Hi all,
I am getting a new job offer and i applied my GC this July just like most of us here. Is it possible to accept the offer and transfer the H1B visa, then try and negotiate to start later as soon as 180 days are completed?
What happens if i transfer my H1 now ... less than 180 days..and do not start with the new company, will my 485 still be processed? Lets say the H1 is transferred, but i plan not to use that H1 and stick to the same company where my H1 is, will that still be ok?
I am confused, its a good offer, and i dont know what to do. pls help..
An H1 transfer is not really a transfer. Just that you'll get another employer who is willing to and who can legally hire you. It does not mean you HAVE TO work for the new employer.
All the options you discussed here are safe for you.
1) Get H1 'transferred' now and join the new employer after 6 months are over
2) Get H1 'transferred' now and don't join the new employer.
Just make sure your new job description is similar to your LC job description and it has been 180 days since you filed your I-485.. Chill

Dear Friends,
My employer got an RFE in regards my recent filing of H1b.
The RFE talks about the office space.
Currently my employer has 3 employees and the available space is for 3 people. One of them is an Account Manager and basically the Manager has adopted the HOT DESK philosophy; so, basically the current work space is ok to accommodate me.
Can you please help to answer this request?

Note - This has been posted in the regular forum also. Re-posting it here to get an attorney perspective.
I just wanted to throw this out there, since I did not get any definite answer from any forums.
When in need for I-485 issues, who is better to contact - Congressman or Senator.
I just want to know the pros and cons of each and maybe this analysis will help others down the line.
Points to note are:
1. There are more congressman in a particular state than senators. There are only 2 senators in a state.
2. Senators are more powerful than congressman (not sure that this power applies for talking to USCIS or not)
3. Senators and congressman have different terms in office. Hence is it better to contact someone who is going to stay longer, or someone who is up for election soon and hence may help.
4. For a particular USCIS case, can we contact both congressman and senator at the same time. Is this good.
Can members throw some light on this based on their prior experience and based on their knowledge.

Hi,
At present I am on H4 but my H4 expired in December2006. But I have I-94 valid till 2009. My husband also got extension till April2009. Now I want to apply for H1 in April2007. I want to know whether this will affect my H1 approval? Do I need to have stamped H4 which is valid till 2009 before filing fresh H1?
I need this as soon as possible.

I just received EADs for me and my spouse and the validity is only 1 year! Aren't we (people whose PDs are retrogressed) supposed to receive EADs with 2 years validity?
Did you filed 140 & 485 concurrently?? this is also one of the uscis check that you shouldn't filed be concurrently...

On May 5, 2008 I got a message through my employer that they received an EAC receipt number from USCIS.While checking online we received a message
Application Type: I129, PETITION FOR A NONIMMIGRANT WORKER
Current Status: Case Rejected because of Incorrect Fee
On May 5, 2008, we determined that this I129 PETITION FOR A NONIMMIGRANT WORKER was not properly filed because you submitted incorrect fee. Therefore, we have rejected your case and returned it to you with all supporting materials, along with the fee. Please follow the instructions on the notice to submit the case with correct fee."
The online notice specifies that "Please follow the instructions on the notice to submit the case with correct fee". Unfortunately, we did not receive the notice till June 5, 2008. I called USCIS and requested them for the papers, they reassured me to have the communication sent to their Vermont office and that I have to wait for another 45 days. Today morning 26th June, 2008 my employer received a notice from USCIS saying that the H1-B petition has been rejected because it was not randomly selected for processing.
I am confused how can I get a receipt number without getting randomly selected? what can I do in this regard please help me!

Hi,
I need some clarification regarding my case,
--> Got H1b approved for Employer A in 2008, during stamping received 221G.
--> Submitted documents in 2009 and got stamping done in May 2009.
--> Now Employer B has applied for fresh H1B 2010.
My questions are,
When my petition is approved and having the petition in my hand, do i need to get the visa stamping before travelling for Employer B?:mad:
Will my visa stamp for Employer B only have the starting date to be from October 2011?:mad:
Is there any remote possibility that i can travel for my Employer B at any time earlier to October 2011?:mad:

I need help. I had filed 2 I-485 applications. I was thinking that my first application would be rejected due to the incorrect filing fee that I sent but they accepted and I already have a receipt number and fingerprinting appointment next week. The 1st receipt # was issued from the TX Service Center. Today I got the 2nd receipt # from Nebraska. I don't know what I should do? Should I contact the USCIS and withdraw the one in Nebraska. The problem was that I sent two applications because I thought they were going to reject my first one because I sent a $1010 check instead of the $395. Now they both cashed my checks. I doesn't really matter to me but my concern now is since I already have a fingerprinting appointment next week. What should I do? Will they reject both of my applications?

Although there are probably wrinkles I have not yet read in the treaty, this essentially puts the CNMI on the same footing as Puerto Rico. Here's the cute part:
Because the CNMI will become part of the "United States" as defined by �101(a)(38) of the INA, "residence or presence in the CNMI before 28 November 2009 shall NOT be considered residence or physical presence within the USA for INA purposes. Thus, on 29 November 2009, all persons physically present in the CNMI are considered "to be present in the United States without inspection, by operation of law."
Will these PWIs (present without inspection) be eligible to adjust status? Unclear? Are they working "abroad" for purposes of L visas? Yes, as it turns out. One thing is clear: Legal Permanent Residents (so-called "green" card holders) who wish to base a naturalization application based on physical presence in the CNMI will NOT be able to do so for pre-29 November 2009 periods of time. the fact that you move using AC21 and use EAD for work nullifies your H1 immediately and the dependents lose H4. even the date on I-94 becomes meaningless.
you will have to renew your EAD for work and AP for travel.
The fact that your I-485 is pending is all that is needed to keep you legal. But if for any reason I-485 is denied you will be out-of-status.

NIW 140 approved last year. EB1a 140 RFE/485 pending. Can I file a new 485 for NIW? or do I have to withdraw the pending 485 before filing the new 485?

When applied correctly, it is more effective than PD recapturing and labor substitution. That's how I got my green.
