    No surprises for me at least. There will be only 816 new EB3 visas available for any country in October. This will move the dates at the most by a month or two and this will continue for ever until a new legislation is passed, that is why DC rally is all the more important and everyone should focus on that to bring in a change.

    For folks wondering how I came to the 816 visa number

    Total GC available = 140000
    7% country limit = 9800
    split for EB3 = 3266
    spread for each qtr = 816

    Good Luck to all and don't have high expectations because you will be disappointed when the bulletin comes out.

    number of families per month (assuming 2.5 persons per family): 109 :(

    I never thought that working for a contractor was something bad!! In fact, I was thinking that contracting is better than working full time! Am I missing something here???

    I mean think about it... you get to work on different projects and you get to learn new stuff, new environments, new people!

    Stay as a full timer and you don't grow (well not like a contractor anyways!). All in all, I think it takes more effort to be a contractor!

    I guess it is a career choice! I personally would rather be a contractor!

    It's definitely a 'Choice' which means - "its Personal" - Maybe for Career or for money or maybe because babes love consultants !!! :) ..

    The 'loser' is the one who tries to judge that "Choice", by saying their choice is better ;)

    If you have a company's blank letter head and genuine salary slips then every thing goes...
    I know after we file the i-485 for 180 days, we can change our jobs. But rule is that the new job should be in the same field as the old one.

    Can i change my job from a biological researcher to a biostatistician? My current job is in the field of biology, which involves lots of experiments. If I change my job to a biostatistician, which is like a programmer, do i still qualify the "similar filed" rule? thanks for your help!

    Yes. I did check with me lawyer. She didn't receive yet.

    Ok. Try this:

    If you have created a login as customer in USCIS website at @ https://egov.uscis.gov/cris/jsps/index.jsp.

    As soon as you log in you can see the last updated date of your case.

    You may atleast know if something changed on your cases internally based on this LUD

    When I was trying to file in EB-2, this was the first question that I asked me lawyer -- No matter what, I do not want to get my pending EB-3 case to get in trouble. His answer was -- These two are going to be totally isolated cases. A person can have multiple pending green card applications. Heck, one can have one application in EB category and the second one in FB category. Having two cases together in EB category is fine and the outcome of EB-2 case at any stage would not effect EB-3 case at all. (Again, if USCIS finds that you are in some sort of fraud then it is all together a different case).

    What you should not do (coming from lawyer) is do not file two sets of I-485. That is going to screw up your case.

    Another suggestion that lawyer gave me and I did not follow is -- Let us say your EB-3 I-140 is pending and you and your wife have EAD and AP. When you start a new EB-2 process, during the I-140 stage, take CP route (Counselor Processing). This is best of both the worlds. You have EAD and AP from EB-3 petition and you are requesting for CP for your EB-2 application. As soon as your dates become current, you will be notified to go to your home country US embassy. Go there with family, get everything done and come back to the US with GC. If S*H*I*T happens there (Which is rate), come back with AP (derived from EB-3 application) and you are back to where you were. By doing this, you just eliminated two things -

    1. Interfile is a tricky process. If you could avoid it, avoid it.
    2. When dates become current, US embassy would surely look in your case. That process is far better than USCIS + I-485.

    Negative point of this route is - you need to make a trip to your home country on a short notice.

    Once again, good luck to you all. Just, do not do anything illegal to get GC. Do whatever is permissible under the law and do not even believe your lawyer. Do your own homework.

    Hi,

    I am joining new job using AC21 provision coming monday. My new employer does not provide medical insurance for the first month. I am eligible for after I complete 1 month.

    So my question is: till the time I get medical coverage from new employer (approx. 20 - 30 days), can I invoke COBRA? I heard that one can not invoke COBRA if he or she is employed (only meant for un-employement) is this true?

    Also, should I call my current insurance company for COBRA now, or I can wait if I really need to visit a doctor? is there a grace period for this? Because there is a possiblity that I may never would have to visit a doctor for next 20-30 days, but who knows!

    Appreciate your answers.

    As per my knowledge:
    You can take up to 60 days to submit COBRA forms.Apply for COBRA only when you used Doctors/Hospitals in these 20-30 days.If don't use doctors/hospitals in these 20-30 days you don't need insurance.You'll automatically get insurance from new company after 20-30 days.

    You're absolutely right. Ever since last year's H1-b lottery, I look at this country in a new light. I no longer see this U.S. as the world's greatest country, I suspect this is a civilization in decline. If I were to make a bet where this country will be in 50 years, I would bet it would lose it's position as a superpower and the most successful economy.

    This H-1b and GC mess to me is an indicator of how things are run in this country. With all these major problems: immigration, healthcare -- there's just an attempt to sweep problems quietly under the rug or apply band-aid fixes such as a lottery.

    Thousands of advanced degree holders are being kicked out of the country and a million people are stuck in a GC mess -- no one cares, it's no-one's business. The human being is like a tiny and replacable cog in the system.

    Of maybe ~500 highly influential people in Washington DC (congressmen + senators + president + DHS high officials) maybe 3-4 people are expressing outrage at the EB GC and H1B mess. Zoe Lofgren is one, maybe a few others. The rest think the system is just fine.

    Barack Obama spoke in the senate last July and said that the employment-based immigration system is working so well, we shouldn't make any changes!

    Sorry, seeing this week's H1B brings out the pessimist in me. Maybe there's hope for legal immigrants in the future, but only if we keep fighting.

    Sorry to hear the screw up. I had some what similar issue with H1B extension when attorney didn't timely file my application. USCIS approved H1B with no I-94 attached basically asking to leave country and get stamping in India.
    We then contacted Murthy firm who filed 'nunc-pro-tunk' petition saying it was a mistake by employer/attorney and I shouldn't be penalized. USCIS then issued new approval with I-94.
    I am not sure if this works for 485 but a competent attorney should be able to give a conclusive answer. Since you have the document you should try this and also change the attorney at the same time. You can also get a statement from old attorney about his mistake.

    I think this has a better chance than rest of other EB bills, because US wants more skilled persons and by defintion advanced degree holders from US in STEM are. Congress extended 20,000 H1 visa for US masters and PhD graduates some years ago whereas they were and are loathe to extend the total H1 numbers.
    Going by this logic, I think this bill will go farther and gain traction. Lets's keep our fingers crossed.:)

    In one stroke, this bill helps both a) US advanced degree graduates and b)non US graduates (i.e, EB applicants), as 1) it puts EB1 and EB2 in non quota category (I,C,P,M and ROW) and 2) frees up EB1 and EB2 numbers for EB3.

    my 2 cents.

    How many ever bills get introduced or hearings happen, there is the CHC which is blocking everything. Lets start a email/fax/phone campaign...

    Thanks. she is still working for the same employer who sponsored her H1. Now, she needs to continue maintaining relation and continue working working them.

    I am still worried though.. I read in this and other forums that USCIS may issue RFE asking for proof and if says medical leave, then asking for medical records etc.. So, better to prepare for some 'solid' answer with any loopholes by being honest. I do not think lying would help and may lead to more troubles.

    Don't know if this would be of any help to 3-year degree holders or not, but World Education Services (WES) has recently changed its policy- it now considers 'selected' Indian 3-year bachelor's degree as equivalent to a US bachelor's degree. WES is a very well-reputed evaluation company.

    If they don't want to publish the numbers, fine. If they don't want to process application, we can't do anything about it. But at least move the PD forward so more cases become eligible for approval and it makes USCIS's life easy to use all the numbers.

    Whats the use if they move PD forward by 2 years in July and then USCIS is super busy using all the numbers available. It would be better if DOS move PD forward every quarter if they see visa numbers are not utilitized.

    They should divide 140K total numbers by 12 (which is 11666) and watch each month how many numbers were used in last month. If 11666 numbers were not used last month then they should move PD for retrogressed country forward so more cases become eligible.

    This is not rocket science and I don't know why DOS don't understand it.

    Though I want to feel sorry for you I cannot. Between all the things you have written I was trying to find one small indication to know that you are sorry for what you have done. I did not find one. You are arrogant enough to blame the immigration laws for not permiting you to come to the US, but never really looked into your own flaws for flouting drug laws.

United States Citizens need an Immigrant Visas Waiver available to their Alien Immediate Relatives deported with a drug-related offence of more than 30 grams of Marijuana in order to even the scales on both U.S. citizen and Alien immigration privileges concerning Deported Aliens with a Drug-Related Offence of More than 30 Grams of Marijuana.

    The way things are now U.S. citizens without a criminal conviction and with Alien Immediate Relatives are being discriminated against by their own government. The needs of deported Aliens with criminal convictions are being placed before their own.

    It�s pure hypocrisy and it�s my family�s and my name being placed on the line.

    I mean, really, how great can the U.S. be if it�s willing to lose their citizens to aliens like me when they decide to move outside of the United States to join their Immediate and shunned Alien Relatives? The U.S. government�s violation of my family�s civil human rights to liberty, freedom of expression and equality before the law is unwarranted. My U.S. family�s civil liberties to equal protection under the law, to due process and privacy are being discriminated against, they are not receiving fair treatment.

    Dont lose hope. I am on H4 since 2000 too and been out of workforce ever since. I had 6 years of prior experience. Now, I have a job offer(non IT) and the company is planning to sponsor my H1 this April. Keep applying and something will work out.

    thats ok, no need of apologies. all i am asking you is to keep it to the point that you opened this thread for and discuss the options. We do not need to go into who is the guru here with so many number of postings etc..its totally irrelevant to this thread. again, when you open a thread with questions, please be prepared not to accept atleast expect different forms of opinions from different people. u have a nice evening too.
    Ok what i have heard after calling Lufthansa is because of the new Schezewan (I knmow i spelled it worng) visa changes AP is no longer considered a valid visa document by Germany. It used to before but no longer and of course France, England and other countres never did. So coming back to Germany yes while travelling to and fro you need a transit visa (Direction does not make any difference because as far as Germany is concerned you are from India and you have no Valid visa to America and/or any european country so you are suspect of trying to illegally enter Germany and to avioid it you need to buy transit visa).

    I myself was plannig for a trip and was trying for travle via Doha and Qatar where no transit visa is required. (Us to gluf direct flight. Gulf to any city in india) but the rates were high. If you like you can look at that opiton too. beats the hell out of going to teh german embassy and getting a transit visa. But if that is your preference go with it

    Start looking for another job. Get back to H1B and get your wife back on H4. there is nothing as important as personal life.

    If you need help in finding a new job mention your skills in this thread maybe someone can help you.
