Mine got approved exactly 2 months and a week. The lawyer sent me a copy of I-140 that was sent to USCIS and that covered my Labor certification also.

Hello,
I have a H1B visa stamped on my passport for Company A. This visa is valid till Nov 2008 and will need renewal after that.
I recently changed my company from Company A to Company B. They have filed for my H1B transfer.
Question 1] Will this new H1B for Company B be valid for 3 more years (Till Feb 2011) or will this visa have to be renewed in November 2008 (remember by visa stamp for Company A is valid till Nov 2008)?
Question 2] What if I want to travel to India this October (remember by visa stamp for Company A is valid till Nov 2008)?? Can I still travel on my old visa stamp or will I need to go to embassy again in India for a new stamp

Pineapple, although I dont have a solution to your problem I can definitely say that something is better than nothing. The senate dont have a problem with legal immigration, as long it is legal. If we can get our EB provisions as a part of this bill, most of them will be happy. There will quirks that can apply to immigrants as well, but that has to be addresed by the part of overall nature of the bill.

As as long as your job title says software engineer and your job description is close enough, you should be fine. Junior .. senior doesn't matter and they are pretty common.

I sent my documents for I485 on May 4th. Fedex web site shows that the documents were received by the service center on May 5th. But so far, my checks were not deposited or I haven't received the official receipt. How long does it take usually for USCIS to deposit checks? If I don't get the receipts for another week, what do I do?

I think you are fine - if it happened more than 5 years ago, and you have completed your sentence and it wasn't a crime of moral turpitude - you should have no issues. BUT be prepared to tell the USCIS interviewer everything AND take along all the court papers etc showing you have completed your sentence - to be on the safe side.

Hello,
My wife is currently on H4 status. (Just the I-94, her visa expired last year October). She started her MS in Fall 2009. She already competed 2 Semesters of MS on H4 visa. We applied for her Change of Status to F1 visa in March. According to the USCIS processing dates, she will get the COS approved approximately in June 1st week.
She will have to travel to India this summer. The question we have is,
is it advisable to wait till she gets her F1 COS Approved and then go to India for F1 Stamping ?
or abandon the F1 COS and go for F1 stamping directly in India ?
Please advice if there are any risks involved here.
It is the same either way. Once she goes out, she would need a visa stamp to get back in. And the consulate will do whatever they needs/wants to do for approving (or not approving) the visa petition regardless of whether or not she was in F1 status before leaving US.

I would like know if any of the IV members whose I-140 applications were transfered to VSC for receipting has been approved. If those IV members have received any kind of communication from VSC regarding processing of I-140 please post the details for benefit of other members. My case should have been processed at TSC, but was sent to VSC for receipting and has been stuck there for quite some time. It appears that VSC has stopped processing I-140's as of April 2006 and have not processed any applications since then. I would sincerely appreciate if members with I-140 at VSC to please post any updates they may have received. Any idea when I-140 PP will be reinstated?

There is no need to withdraw your 485. But why do you need 2 485's. It just shuts out visas for others. You can continue on H1b with your current employer and join in EAD with the other.

I thought they changed their mindset from having no movement most of the year then jumping ahead several years in the last quarter and playing catch up.. this is what got them the 07 fiasco

I came to US on F1 and am currently working on H1-B (never got H1 stamping) and I got married here in US. I applied for 485 as dependant with my spouse and I got my EAD/AP. 3. Is there a minimum time limit after joining aftre which only I can apply for extension..? No such limit...I feel it is good to have some pay stubs
