I appeared for an interview on Feb 11 (H1b renewal and H4b renewal case).
Was asked to wait a week for an email and was given the yellow form.
Its been 16 days and no reply yet.
Does anyone know how long the wait will be?
How can I follow this up with the Mumbai consulate?
Is there a way I can cancel my application and go back on AP?

Hello All,
In delhi consulate i know they keep the passport and are not giving away any slips (221(g)) or any color slips.
all they say "pending processing". Is this same as Administrative processing ? how do we differentiate if this delay due is due to PIMS or some other reason like security/name check/ or any etc problem. This is such a doubtful situation specially for people who have been waiting for more than 2 weeks ?
If you have knowledge ..do shed some light.

I received a response from the ombudsman. I am not sure if our issue is properly understood by his office. When we write about AC21 issues, the response talks about I-140 delays. Gurus, please help me understand the contents of the response below:

I don't get how you are getting the 8008 figure. Based on the 9%, you are right about the cap for any country being 12,600 for all EB categories combined.
Pre-adjudication has nothing to do with country quota. And 'assigning a number' is still based on country quota. With all the pre-adjudication, it is likely that 'assigned numbers' = GC approvals. The 'assigned numbers' concept was a lot more relevant till last year, when they had numbers, but still had to 'process' the applications. Now most applications seem to have been 'pre-processed'(pre-adjudicated)

I do received RD as July 2nd and ND: Oct 10 on RN. I am not planning to bug IO@NSC for EAD or NC untill Jan 2008 or I see my PD current per VB.
I called yesterday and spoke to an IO at TSC.. she says I am seen pending for name check as of Oct 17.
I am a July 2 filer.
CAdude.. I have a question for you though.. Did your notices show receipt dates of 2nd July or different.
I spoke to my lawyer about getting it fixed.. but they never responded to me back.

I have both I-94 attached to passport and also I-94 along with current I-797. I still confused which one to use?
Technicaly you should possess only one I-94. So when USCIS asks for a copy you should submit only the latest. If you submit extra copies you will create more confusion why you possess more than one I-94. My advice just send them the one that is valid and latest. USCIS can determine you live in this country legally from your records including ur passport, I-797, I-20 past EADS etc.

I got the CPO email first. In another days 6 days got welcome mail. Then the status changed back to post decision activity. 5 days from there, I got the cards. Even today the status says the same.
Looks like you are so much addicted to check USCIS case update, you still checking your status after you receive your cards :)

My question is if my H1B visa gets rejected, can I come to the US on AP (someone in the US will mail me the approved AP)?

1.You depart from the United States; or
2.The person seeking advance parole attempts to enter the United States before a decision is made onthe application.

My appointment was on the 12-Dec. Visa was approved immediatly - was told I'll get it in 7 days - but haven't received the passport yet 56 days to date. I receive the same response when I call.. that its under PIMS verification. No ETA of when I can expect it to be done..

If companies find more stumbling blocks to operate their business, they will find even more innovative ways to overcome those. Remember India is no longer a back office for a low end work now. Many companies have even moved their R&D to India.
I agree to what you say. The intend of this thred is not to support/oppose the outsourcing/offshoring the jobs. The intent of this thred is the fradulent use of L1s by the offshoring companies.
If these companies play as per law then there is no issue. Everything is OK in moderation even outsourcing or offshoring. However these companies does fraudulent use of the L1s. They send endless people in L1s. Even if the person does not have hire/fire authority he/she is sent as L1A. General java/Oracle/.net developers are sent in L1A or L1B.
These people with L1s are placed at client location and they work under supervision of client manager. False names are shown in the chart under these L1As benefeciary when they are applied for renewals.

Seems like there might be an internal memo or understanding between USCIS and DOS not to approve many Eb2 India 485 even though there dates are current, this is the only explanation I can come up for the lack for eb2 india approvals in October. Even with the limited number of visas every quarter I was hoping there would be lot of approvals because of Visa spillover occuring every quarter instead of once every year, but looking at the USCIS performance in the first week of october it seems like there wont be any quarterly spillover at all.
Correct me if I am wrong but to my knowledge quaterly spill overs if any would be in the last month of the quater which should be in Dec 2009

hi,
my spouse and i are july 2 filers. our checks got cashed yesterday. the lawyer emailed us all the reciept numbers. however, when i check the status online, it says that "our applications were recieved on october 2nd". our laywer tells us that this is not accurate and once the actual reciepts get to her, she will confirm. we are hoping that oct 2 is just the notice date and they have 2 july as the actual date!
will update once i have all the reciepts.
