A friend of mine told me that we do not have to pay Social Security Tax while working on EAD. Does anybody know if this is true ?

Your friend may have confused 485 based EAD with F1 OPT based EAD. On F1, you do not pay SS or Medicare. On AOS based EAD, you do need to pay SS/Medicare taxes.

This question is implying that the stay for the children to go to school in canada would only be a month or so, not more than six months - so does anyone know if there's a risk in messing up the green cards while the family waits a month in canada while waiting for the next destination.

I left the US for good after spending around 5 years on H1-B sometime last year and have only made entries on tourist visa. Can I apply for a new 6 year H1-B quota since leaving the H1-B status last year or will I have to spend 1 year outside since the last tourist visa entry ?

Yes it is legal as long as
- the student is in legal status (valid I94 and visa/petition).
- the student is not working/volunteering (peer discussion/helping other students may be ok) for that employer before work authorization.
I unable understand what you mean by "Is he allowed to sign any documents on behalf of the company during this training ?".
Can anyone please tell, can the employee be trained by the employee before activation of visa i.e. 1st of October. The employer is not paying employee any wages for his training. Can his training be legal ? Is he allowed to sign any documents on behalf of the company during this training ?

First of all, let me begin by congratulating the IV core team and other members on staging a dignified protest to the entire July VB fiasco!
I have a question regarding the medical exam for the AOS. The civil surgeon I went to did not do a TB skin test and instead took an x-ray to verify no signs of TB. Has anyone else had the same experience, i.e. no skin test, x-ray only?
The other strange thing he told me was that some of his patients send the x-ray as part of the 485 application. Has any1 else heard of anything like this?
Last I checked, the USCIS did not employ medical personnel, but then what do I know?
Any input from fellow IV members is greatly appreciated.

if monthly wages for an employees is 1000 per month then it should be 12000 per year) company need to prove the ability to pay $12000 per year.
but what if the LC was filed in mid year for example June 2005 and CIS RFE is asking to proof ability to pay (only One year) 2005
can it been showed as June - december = 7 month and onwards
$1000 x7= 7000
is it good approch or no

Yes, unfortunately that is true. You can not use the experience that you gained with the current sponsoring emplloyer for your permanent residency application.

I'm having a little trouble with counting the years of experience for my EB2 petition. My attorney said I can only count the number of years I worked before joining the current sponsoring company!! The situation is, I jointed this company in Jan 2004. But my petition (Labor) appliction only started at the end of 2006. My attorney says that the three years of working experience (04, 05 & 06) can not be counted!

Short answer: No.
However, that said, you could have multiple H1 visas and work full-time for one and part-time for the other, as long as the first one doesn't have a problem with it :-)
If you get paid for work in the home country, there may be complications. One being that you'll still be taxed in the US. Consult a good Immigration attorney and a good CPA before doing anything like this.

Yes, what is this security clearance? I have applied for H1B renewal after 3 years on July 23rd (my receipt date) of 2007, and this still has not been processed and sent. I was told it has been sent for security clearance. I am here in US working without H1B visa after 7 months of my H1B visa expiry while my renewal is still pending as of today (03/07/08). Does anyone have an idea when is this going to be processed and will I ever get my work visa renewed ?

Let us be very clear, we are MORE THAN WILLING to associate with any org that can be beneficial to us. One of the members of IV had established contact with USINPAC and it has been a very fruitful association
If anyone can do the same thing with any other org (could be 'Chinese Physicians Association', or 'Russians in America' or 'Canadians in USA' or even 'Americans for High Skilled Immigrants' - please note that I made up all the names, but please get the gist) please take the inititative and let us know how it goes.
Also note, that even if we associate with an org primarily working for a particular country, all our issues will benefit EVERYONE from every country. It is impossible to press for an amendment like 'Ability to file I485 without regard to visa number for Indian Nationals only'. The US Government doesn't allow that and neither will IV go in that direction.
The keywords here are 'publicity and exposure'. We really need that to protect our amendments in the Senate and the House Conference

Alien registration number is found either on I-140 receipt/approval on top of beneficiary's name. If you're not sure, just leave it blank or put N/A. This is different from I-94 number.
concur it is the I-140 A# number if you have the approved I-140, otherwise check with your employer if they have the I-140, or leave it blank if your I-140 is approved.

Hi Attorneys,
Recently I have filed my H1B petition . However due to some emergency I need to quit my current organisation (Company A) who has sponsored the H1B . My questions are :
1. Would there be any adverse effect if in future Company B files H1B for me ?
2. What generally happens if I file H1B and am not able to attend the interview ?
3. Is there any way Company A can revoke the H1B petition after I resign before H1B interview ?
Would appreciate a quick a reply .

by filing that I-140 that LC became yours and so now you have that one year old LC that you need for the 1 year extension.
When premium processing opens up, you may want to upgrade your I-140 to premium and get the 3 year extension instead, up to you
if you have one I-140 pending, the second one cant be made premium, but can still be filed in regular.
