On Sept. 14, President Bush signed the Honest Leadership and Open Government Act of 2007, an ethics and lobbying reform bill, which enforces a number of new restrictions.
Under the new law, lobbyists are prohibited from providing gifts, food, beverage and travel to Members of Congress, their staff or employees. A violation of this law could result in civil fines and/or criminal prosecution for the Company and individuals involved.

You can apply for a new H1 and will not abe counted against the cap. That is what it mean by cap exempt.

To best of my knowledge, a person on EAD (probably not the primary candidate) can work for anyone.. It can be City, State, Federal or McDonald's at any position, part time or full time, provided the job does not involve any government classified information. Jobs involving classified information are only for citizens that too after proper background check.
Primary candidate might work for the government i.e. if job requires skills that citizens don't have and that group has a policy of filing H1's..

A lot of people don't submit a formal AC21 letter when they change jobs, but if you want to do so, then it is better that you don't assume that they are going to look at your h1b app and figure you used AC21.... in most cases, uscis doesn't even look at AC21 before sending an RFE or NOID when I140 is revoked. Take what you can out of this...

your regular employment letter that you get from HR should work. There is no special format for POE.

My passport will be expiring in next 6 months. I do have an appt pending with US embassy Bombay. I have some queries, if someone can please guide me:
1. What happens to old passport. I took Appt with old passport number?
2. Can I keep my old passport?
3. Is it OK to go for new renewed passport? Or will it impact the H1B stamping and interview process?
Pls suggest.

All this big companies as declared will reduce h1b employees in us and will do work remotely - so payroll reduction will be in us and ultimately more loss to us goverment.
if they reduce even 4 out 10 than also 6 people government will get $12k while additional 4 govt. will loose atleast tax and social security other together more than 50k and all the expenses they will do here all those money will go out of the country rather than spending done here, so many side impacts to other industries.

According to USCIS field manual for Adjudicators (IOs who approve 485), they should use DOL SOC*Net Codes, to determine same or similar, while approving. This code is mentioned in your LC.

I was just wondering if they stall the 485 processing once they issue an RFE on EAD. Would they hold the case in abeyance or are these two mutually exclusive.
Btw, am not sure of the reason for RFE yet.

In 2005 I (american citizen) applied for a I-130 petition for my husband who is an Indian citizen. (It was approved.) Then after that the case was placed under administrative review at the Mumbai embassy in India. It is still pending for over four years now. As of Sept. 2008 My husband recieved a letter stating the petition was sent to the USCIS here for review and possible revocation. We were told to contact them here for our case. They can not find anything on our case.
He is now in Canada on a student visa. Can I apply for a K-3 visa while he is in canada on a student visa? I was told he would need to go back to India for me to apply for a K-3 visa. USCIS agent told me to take the steps in applying for a K-3 visa for him.

I moved from Company A to company B towards the end of my H1 6 th year with only a month and half left in my H1. Company B applied for my 140 and 140 was approved just on the day of my 6 year completion. H1 transfer was filed in parallel in normal processing. H1 transfer has got an RFE now a day after 140 was approved.
1. Will there be any problems in getting the H1 transfer based on the 140 approval with the new company? Please note that I do not have any days left in my original H1.
2. What will the duration of H1 if the transfer gets approved?
3. I am continuing to work based on 140 approval and pending h1 transfer. Please advice is it is ok.

My family was applied I-485 by my mom's working at the company, and all my family had EAD which is working permit and received SSN with that EAD.
However, 2008 January our I-485 have got denied because of sponsor got closed.
That was the before our EAD card gets expired. So I couldn't renew the EAD card.
So My question is, is there any way to renew that EAD now?
if I still want to work, what does I have to do?

I am leaving company A to join Company B. My first 3 year term of H1 is expiring with company A soon in the next 6 months.
1. Do I have to apply just H-1 transfer or (H-1 Transfer + H1 extension) with company B?
2. Is there any number of weeks or period that I can be with out any pay stubs from company A after I leave them before I join company B? Will I fall 'out of status' as soon as the company A stops running pay stubs (they may not revoke immediately as my 3 yr H-1 is expiring with them soon anyway)? I am asking this because the company B may take a couple of weeks to employ me and start paying me.
3. Company B is doing good now. But who knows what will happen in this recession economy?! What are my options to be in legal status if I get laid-off by company B after H-1 transfer with them OR if the H-1 transfer to company B gets rejected for whatever reason?

I am on a L1 visa which has expired April 2006. I have got my petition extended till 2008. Can I transfer my L1 from Employer A to another Employer B. Can employer B transfer my current L1 petition to his company?

It will take hours. Let's put it this way; for one letter that is animated to spin, the file size is about 14-20k. Now 10 letters that are animated to spin will be around 200k alone. The process time does take hours.
It all depends on what configuration you have (AMD K6-2 550). On my PC it takes about 30 mins (P3 933), but that is still a long time to watch the Ravix processor draw all the lines individualy. What I usually do for large Swift 3D files, is simply export the outlines only. Then inside flash, I lay the movies on top of each other. So when they move, it creates an illusionary effect. For web based publishing, Swift 3D is just not a program that creates small files.
