    Unless there is a significant increase in Employment demand, it will be necessary to continue this rate of movement during the upcoming months. Such movement could be expanded to include other chargeability areas and preference categories.

    One consequence of rapid cut-off date advancement is the inevitable increase in demand for numbers as adjustment of status cases are brought to conclusion at CIS Offices. Such increased demand could have dramatic impact on the cut-off dates. Readers will be provided as much advance notice as possible should this occur.

    We might be looking at it the wrong way. The question is whether outsourcing is bad. Maybe thats not what the question should be. My view is that just like competition, outsourcing and globalization are facts of life. You can fight it, but it will not get you anywhere.

    If you think of globalization and realize that the whole world is a marketplace then wont the whole world be a competition for your job?

    When I think of outsourcing, I think of just another competition for your job. In some cases though when the entire department is being outsourced you are part of the herd. The same can be said for entire departments laid off.

    Be prepared to carry your H1B papers/EAD cards/I485 application papers and wait like a criminal while the cops check if you are legal or not after stopping you at the Phoenix Airport terminal, when you are waiting for your connecting flight, since your skin color was not white and you could be a potential illegal.

    Also, be prepared for this to happen to your kids even though they might be US citizens.

    Thank you - that is good to hear.

    We did a few this way based on the AIU (Assoc of Indian Universities) documenting that the CA = PGD. The professor showed that the PGD = MA. So far it has worked every time but we still feel the evidence is stronger pointing to CA=BA. Those have all been approved. However, we have done many more as equivalent to BA than MA.

    My EB2 was rejected initially but later approved due to Sheila's evalaution of my CA degree equivalent to master's degree. I did not know her but my lawyer insisted to get it done through her. She was good for me.

    .. and how exactly do you know that I didn't participate? did you just look in to your crystal ball and it magically gave you a list of people who didn't call their lawmaker? I may not have posted any update in that thread but I did call my 2 senators.

    If you think that I have to give you a daily update in writing on what I am doing everyday to support IV, you are up for a surprise because that isn't happening. Before you criticize others, at least think.

    By the way, you don't own IV or this forum so please don't act like everyone needs your permission before posting anything on this forum.

    All I am saying is that if there is a good reason to close a thread, just say so. Just give a one liner explanation and everyone is happy but I am not sure if that's too difficult for you understand.

    You did not even take part in the call the lawmakers drive. Likewise others complaining on this thread also do not have a single post in calling the lawmakers thread. You can happily do your predctions on your own websites, but on this websites you should allow people to seriously do focussed IV work.

    We have been model "future citizens" by paying all our taxes, abiding by civic laws and meticulously making sure that we never get out of our precarious H-1 B visa status. This is how we are rewarded. This isn't a "grand bargain" it is not even an "amnesty" as many anti-immigrants are labeling it, this is worse, it is a "travesty." Bravo US Senate, you just proved that playing by the rules is such an unAmerican trait. We learn that from your grand bargain. Better late than never. We know now what to do.

    On a different note. We could request these senators to introduce an amendment that will create a new category of visa called "H-2-Z" visa for people who give up on getting a green card based on employment based system but may find it easier to refile under Z visa category by becoming illegals.

    Yeah that sucks. I have a 2004 PD as well but was lucky to get out of PBEC in Jan 2007 and was able to apply for 485 in July.

    I feel for people like you who have older PDs (2001 to 2004) and missed the July-Aug window.

    It is unfair that some people with recent PDs (even 2007 PDs) got to apply for 485.

    Hope something works out for all old timers.

    Same situation here too. My husband came to this country in 1999. Filed for greencard in 2004. Labor was sent to philly BEC and it got cleared in September 2007 so we too missed the window too. Not sure what to do

    No, that is not true. It has nothing to do with lawyers or the HR people. I-485 is YOUR filing (not of your employer's HR). By sending this you merely want to draw attention about something which you believe or hope should happen, and unless immediate attention is drawn you might suffer a loss (in this case, visas may be used up by others simply because someone did not care about your case, or just took the case to process and then went on long holiday etc. Such thing can happen and do happen particularly when paper files have to be worked with). Best...

In this case, if they are using "annual limit" to mean the entire annual quota, then they are admitting that they have broken the law and issued too many visas in the first three quarters.     Well, they could be talking about a subset of the annual quota, such as the quarterly quota. From the context, I don't think that is the case, but I'm also not used to seeing the State Department flat out admit illegality, either.

    Well, if they do broke the law, can we do something about it? Like class action law suite???

    When your H1 is ready to be approved, just go back to Canada, get it stamped and enter US using your H1 visa (I-94 should have H-1 stamp)...Thats it, then you are all set...Even after entering on AP, you can continue to work on H-1 if you are still working for the same employer....No need to re-start/re-apply anything...Your EAD/AP will all be still valid but you will be in H-1 status...You can just keep renewing them...The only thing is when you get married and bring your spouse on H-4, you wont be able to file for her 485/EAD/AP till your PD is current again...

    Why do you say so? This has no relation with the current Feb.04, 2008 memo.

    The file is an old policy change where USCIS doesn't automatically consider an pending mandamus lawsuit in court as a reason to expedite. They started fighting these cases but have definitely expedited name checks after the policy change( in 02/2007) in response to court orders.

    What I can gather from this is that USCIS is going back on its original position of asking the FBI to expedite Name Check cases.

    Hello Gurus,


    This is my first post. I had filed 485/140 in Aug. 2007. 140 got approved this March 2008. I donot have pay stub for last 3 months. I am looking for change. My labor is a substituted one( PD 2004). It has skills mentioned of Oracle EBS. I am working on Java/J2EE. I am looking for a new Job with Java/J2EE skills. I am worried that my new offer letter with Java skills mentioned would create a problem for me.

    Please Gurus, can you advice me as to whether I can do that? Will staying on bench create a problem, as I donot get salary on bench.

    Please help me.
