andrew Knapp.

    We hope that the USCIS, DHS and the Department of State will follow Matter of Garcia and apply the law not only to our plaintiffs but across the board.

    Thousands of immigrants would benefit. We will post a copy of our complaint on our website later this weekend, and will discuss the lawsuit at the AILA convention next week, and in the upcoming issue of our free, e-mail newsletter.

    Called all of them early morning 10am eastern time
    which is 7am pacific for me. No hold anywhere. All calls were
    done in ten minutes.

    Response from most of them was "I will pass the message".
    Some took my phone number, name and current location.
    Exceptions were

    From office of 'Hilda Solis', staff said that congressman is already
    supporting those bills.

    Office of "Ciro Rodriguez" said that they respond to issues from
    their constituents and encouraged me to call my representative.

    Office of "Lucille Roybal-Allard" said "pass and message" and asked
    if I have contacted my representative.

    IV members who are the constituents of Congressman Rodriguez, please take a few minutes to call him and impress upon him of how important this is for his constituents.
