Is this for H4 renewal or first time H4. If its for renewal she can go to any US consulate in India. However, if it is first time she has to go the consulate that falls in her zone i.e her place of residence. Confirm it with VFS.

High-tech immigrants
protest visa delays
About 1,000 highly skilled legal immigrants, carrying placards and cell phones and wearing T-shirts emblazoned with U.S. flags, rallied Tuesday at the Capitol to protest long delays and vast bureaucratic backlogs in the immigration system.
The immigrants, including computer engineers, doctors and medical technicians from India and China, came from as far as California and Washington state to call on Congress to provide more permanent visas for highly educated immigrants and more resources for the overburdened immigration system. They said the plight of foreigners living in the United States legally had been eclipsed by the polarized debate over illegal
immigration that led to the defeat of an immigration overhaul in June.
The immigrants, who are living in the United States on student or high-skilled employment visas, said they were nearing despair with waits lasting as long as a decade to obtain visas giving them permanent residence, which are known as a green cards.

How your husband file H1B for you ?
Did he own a company ?.
Did he file your H1B using desi body shops? without interview or knowing you ?!!!!!!!!!!!!!!!!
Are you start working for the company?
Your H1B start date is October 1, 2009.
Your H1B approval notice does not have I-94 attached, because you are not applied H1B while in USA. So you need to go back to home country to get visa stamped and start working in H1B ASAP.
Am currently on h4.my husband filed new h1b for me in april 2009 and it got approved in August 2009.
But when he filed my h1b i was in india.
i came to us on June 2009 on H4 visa.
can i go ahead and apply for change of status from h4 to h1b and start working.or else should i have to get my h1b stamped before i start my work.please advice.
thanks,
subri.

Thank you so much for your input .Right now I'm in a kind of predicament that my current employer told me in the middle of premium processing that he was hiring another person in my place. Then, when I spoke with my attorney he said we couldn't do anything in the middle of the process but to go ahead with it.I was approved for H1B 3 days after this incident. But, I have never worked for them since then and it's been a month trying to find another non-profit employer. So, in the midst of all this scenario, what would be the next alternative to be in the USA, how long I can be like this , I dont have a single pay stub, so can I show a reason that I was sick /or leave of absence when I find another job and include this kind of document with the peition or can do nothing for this period of time in the new petition.Could anybody please help me and Thanks in advance.

Soumya,
Very legitimate question- don't know if anyone here will have a good answer (I hope so) but I hope you get your problem solved. I would advise a consultation with a good attorney, this is a very important matter for you. Some attorney's will answer an initial question free on the web- gives you some preliminary info.
All the best!
Look into the USCIS travelors information website. That has a seperate FAQ for adoption.

Rajeev,
Sorry, I don't have answer to your questions. If you don't mind, I wanted to ask you couple of quick questions as I plan to apply visa extension for my in-laws.
> What reason did you give for the extension?
> How long did INS take to make the decision?
Thanks,
TB
Hi
We had applied for an extension of my in-laws visa, and it got rejected. Is there any way we can appeal this decision?
Also, they are here a day past their I-94 expiration. Will their multiple entry visas be cancelled? They will leave within 30 days time past their I-94 expiration.
Many thanks

maybe this question has been asked before, I just couldn't find the thread.
These days with tons and tons of I-485 applications received every morning, how is USCIS gonna decide which one to process first?
If it's strictly on "first received, first processed" base, then it may well be that one guy with 3/07 PD date may have his application processed earlier (thus earlier AP and EAD) than one with 5/06 PD date. Simply because the 3/07 PD guy sent out the package much earlier than the 5/06 PD one.
Do I understand correctly?
Is this fair, though?

You will not jeopardize your I-485 as long as job with company C is in same or similar occupation. Whether USCIS will grant an H-1 3 year extension based on a withdrawn/revoked I-140 is not certain. I outlined the reasons for this uncertainty in my response on the thread entitled "Facing Layoff---6 months left..."

Hello,
My original H1B visa was issued to me on Oct 1st, 2010 and is valid till Sep 30th 2010.
I got a new job in 2009 and they applied for my H1 transfer. It was approved and the new dates on the new I797 are 10/01/2009 till 09/17/2012. I went to India after that and when I returned, I got a new I-94 off course which was stamped to be valid until Sep 30th 2010.
Now I am nearing the end of my original H1B visa issued by my previous employer and stamped on my passport this coming October. I am also planning to go to India in this coming June. Will I will have to get my visa renewal stamping done this time if I go to India? Will I need a new H1B stamp on my passport from my new employer on my passport to come back?
I really appreciate any words of wisdom from all you learned people on this forum. Thanks in advance!
-Jatin
You probably have to get your passport stamped for visa renewal.
