My neighbor was asked to how many years he worked with the company who sponsored his green card. He mentioned he had worked for two years. This was when he was applying for citizenship.
Although there is no mention in law for a specific duration. As Pappu said, its a lawyer's interpretation. I have yet to see USCIS's interpretation, especially what is the criteria followed in the naturalization interview.

Even if i-140 is not approved one can still invoke ac21 (after fileing i485 and after 180 days) . But, your original employer has to answer if there is any i-140 rfe. And original employer can withdraw i-140 at any time until it get approved. So bottomline is, don't try to invoke ac21 until i-140 approved and your i485 is 180 days over.

I don�t think he will have any standing against you in court of law. If you have ur documentation strong then nothing to worry. He is just trying to give you hard time. Even if he does so take him to all levels, I am sure at the end of day you will not loose anything but he may get burned by this. File all claims like harrasment; Unethical practices to run business and more if attorney suggested doing so.Just be strong and cool ......

My Job duties on labor says
"Design, develop and test software using Java, C++, C, VB, Winrunner, SAP, Oracle, Networking, ASP and RUP"
The title in labor is "Software Engineer"
Now the new job offer has title as "Lead Developer"
and duties are
"The lead developer will be responsible for leading a team to creating components within Java, utilizing standard Integrated Development Environments (IDEs), writing unit test cases and supporting the Testing and Quality Assurance phases of the software development lifecycle."
Can somebody comment on this in context of same / similar job?

This does sound strange, do you know what was the reason for this officer's visit to your employer two months back? also, i would suggest make sure all your paper work is fine, I mean LCA etc. indicating your correct place of work and right wages.
first of all make sure it was a genuine call
call USCIS back and find out if there is a visit scheduled for your house
also be carefull, check all credentials of whoever wants to come to your house
economy is bad, recession is in ,the crime rate is going to get bad, especially against immigrants etc
ps also i would second the visit at your office place instead and if need be , in the presence of a lawyer

Immigration Voice member Dr. Murtaza Bahrainwala, who was also quoted in the New York times article today about the July Visa bulletin fiasco and the resulting fallout from it, will be on NBC nightly news with Brian Williams tonight around 5:30 Central time.
The interview also has snippets of interview with USCIS officer as Brian Williams has interviewed USCIS over this issue also. So its a "must watch" thing.
This will be on NBC and that's good coz you dont even need cable to watch this. In your local area, the NBC channel affiliate will be broadcasting the "Nightly news" with Brian Williams.
Local times may vary depending on your local NBC affiliate. Its most likely 5:30 Central time tonight but check your local listings.

If I remember correct in the NYT article, he has spent something like 11yrs waiting to just file the 485.
I hope, really hope that out of all this we can atleast get a visa recapture legislation. It can be considered as undoing the inefficiency of the USCIS over the years.

Can anyone tell what will be the status of a person who has used AC21 , and does not get the EAD renewal before the existing EAD expires ? Assume 140 has been approved, 180 days has been passed and got the EAD renewal receipt.

Urgency of getting a receipt is that once you get the receipt, it means that USCIS has 'accepted' your application and it will not be rejected for lack of initial evidence.

I think we need an IV movement to fix the Indian Consulates - They are absolutely pathetic - Lets get our house in order before we try to fix the USCIS !!! I: You are the first person to tell me in last 4 years that I cant do my job due to poor english.
[At this point I was ticked off]

I: 18 months
VO: How many employees in previous company?
I: 150
VO: How many Indians?
I: I dont know. Ask the employer.
VO: Is this company owned by Indians?
I: I dont ask my boss his citizenship status.
VO: Have you worked with them before?

Do this: Be happy with what you already have and expect (don�t worry) more good things in life. Just compare with somebody who doesn't even have food, clothes, shelter, health care, etc... in their lives.
You are VERY fortunate to make it to US and living a decent life than most of the Indians.
Cheer up....
Yup, i went back to my homecountry in February after 10 years away from home and trust me, our lives here are good. People back there will trade your place in a heartbeat. Just be glad that you are in the pipeline for a PR.
