Hello

My wife and I will be Canadian Permanent Residents in a few months. I am on EAD with I485 pending and have AP. She is on H1B

We will need to Travel to Canada for Immigrant Landing formalities after we get PR.

How can we enter back in US so that my AOS and her H1B Status is not affected?

Hi GURU's,

I received my original I 485 receipt on which my receipt date is - July 10 2007 and Notice Date is - Sep 12 2007 from CSC(even though I applied to NSC)

After one week I have received Transfer Notice from CSC on which receipt date is - Sep 12 2007 and Notice Date is- Sep 17 2007 saying that my case is transferred to NSC

Now I am confused,

Which one should I consider as actual I 485 receipt date
July 10th (Original Receipt Receive Date) or Sep 12th (Transfer Notice Receive Date)

Please somebody help me, As I planning to use AC21 on Jan 10 2008, Thanks in Advance...

Can spouse leave to home country after filing concurrent i140 and 485 application?

Her and mine application (concurrent 140 and 485) was filed on July 2nd, 2007but I have not received RECEIPT # yet. Can my spouse leave USA or we have to have get Receipt # first ?

Now the PERM takes 2years... whats the difference for new guys? My friend stuck in labour for almost 15 months now. got RFE, replied to it and stood stand still..

But this helps for someone who filed during July'07 fiasco and waiting though. I got mine approved in late feb'09 (filed in July 07).

Something is better than nothing.... :-)

My H1b was approved in feb 2010 for location A.Before I could start working at location A,my company found a better client (close to home,better pay) at location B .(different state).
what should my company do or have done with regards to lca for me to work at location b.
should lca have been approved before I moved to location b or could it be filed after i started working at location b. If lca was filed after I started working, is that ok.If not, how do we correct this.

i have a valid H1 visa on my passport till 14th dec 2007. yesterday i got the new I-797 with I-94(I-94 dates are mentioned as 15th Dec 2007 to 14th Dec 2010). Since my visa is expiring on 14th Dec 2007, I want to go for stamping before Dec 2007 to Nogales (i have some travel plans in Jan 2008). When can i go for(how soon) stamping. I am planning to go this sept. CAn I ?????

I am going to file application for renewal of EAD of my spouse.She was on H-4 when she came to USA and she got EAD last year. She will start working from Aug 08. She has not used her EAD till now but went to India on AP.

1.What is manner of last entry and the current immigration status for her? Is it Parolee or H4 status in both cases?
2.I have filed I-485 after July 2007. Can I E-file? As I read somewhere on forum that On or after July 30, 2007, applications may not be electronically filed and must be submitted to a Service Center via regular mail or courier service.

Though I am not an attorney, I would recommend removing the word "revoke" from the letter. Some less knowledgeable IO can read "revoke" along with "I-485" and do something disastrous.

Technically, you can do that. But it's better for you to transer your case to consular processing if you are not planning to be in the US for a couple years.


I forget to mention that it is for my wife. she is my dependent with EAD and AP. i know if she have green card she have to stay 6 months in usa. it that applies to EAD and AP also.

a_yaja is 100% right. Is is upto port of entry(POE) officer to decide I-94 expiry date. Usually that will be 3 months to 6 months longer from the POE date.

swft3d max is only a plugin for 3d studio max to allow import export between the two. you need the trial full version unless you have 3d studio max.
