    BUt keep in mind that when you enroll in a GROUP insurance which is typically your new insruance with you new company..most of the companies DONT have any restrictions on the pre existing condnitions, per my experience.

    however if you buy a individual pocliy they will unload on you a TON of restrictions...no wonder why we see many old people working in Walmart and other places just for insurance..God save us when we get old :)

    Yes, completely agree....PMP is akin to CCNA type of certifications and MBA is akin to a MS in Computer Networking. I will not go into details explaining the difference but just getting CCNA only helps you get a job, not advance in your career - where as a MS degree will always help in advancement. Ofcourse, there are exceptions and nothing is set in stone but that's the general rule of thumb.

    I am not sure why the 2 are being compared. One is a professional degree while the other is a certification. MBA prepares you (in theory) for several different jobs (marketing, finance, ops, general mgmt etc.) while PMP is primarily to "check the box" on program management. With all due respect to the PMPs (and other PM credentials) I havent seen any additional skills that PMP provides.

    Yes- I have an MBA and a PM certification and work with several IT PMs/techies but an not in IT myself.

    May be you are right....but, I feel that the whole thing is a broken promise. And I feel like I fell right in the trap set for people like us.

    Broken promise ?? I would say NO.

    Disappointed ..... definitely YES, having realised the follies of the "system" here. Search within yourself to find out how / why you came to this country first. Was it just a lure of the GC ? Most of us either came to study / work. We took it one step at a time, but GC was not the only or ultimate goal.

    I can speak for myself at least...

    I ve been paying all GC fees from the LC, company pays only H-1 fees.

    For I-485 total expenditure as follows:

    $1300- attorney fees
    $300- doc fees
    $200- other docs, vaccines, etc
    USCIA appln fees for me & spouse for 485 765 131 ....

    Lost hours at working for the medical and attorney appointments almost 24 hours * $40 = $816-

    Sleepless nights filing forms & submitting on time = priceless ....

    Looking at the movement of dates for EB3, esp India and China, it's hard to be optimistic of any changes. It's a very wretched position to be in for Indian and Chinese nationality, if they're in EB3. All those who are eligible to port will definitely try to port to EB2 as long as it's available and cut their waiting time. It might be risky and unpredictable, but it's a risk worth taking considering the endless torture in the form of a long wait and zero or little forward movement of dates.

    There've been times when I've felt like attempting porting, but am not sure of the reaction of my employer - a big "reputed" company. If they revoke the I-140 in retaliation for using AC-21, then no chance of porting and back to square one. So it's the seemingly endless wait for me just like all others suffering from 2001 onwards. If only I'd not hesitated to take a bold step back in 2003. Too late to lament about that though.

    It was very hard to see at least 3-4 of my friends working in very reputed, established companies, not some tinpot startups (I'm almost tempted to name the companies) using labor Sub. And all of them have got their green cards comfortably. Every single one of them.
    Their managers pushed for labors subs for them and nobody even objected because it was legal!

    And to my best knowledge, my current company didn't do any subs (perhaps because they didn't have layoffs during dot com bust) so I see senior employees in my company badly stuck with EB3. In fact, there are EB3 managers hopelessly stuck whose EB2 employees are in a better position than them. I'm NOT making this up.

    Unless you take risks, you won't progress. Calculate your risks and take it. My friend, 2003 is an old PD and you have been stuck for long. You deserve a better deal and a more senior job profile. I agree completely with folks though, that allowing people to retain the old PD is unfair to others waiting and USCIS should grant some intermediate PD. But take it from me, all kinds of unfair practices have been happening. A classic example is July 07.

    Is your NC cleared? If yes, shouldn't you have received your gc in early 2007 itself before July 07 messed up EB3?
    Even if its not cleared, you would have surely crossed 180-day barrier, yes?
    I'm not EB3 but if you can post updates in this thread related to your case, it would satisfy some of my curiosity.

    I don't know if my NC is cleared. Tried to find it couple of times calling over phone but always ran into unfriendly IO officers.

    Got out of BEC in dec 2006, I140 cleared in Jan 2007 but then my PD became current only in June 2007. And due to laziness of my law firm, my I-485 filing did not happen in June and got dragged into July 07 mess.

    I think if USCIS had initiated my Namecheck as per normal timeline (sometime around when my I-485 filed , i.e anywhere between July - Sep 2007), then yes, I think it crossed 180 days long time back.

    We think about outsourcing because it affects engineers the most. especially IT/software. Remember software is still a tool. What you do with the software is more important. The process of creating software is just like making any other tool (every problem is hard to solve only for the first time).

    Western countries started the industrial revolution (manufacturing/factories). Now China is leading in manufacturing. IT revolution, again was started in the west. In 20 years, it is possible that very few lines of original software is written in the US. Its not that US does not have smart people who cannot be trained as engineers but more like the smart people in US prefer other occupations as compared to engineering/software.

    I imagine the computer/internet revolution to be similar to the air travel revolution. Both made the world a smaller place. A few decades ago, being a pilot was a glamorous, high paying job. While pilots may still be reasonably paid, they are now perceived just like taxi drivers (with all due respect to both professions). What is to say how IT engineers are perceived as in a few decades from now. 13 years ago, a maths professor who taught us a class said "Before the computer was invented, we had a profession called typists; now they are called computer scientists".

    US education system : A few months ago, there was an article that debunked the myth that 'US education is falling behind other countries'. The US education system may be a little pressured (especially in places with more population - but certainly not falling behind other countries. Just count the number of colleges in the US.

    I am not just being brouhaha about the US. But just putting things in a different perspective.

    H1B, GC, legal immigration are just sub audible noise in the overall scheme of things. Yes. it affects us a great deal because we cannot live unfettered lives.

    On the other hand, India & China ( & Brazil/latin america & Russia) are starting to rise back (yes, each country had its own golden past - remember Columbus was trying to find a route to India when he discovered America. Marco Polo is still remembered for discovering the silk route to China....) These countries got left out of the renaissance, industrial revolution developments that gave western europe and north america an edge over the 3rd world countries.

    Growth in the above mentioned countries will result in increased demand for goods and services that will benefit the overall global economy.

    EB-3 india is not yet completely out of 245(i) mess. If you remember the last month's priority date was 22Apr 2001. Now in Jan priority date is 08May2001. 245(i) ended on Apr30th 2001. So this month's progress still includes 8 days of 245(i). I would imagine that more cases were filed from Apr 22 - Apr 30 as this was the last week. So its still a long way to go before EB3 is completely out of 245(i).

    But the nature of the job responsibilites are same but i believe the Job code may change b'cos of the Title.



    I believe it is not a problem, I have read in other threads. but I would suggest lot of attorneys are only taking 300 or 500 dollars to file aC21. it is worth spending.

    I prefectly agree with the fact that people are getting a bit overly impatient on the issues here , but I who has been patiently waiting and waiting and working with the state chapters just see a lull and silence on the immigration front ( Skilled and Unskilled ) . No one wants to talk about it or do anything about it on the Hill.Please prove me wrong here , I WANT TO BE WRONG !!!

    Arnab, I understand your point. I mean it. My old priority date was Sept. '02 and after being stuck in backlog for years, I finally decided to change my job, my new priority date is in 2006.

    Now, IV doesn't have control over the schedule followed by the US congress. Having said that, let me assure you that there is positive movement. If you look at recent posts by other members, you will see that momentum. That is the result of your efforts with DC rally and your contribution.

    This last quarter of 2007 is do or die for us. That is why we are asking members to join state chapters and preparing for our next big push. All this may not be what you would be hoping for but guess what, without your efforts we wouldn't have come so far. So have some more patience.

    Surprisingly today I got second LUD on AP. Content is changed as under.

    Receipt Number: LIN****
    Application Type: I131, APPLICATION FOR USCIS TRAVEL DOCUMENT

    Current Status: Document mailed to applicant.

    On November 7, 2007 we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service

    I received my AP on Nov 3 and looking at the AP doc it had an approval date of Oct 10 whereas I had "Document mailed to applicant" message on Oct 31.
    I am not sure what happened between Oct 10 and Oct 31st.

    Right on the money. These threads are all about free loaders (mostly) coming up with their ideas. Most of them will contribute a big 0 = ZERO to this community.

    As you see most of them are free members who have nothing to do with the immigration reform. They just keep browsing around the pages to see if there is any hope of getting GC any sooner and others are disguised Antis and marketing guys.

    So just don't get bothered by these members and their comments.
    The guys who are serious , have already proved themselves by becoming the donors and working sincerely towards the solution.

    Thanks for greaat posts, everyone. Just to follow up with Jaime's point it is tru that we are not all from India or Aisia in general. I guess I should have mentioned that. I am from a northern place - from Russia. Actually I was born and raised in one of the southern former Soviet republics, which had relatively warmer climate. But I lived for over 5 years in Russia before coming here. I just mention that, because I read it the cold Canadian weather seems to be the number one downside. It is not such a big deal to me or my wife, because it was as cold or perhaps even colder back home.

    Just as Jaime I am not here just for ecenomic reasons. I wuld be better off (financially) back home. I guess we are in search of better life (qualitatively), and that is why I am wondering about Canada.
    And perhaps due to somewhat European backgraund I seem to have nostalgia for European flare sometimes; hence the questions about Montreal (which I presume is a bit more European that TO).
    I guess I would like to put a streignt question to those who lived in or familiar with Canada.
    - I am from a Northen Country (even leave in Northeast here in US).
    - I worked full time for 5 years in US (plus a year of internship)
    - My field is Not IT though, it is in business (data analysis, finance, supply chains, etc)
    - My in English is quite good (for and immigrant especially)
    - I have some basic knowledge of French and willing to learn more
    - I have a Masters degree (few actually) from US universities
    - As I mentioned I have a family including kids.

    My question is - what do you think my chances are in Canada in general, and in Montreal specifically?

    I would appreciate any response. Thank you very much!


    Go for it! My earlier comments would be mostly applicable to folks from the sub-continent - which you seem to be not and looking at your priorities and what you already have, might work out perfectly for you. Best wishes.

    bcos I was there stuck at BEC with no result in sight for 4 years.

    My advice would be to file for another LC through PERM ( I know its hassle) & file it in the EB2 category if you are eligible (even if your company might not sponsor the 2nd labor, you should probably foot the bill). This way, you can retain your old priority date & file in EB2 sooner. Or maybe wait & watch how the cutoff dates progress ( I think EB3 will surely move to 2003 soon (early/spring 2008) for India.

    I know that its not easy looking at all the threads talking about starting company using EAD, buying homes, recpt. number, AC21 etc. when you missed the boat to file I-485. But hang in there. When one door closes, another one opens.

    I wanted to find about pre approved or pre adjudicated case, We have been hearing the same more often in the forum, so out of curiosity i opened a Service Request.

    I kind of have a good relation ship with the former employer, worked with them for 4 years. I just called my company HR and he said he does not know my name is on withdrawn list but he will check the list and let me know tomorrow.

    Take an infopass appt ASAP.

    The officer in the local USCIS office will be able to give more details about your case.
