    Sorry you answer is not clear to me. You mean I was out of status and I will have problem at 485 stage?

    Suppose I have an approved I-140 in EB3, and I ask my employer to port to EB2, and the EB2 i-140 gets denied. Does it result in losing my PD?

    AFAIK, you do not lose your PD.

    My friend, I am sorry to hear about this. Your employer must be an A** hole.

    I - 485 is your application. Employer has control of your application until I - 140. All you need from employer is employment verification letter.

    If you have a good lawyer, then you can do it together. Take legal advice. This is just my opinion.

    Hello All,
    I suggested this in my last two posts and I am suggesting this again. Emails , faxes to Rep will not create visibility of the problem. What we need to do is, do something big, like a DC rally again. One of the benefits behind doing this will be, everyone in this country i has their eyes on DC for presidential elections. Hence more visibility for us.


    Secondly the topic of these three bills is hot, if we don't do anything now, it will turn cold, and then will be forgotten.


    What we really need is a huge volume of high skilled workers in DC, not just a handful. Please let us all get together in DC again and push for these bills. We will get a lot of visibility. How about sending flowers to congress members?


    Please let us all act on it!!

    My manager surprised me today saying that I was promoted yesterday from a programmer analyst to a systems analyst. I have an approved i-140 and have filed my 485. My priority date for EB3 is current. I also have a 3 year extension of H1B.

    There is no change in the job responsibilities.

    Question:

    1. How soon should I file my AC21 request?
    2. What is the impact of this promotion on my H1B?
    3. I have waited for 7 years and I may be close to getting my Green Card. How does the AC 21 impact my pending 485?

    I declined my promotion. My manager said that it would take a lot of effort to unwind this promotion. He was not pleased with my request.

    Any ideas?

    since your duties are the same I would think there was no issue in accepting this promotion. Even teh DOL job codes page mentions that those two titles apply to similar jobs: http://online.onetcenter.org/link/summary/15-1051.00.
    you my want to undo the rejection, and go ahead and accept the promotion... confirm with your immigraiton attorney.
    Does your immigration attorney say that your H1 needs to be updated with a revised LCA?

    Pineapple .. you hit the nail right on the head. It is a misconception that everything is cool in India. There are a lot more problems than just your salary. Money is not everything . I think standard of living and less corruption , cleanliness and less crowd do count towards life.
    i know i end up getting red dots for speaking up my mind - but i dont seem to learn!

    outsourcing is a phenomenon that will slowly expand in scope beyond low-end IT jobs - but the larger issue is that overall economic activity, which was concentrated in a few cities around the world - like NYC, London, Singapore, Tokyo etc., is getting geographically distributed - today more cities/ countries have world class higher education schools, stock exchanges, hospitals, manufacturing companies, banks than ever before...as a result - starting with tier II and tier III cities and eventually NYC, Chicago etc -the pride of place held by many US cities is now going over to places like Mumbai, Jo'berg, East European cities, Brazil, Chinese cities etc......companies are choosing to list their stocks at hitherto unknown exchanges, people are travelling to India and Thailand to get medical treatment done and so on

    obviously jobs of all kinds - not just IT jobs - move alongwith the shift in economic activity - and this is not just about saving labor costs - but about overall balancing of demand and supply for land, labor, capital and entrepreneurship.

    So, those who have high skill adaptability, geographical mobility and a strong network of professional peers are likely to continue to succeed in this game...having a GC or not would become irrelevant sooner than we probably think..

    A personal comment for hpandey - not sure where you live in US- but i cant imagine how living in 300sqft lofts in NYC or shabby NJ suburbs (for many of us) and doing all grocery/ laundry/ housekeeping/ NYC type commute on your own can be any worse than living in delhi or mumbai or bangalore with driver, domestic helps etc. :-)

    You can bring UP TO 4 spouses on H4 visa. That's why it is called H4. Similarly on F2, you can only bring 2 spouses, Ah...students do not make that kind of money to support more than 2 spouses. USCIS thinks so much about us.

    Xenophobia (fear of foreigners) has always been high in the US, though not always on the surface. Most probably we remind them of their own history of invading the native american's land, killing him and occupying his land.

    Back in the 1850s, Ireland went through the great potato famine which killed millions. A number of survivors migrated to the US where they met with hostility from local Americans who were scared these foreigners would take away their jobs. This has been going on since 150 years and is not a recent development.

    In 1997, unemployment in the US was zero and so no American felt threatened by foreign presence. The sun was shining, the birds were chirping and everything was hunky-dory for new immigrants. However, the situation is considerbly different today with increased outsourcing and brown desis seen everywhere in the US - especially in walmarts.

    With all this, it is inevitable that an immigration reform that will put an end to all our woes is not going to happen. However, we can try our best and hopefully expect at least some reprieve in the forthcoming revamp. If not, then we have Bangalore, Hyderabad and Noida where we do not have to spend an average of 2 hours everyday brooding over immigration issues.

    Washington - Colorado's Rep. Tom Tancredo and 70 other U.S. representatives sent a letter today to a Senate committee, warning that legislation it's considering allowing illegal immigrants to work legally in the country will hit a roadblock if it comes back to the House.

    The Senate's Judiciary Committee for the last two weeks has been debating an immigration reform bill that includes what's being called a “guest worker” program, something President Bush said he wants.

    “We are concerned that some of these proposals are fundamentally incompatible with the desire of the American public for real immigration reform and their clear opposition to reform proposals that amount to little more than thinly disguised attempts to provide amnesty," the House members said in the letter.

    “If the Senate were to pass such a proposal, we believe it would doom any chance of a real reform bill reaching the president's desk this year.

    Tancredo, R-Littleton, and the other 70 lawmakers were part of a group that led the passage of a bill in the House that imposes new border security measures, including increasing penalties for being in the country illegally.
    The House bill does not include a guest-worker provision. The group considers allowing illegal immigrants to stay in the country legally a form of amnesty.

    “Rewarding persons who have broken the law with an advantage that they would not otherwise have had encourages more illegal behavior and is unjust to immigrants who came to the U.S. legally,'' the letter says.

    Reps. Bob Beauprez, R-Arvada, and Joel Hefley, R-Colorado Springs, are among those who signed the letter.

    The Senate Judiciary Committee is not expected to finish work on the bill this week, which was the deadline given by Senate Majority Leader Bill Frist. He is expected to introduce his own bill possibly today that includes border security measures and does not have a guest worker provision.

    I agree with you. It's not required by law to file any AC21 papers so the USCIS cannot do much. Also, the green card cannot be revoked after 5 years so by the time you apply for citizenship, the USCIS cannot do anything bad to you. Worst case, they will ask about it during the citizenship interview so it's a good idea to keep your employment offer handy. But it's very unlikely and I really doubt they can deny your citizenship based on this. That's why I see no drawbacks in not filing AC21 and no benefits in filing it if you know that I-140 won't be withdrawn. My advice would be to take an employment letter from current employer and keep it in case the USCIS asks for it. There is no need to cause troubles for yourself by letting the USCIS know about it.

    Thanks for explaining this clearly. 2 Questions:

    1. If you use EAD and don't file AC21 and assume your I140 is revoked and USCIS wrongly denies I485 based on the I140 revocation, will you be on legal status while you fight the USCIS ?

    2. If you do file for AC21 and switch jobs, if you happen to change jobs again, do you have to file for AC21 again? Does this need to happen everytime one switches jobs?

    i am starting to wonder, if you are for real. your profile is empty. All your previous posts are derogatory and you accused the american president in your previous posts. I am wondering whats the basis you are here in IV and if you a green card case that you have applied and waiting..

    Over 60% of the US and 90% of Arizona supports the law they passed. Obama and his Attorney General are doing the wrong thing by interfering with state politics. How can these high ranking officials tell state law enforcement NOT TO enforce laws? The Supreme court will favor AZ even before the case starts. Slam Dunk.
