The DREAM Act could come up for a cloture vote as early as this week, but faces tough opposition from Republicans -- including a few who, like McCain, previously supported the bill.
Some will likely vote against the DREAM Act citing timing. Senate Majority Leader Harry Reid (D-Nev.) plans to bring up the bill for a cloture vote as early as Wednesday, but all 42 Republican senators have said they would filibuster any bills not related to tax cuts.
As the Senate struggles to come to agreement on the tax cuts and other issues, the DREAM Act could lose its few Republican supporters. Sen. Richard Lugar (R-Ind.), a co-sponsor of the DREAM Act, would vote against the bill if it came up this week, spokesman Mark Helmke said.
"You have to handle the spending bills, tax legislation and START first," Helmke said. "If we get those three things, he's willing to stay in and take up the DREAM Act."

Ah. It doesn't end even if you get the GC! I agree with the others - go for the interview fully prepared with all the documents including your GC. Even though you have the feeling "what if they revoke it?", it is best to comply with the laws and respect the interview notice.

My wife's and mine EAD renewal was applied on the 23rd of July (company lawyer delayed filing). I received mine in 30 days but my wife's case is still pending, though I am working on my H1 and don't need it. My wife's current EAD expires today, is there anything we can do to get the process to move faster or get her case expediated other than just wait till 90 days. There are lots of people I know who received their EADs even though their applications were sent much later. If the discontinuity is long, my wife may loose her job.

My in-laws came to visit us on vistor visa(B1/B2) .
They got 6 month of stay in their I-94.
My father-in-law left US 2 day's before I -94 expiry but with my mother-in-law's I-94. Before he left I applied for the extension of stay(I539) for my Mother-in-law.
Her I-539 got denied stating the person has already left.
Now in my mother-in-law's passport we have my father-in-law's I-94. So actually at the port of entry the officer switched the I-94's.
Now the question is now how to handle the denial of extension for mother-in-law and get new I-94? and what to do with father-in-law's I-94.

She could join from the day when the papers for transfer was mailed, this is as per AC21 law. She does not need to wait to receive the receipt from USCIS.

according to latest may 15th update, 140 processing dates have not moved at all ...Is there anything we can do at all to push for premium processing or is it a lost cause??

The substitute elimination rule is still under review and not in effect yet. The premium processing can be done with substitute labor, by attaching the original labor certification.

I am currently on H4 and it expires in a couple of months. I have my H1 approved for 2008 quota. My husband's H1 expires on sept 2007. we are applying for I-485 next month. Do i need to apply I-765 and I-131 because as per the instructions from my attorney it says the following:
-I-765 or EAD card. If you have valid H-1B valid more than one year and will not change job, you do not need EAD.
-i-131 or Advance Parole. If you have valid H-1 or H-4 visa stamping valid more than one year of if you are Canadian citizen, you do not need AP
Please clarify me whether I-765 and I-131 is required for our case.

My wife has FP appointment scheduled for 12/29/07, She is in india now. I have returned from india today only(12/28) and saw the FP appointment. Can i reschedule FP one day before the appointment date? If i send the reschedule request today will USCIS accept it? since there is only one day left. Please advice me.

I have sent in my I-140 + 485.. SO i hope that they accept the 140s atleast... I hope they dont outright refuse the boxes... Atleast I haven't seen anythin about refusal on UPS website yet ..
Just read that if you have sent one check for 1-140 & 485 then the whole package will be returned and you would have to refile your I140. If you have sent separate checks then they will just return the I485 part of your package.

Thanks so much for your help. I had a question for my friend. He is on H1B status with wife on H4 status. Both expiring Sept 30 2008 (First three years). They applied for regular extension in July 2008 (for both his H1B extension and her H4 extension). Application is pending. Question is will her H4 status be affected if she leaves the country before approval of her extension? Lets say she leaves the country in October 2008 before their extension is approved would that cause any problems? She would plan to come back mainly once his extension is approved as she would need to take his approval in any case to Mumbai Consulate for H4 stamping. But the question is would her leaving the country cause any problems? and can she just use his approval once it comes to get her H4 visa stamped and then come back? Or do they have to go for premium processing for their current apps to avoid any issues? Thank you so much.

I am trying to get a green card for the US. My parents are from east asia and I was born in Canada. I went to University in Maryland from 1992-96 and obtained my dental license. I am licensed in the US and intend to purchase a dental office soon. I will still be keeping my dental office in Canada for at least 1 year once I am able to work in the US. I heard about a investment visa however I am not investing more than $400k but it will employ at least 4 US nationals(ctizens). Can I still use the investment visa or can I get a visa for opening a secondary dental office in the US and still keep my existing office in Canada until I qualify for a green card. My case was file in jan 02. I have approved labour and I-140. I filed my I-485 in Jun 2005 and have an EAD and parole. How do I find when can I file my spouse's case.

I have stamped from Canada 3 times before. without any issue.
I do not know the situation today. If you have all the required documents ready
and You attorney has sent a copy of your H1 extension to PIMS office at Kentucky
(For all extension petition this is required) You can stamp at Canadian US consulate
without much issues. If PIMS is not updated then you have to be ready to stay at Canada
for 1 to 3 months. so be careful before taking decisions, especially nowadays.This is my understanding.
Same thing at Indian consulates. I
f the rules have changed Please enlighten me the folks who knows about it.
