The staffer asked me where I am calling from. Then said you are not a constituent of the congressman and was not willing to transfer to the person who handles immigration issues. I insisted on leaving a message and he took the message, but was surprised, did anybody else encounter this? How do we handle this if it happens with other congressmen?

Same here. My labor was filed on July 07 and Audit reply was sent in August 07. Attorney has contacted DOL twice and got same standard reply. Mine was filed at Chicago though.
I have no idea why Chicago is taking this long for my labor. All of my friends who filed at Chicago after me got theirs certified. I am the only one stuck.
I think denying labor is better than keeping it stuck for almost 1 year in audit.

I was running free ads for IV on all my sites (and am still running them on iBookDB) and if you look through my past posts you will see that I was encouraging everyone to do the same. But now I want to contribute money but I don't know what I am contributing towards.

I guess, it is the 13th ....such an unlucky number.:eek:.Just kidding..When all of us are so anxious about this..I can't even begin to imagine what our EB-3 friends are going through. Especially to whose who have been waiting for almost a decade (or more) and still stuck..

I didn't think that EB3 ROW will be "Current" in June. What I meant was that Illusion's PD will be current because he is only 3 months away from May cut off dates.
This is the selfish part of me speaking but I hope they don't become current but move to April 2008 or something similar.
If EB3 ROW is current then that opens up the numbers to EB3 India and China and we saw last year that India alone got 17K approvals so that cuts from the number of ROW approvals.
Again ... it's the selfish part of me ... in a perfect world, nobody would have to wait this long or make these claculations ...
I'm happy for all the people that get that "card ordered" email but I so hope to get one for myself!!!!

Alright guys, I cannot tell you how excited I am to report that i got a call this morning from my attorney and my online case status also states that Card Production was ordered for my case!!!
After 8 long years.....i finally have been approved for permanent residency. After 7 years, i will finally, with peace of mind, go back to India to visit my family. Thanks to IV, everyone's help on these forums for helping me keep my sanity over the past 2 years....
After 15 years in the US, I will finally have my green card in hand soon.

No. It was changed in the middle of 2008. The DOS consulted with the Congress on this and came to the conclusion that there should be horizontal spillover before vertical. I don't want to go into whether this was right or wrong, fair or not. This is the current policy.
You can see ample evidence in the annual visa allocation once you compare 2005/2006/2007/2008 allocations. EB3-ROW and EB3-ICMP benefited till 2007 because of vertical spillover and EB2-I & EB2-C have been the beneficiaries of the horizontal spillover policy since 2008.
It is not the policy of DOS or USCIS to follow horizontal or vertical spill over. It is law. Both federal agencies (DOS and USCIS) has to obey the law by strictly following what INA section 201, 202 and 203 says, irrespective of how the law is unfair to any catagory. The law is very clear about spillover; it is horizontal. One has to read word by word in the law book to understand how the allocation of EB visas are made.
If DOS properly followed the INA as amended by AC21 act in 2000, EB2-I never retrogressed since year 2005. EB2 I might have been always “current”. EB3 including ROW might have been much worst situation than now. EB3-IN would have beeen (always) be in disaster state since 2001. Though it is unfair to (EB3) many, this is what the law. Here is the historical events what happened in EB catagories.
In later part of 1990s EB categories were retrogressed for IN, CH by about 2 years. When AC21 law passed in 2000, it did two very important things. One recapture of about 216,000 EB visas and it removed country quota in each EB category if excess visas available, in that category. That means it enforced horizontal spill over. In simple example, consider Mexico which is most subscribing country. Lets assume in a fiscal year, 40,000 Mexican are eligible for EB2 visa(and no other citizens in EB2), and millions of Mexican eligible for EB3 and in family based categories, still DOS should issue 40,000 (100% not 7%) EB2 visa to Mexicans irrespective of how much demand in other categories. Because of tons of backlogs in 485 (between 2000 and 2004), particularly in EB3, DOS issued about 185000 (out of 216000) to EB3. That’s why EB3 was current between 2000 and 2004. They simply ignored the EB2 demand by India and retrogressed in 2005, though total demand for EB2 less than the available pool of recaptured visas. Since the year 2007, they realized the mistake and now (since 2007) they are following correctly (though may not fair to EB3) the law. To all gurus here, does this mean that we can expect date forward movement in OCT bulletin?
Mine is EB2 India Apr 2008. Any chance for me to file i-485?

My child will turn 21 march 2009, currently on EAD from the I485 filling in July 07, I140 approved in July 07, PD is Feb 07. I have not received any letter from USCIS about the immigration age of child being locked in at filling. Where does my child stand now?.

I thought visa numbers are available equally per quarter and DOS is prevented from releasing numbers early. How can they say that all the visa numbers have been used (or will be used by April end)?

Q2: Jan-Mar
Q3: Apr-Jun
Q4: Jul-Sep
I think July visa bulletin would bring some good news when numbers for the last quarter along with the spill-over (if any), are released. If USICS is not as efficient we may even see some good advancement. Don't loose hope guys!!

I filed on March 26th in TSC (paper filing). Got receipt dated April 7th. Still waiting. I cannot continue the job as my H1B expired. Anybody knows what should I do to get it expedited. I guess people at USCIS are very unpredictable and work according to the mood. I did not anticipate this as earlier I filed EAD for my wife and son and I got it in three weeks.
There is a fax number you can send a letter to expedite your EAD case. You need to mention that you are not able to work and will face extreme financial hardship if you do not recieve your EAD in time. we had sent a fax for our renewal last time and it worked.

Received our approval notices in the mail today. Infact, our immigration attorney received them first. No emails, no SMS, no SRs. Online status still shows "Initial Review".
Its been almost 10 years to the date. I wish all my friends on IV good luck and hang in there.
Along the journey, IV has provided a lot of help & support and I will certainly be sticking around to help in whatever way I can.
