Damn this sucking life man, no social life, no career life, no nothing life. Even animals must be living a better and meaningful life. It sucks big time, did it ever happen in history that uscis revised a visa bulletin on the day it is supposed to go into effect ....
We must fill their mailbox guys, let tham know this cannot be accepted.

I am going for concurrent 140 & 485. Can I apply for EAD and AP now? or do I need to have my 140 cleared before I can apply for EAD and AP?

I am also in the same situation. Recently I changed the employer. My new employer is going to file I-140 and I-485 using the Labor substitution.
I also want to file EAD and AP but the company attorney is saying it is safer to file the EAD and AP once the I-140 is approved. Can any one please answer this is true or not? Should I wait for I-140 to be approved or should I try convince the attorney to file EAD and AP also along with I-140 and I-485.
I have one more question which is if We do not file the EAD and AP along with the I-485 and once the priority dates are retrogessed. Can we file
EAD and AP even though the priority dates are not current.
I would appreciate the answers.

Finallly, my online status changed from "Initial review" -> "Document production" and also got email from Senator's office that my case is approved.
I think I got it....but not 100% sure yet...no approval emails yet... or no other proof.

What Pappu says is right. Ppl have been so impatient that they're bombarding USCIS with SRs, emails, letters from attorneys, Infopass etc..etc...etc...I understand the anxiety but isnt this a bit 2 much? I was no exception to this. I raised an SR on the very first day my date got current and on trying to followup on the SR the very next week, I stumbled upon a clearly tired second level IO who didn't like the way I was pushing for it. He clearly explained to me that there was no need to worry as the dates were current and everyone who was current and cleared of security would be approved as there were several visa numbers available and he also told me that there have been thousands of calls received everyday and its becoming really hard for them to handle the situation. I could see how tired and frustrated he was. I immediately understood their plight and just waited without any further action and within a span of 15 days after that call, I got my approval. My attorney also advised me to wait as he was sure the dates were gonna be current the next month as well and followups would only result in delays.
Well I'm not saying its wrong to be anxious. Ofcourse, its an important milestone, one that secures our future in this country and yes, its only natural to be anxious. But being anxious doesn't mean that by calling or emailing or Ombudsman etc...ur case will be approved. Try and put yourselves in the IO's shoes as well. For a moment think what it wud be like to be an USCIS first lvl/second lvl IO receiving the same call every minute from a diff person and each one trying to reach the second lvl IO with lies such as my A# on file is diff than the one on 140 OR address change etc...etc...This is ridiculous. After years of wait we resort to such shameful behavior towards the end.
Yes when others with later PDs are getting approved and u r still waiting, it does bring out frustration in u. But u should also put in thought as to why that could be. I have attended the Interview for H1 B renewal at the US consulate in Toronto (Although i see a lot of posts concerning US consulates in India....thought this might be helpful for someone who would attend an interviewat US consulate in Toronto)
I attended the Interview on Jan 16th at toronto for H1 B renewal and i got my passport back on Jan 23rd (4 business days as the officer told me as jan 21st is a holiday...martin Luther king day)
I have been speaking to some people at the consulate and for them it is taking 5-8 business days and for some they got it in 4 business days.....the worst i have seen is for a lady who was coming to the consulate from past 3 weeks everyday and there is no ETA on her status..(i hope she gets her passport soon:) )...
Unfortunately most of the people who attended there did not know of these delays and are struck cancelling and re-booking their flight tickets and extending their hotel stay

Finally got greened. Got the CPO email for myself and my wife today. It has been more than 9.5 frustrating years since I came to this country. But I am finally happy that it came through.
I am even more happy that I did not just leave it to time. I have been heavily involved with IV from the beginning. I have spent plenty of time and money on IV and happy to see that it has benefited myself and others.
Don't loose heart. Keep fighting for what you think is fair.

What are u guys trying to acheive and how will this help EB3 India?
Also, how is the spillover going to be distributed among EB3? First EB3 ROW and then EB3 C/I as in the old system?
Personally, I think the visa recapture bill would help things quite a bit.

At the cost of being bombarded by every one in this forum,
if the VB bulletin is indeed "retrogressed" to Pre madness - back to what was supposed to be the next jump from June 2003 (perhaps 6 months or more for EB3 and 2005 for EB2), this would actually be a good thing in my opinion.
What they did by making the VB current is going to have serious consequences a few months down the line. People who have been waiting for years may still not get their turn in line, while others simply jump ahead and take away the visa numbers. People are excited at the short term benefits of EAD/AP but we must look at the long term effects also.
I believe (and im entitled to my own beliefs ) that if anything, USCIS/DOS have actually finally figured out their mistake of making everything current and are now back tracking to what would be a decent situation instead of the floodgates being opened. I dont believe it has anything to do with conspiracy theories or CIR or any such thing.
And btw - i would be one of those people who spent money to get ready for the floodgates and i would also be one of those that gets stuck!

Whats the fee of INR 155 for? Nothing of that sort was mentioned to me by the consular officer. He just asked to submit the passport. But if you do have to submit, should I get it in form of a receipt from HDFC as I did for the visa appointment or just cash?
Yes, you can only deposit your passport at the western VFS locations only if you are interviewing at Mumbai. In my case I gave my passport to a responsible friend of mine in Mumbai who in turn was able to deposit the PP with INR 155 as the fee to VFS.
You can not give the passport directly to the consulate, they will not even accept it as that makes them liable for the passports.

My current situation is that my wife and I applied for 485 separately.
my wife's PD is 2007 ( 485 applied in Aug 2007 )
I applied for 485 in Oct 2007, Since my PD is 2003 and is current as of now ( my 140 is pending ), I talked with our companys lawyer on what options do I have with regards to my wife's 485.
My lawyer suggested 2 options.
1. File 485 again for my wife as a spouse derivative. As per lawyer, this is very common and has experienced with these kind of situations.
2. Instead of filing a second 485 for my wife, just write a request letter to move her pending 485 to my 485 as a derivative. If this porting is successful, she cannot move back to her own 485.
I know some of us have gone with option#(1), but since option(2) involves very less paper work, did any of you have used this option so far?
I am confused as to which one to choose. My lawyer spelled diplomatic when asked about which option is better/safer:-)

+ve skin test does not mean anything.
You can be +ve if
1. If you ever had TB
2. If you ever had TB medication
3. If you ever had TB Vaccination
If you are +ve, you need to do chest x-ray to verify whether you have TB or not. Tell your doc for chest x-ray. For me, I knew I will be +ve and so I told my doc for x-ray at the first time and did not have skin test.
I Got Positive Skin Test. What Should I Do Now? Please Inform Me.
