i had interview at mumbai consulate on friday morning 9.30.
EVERYONE please take time to read and reply...
the officer was very rude... i said good morning upon entering and she did not reply.... then she said she is getting strange people since morning and no one is following her instructions....
she asked me the name of company, my job title etc..i replied ...
and then she asked me for my old passport and wrote CWOP on expired visa.....
she asked my wife if she has old passport and i said no and there it started..."SHE got angry and said did i asked you? let her speak... " "women can speak for herself etc..." she did utter some few words slowly so i said "excuse me" and that's it..she told me people like me should not be in usa..etc...etc........."
here is the deal...she did not gave me any slip or anything and said we can go now.....
WHAT WILL HAPPEN?
will i get my passport with stamp? or do they send Pink/Yellow/White slip through courier?
expert any advise?
i tracked the passport on VFS site on Saturday morning and VFS says they have not received passport from the embassy. is this normal? should i wait till monday evening before jump on any conclusion?
Sorry to hear this. It seems to be a real unfortunate thing to happen. Hope the lady was just having an emotional issue and doesn't act upon that. I would anyway wait till Monday and contact the VFS again. Hope for the best.

I had this experience before in Pennsylvania, same single bed room, had a PC, fridge, thats pretty much it...
Apartment management said, check with power company. Power company said the apartment have insulation problems. There are quite a few reasons why this may happen..
1) Location of apartment, corner, ground level
2) Old equipment, like washer/dryer, bad insulation
3) Normally in northern states winter power rates are more almost 2.5 times....
the highest i got was $350 dollars at that time, that was in 2004....

SUMMARY OF PROVISIONS FOR EXTENDING H-1B VISA STATUS
PAST THE PERMISSIBLE 6 YEARS OF H-1B STAY

1. AC21 104 (c) - Approved I-140 Petition = Extension of H-1B Visa Status in 3 Year Increments.
� Under Section 104 (c) of AC21, the beneficiary of an approved I-140 who is prevented from filing an adjustment of status application due to application of worldwide OR per-country limitations may be granted an extension of H-1B visa status in 3 year increments pending eligibility to apply for adjustment of status.
� There is no requirement that the foreign citizen have a Labor Certification or immigrant visa petition pending for one full year prior to the expiration of the foreign citizen's 6th year of H-1B visa status.
� However, there MUST be an approved I-140 to access this benefit.
� This benefit does not apply to dependents who have reached 21.
2. AC21 106 (a) - Pending Labor Certification or
Employment Based Immigrant Visa Petition = Extension of H-1B Visa Status for 1 Year.
� Section 106 (a) of AC21 permits H-1B non-immigrants to obtain an extension of H-1B visa status beyond the 6-year maximum period, when:
(a) 365 days or more have passed since the filing of any application for labor certification, Form ETA 750, that is required or used by the foreign citizen to obtain status as an EB immigrant; or
(b) 365 days or more have passed since the filing of an EB immigrant visa petition.

As listed if there is so many address .... is the just the place where we filed the 140 that counts ?
Does it make a difference where the labor is approved ?

I dont think this should be our priority, his reporting is mostly based on illegal immigration, he does talk about H1B visa sometimes and has reported some incorrect facts, but again his focus is more towards cleaning up the H1B visa system so that things are transparent rather than stopping it altogether.

This new law in its current form affects everyone who is here legally whether someone is a Student or H1B

2. The moment student want to file for H1, his employer should be willing to shell out nearly $10,000
3. Every extension subsequently costs same amount unless they dont increase it further.
4. Some one on H1b cant do consulting.
5. Some one whose EB petition is pedning and nearing 6th year is scrwed because of the reduction in VISA numbers and repealing of AC21.
6. Employers have to shell out $10000 every year to get extension.
A spoke with at least 10 people and have them signed up for IV.
Folks , Please talk about this issue when you make weekend calls. No one from EB community is spared from this draconian bill .
Make phone calls and have your people signed up for IV

Did you have to change your address while you switched jo?. And if you had changed address, did you inform USCIS. I am trying to find out if address chnge is what triggers RFE for job switch. Also were you on H1B or using EAD with previous employer.
I moved out of state. I owned a home and it took a while to sell. So I stayed at a temporary facility. So effectively I retained the same address. But, we got the cards just before we sold the house. So the answer to your question is No I did not inform USCIS. But, I had a justification not to inform the USCIS.

If you have a lawyer please ask them, because in my case only the lawyer got the receipt notice.
Now here is what happened to me: filed on July 2nd in Nebraska, receipt notice came from California on Sept 5th, then they forwarded it back to Nebraska and I go the notice of action in the mail (this time I did get it and my lawyer did not), but now my receipt date is Sept. 5th instead of July 2nd.....so don't be surprised if they pull the same thing on you!!!

I think IV should stay focussed with what they are doing right now. This is a non-profit forum with a purpose and lets let it be that way.
We can probably make it more expansive as we get more volunteers to moderate the forum but with whats going on right now,we should let the core members focus on what they are doing.
I strongly agree with Berkleybee that this aint a one-stop shop.There is a danger of core issues getting diluted.

This is equivalent to $155,000/year. Indian companies like to report CTC (cost to company/compensation) rather than gross salary. So $155k CTC doesnot sound out of normal range salary ($90K gross +relocation+1 time sign-on+benefits (401k,medical, dental, bonus etc)) for someone working for a big tech firm in California.

By filing an I-140 you have shown an intent to immigrate and hence you will not be able to file for an F-1 from outside the country (my personal opinion). However, since you probably do not need to re-enter the country on F-1, you do not have to prove to the official at the consulate that you will return to your home country. So my guess would be you can change to F-1 from within US. BUT, you can forego your H-1B, attain AOS pending status, and attend school.
I think you should consult an attorney.
Once I-485 is filed, one can file for change of status ONLY to H/L status.

I had similar issue and went upto the local Deferred Inspection Office but couldn't get it done there. So I travelled upto Mexico border, didn't even have to enter into Mexico. I went upto the office and the officer had an idea about my situation and issued new I-94. I found (while searching through posts on other threads) that some DI offices do realize about this problem and they issue I-94 within U.S.
I'd say try at one of your DI offices if not you can travel upto the border. Call the border to make sure if they do issue I-94 for such cases.

Could you be a little specific?
Was your h1 approved or did you get RFE (Request for evidence). Did your attorney receive the approved petition? Are you currently in the US or outside US?
