Please clarify where exactly you are going and whats your proposal. Please be more objective and cut bureaucratic statements.
All,
This is a non issue now for all practical purpose because of recent Job Zone change for Computer Information Manager.
The porting to begin with was unethical in our mind and we took a stand. We were challanged by several people on this forum but they did not realize the extent of our convictions.
Unlike others with their lawsuits Ideas, in this case we did follow up on this issue by contacting DOL in early September with our greivance along with a famous lawyer on our side. Enclosed is our letter to Secretary of Labor Elaine L. Chao and other senior officials. We would like to think that our effort has contributed to the recent change in the Job Zones for Computer Information Manager, as that was specifically mentioned in our letter.. This was not exactly our intention as we just wanted DOL to put some more control around the process. Hence our apologies for the unintended consequences of this effort on the future applicants.
Thanks to these members who actively/morally supported us.

Note:
We have further indication that any research position may be upgraded to Zone 5.
US educated may be viewed favorably espeicially in non IT engineering positions

This would be a good move on part of BJP.

Let Obama feel the heat. US has to understand that they have no native skills and they are in deep debt. Let more jobs go away in this country if Mr. Obama does not stop his actions.
In nutshell- Election of Obama is bad for Indians / Skilled workers.
Yankee ( Moderate)Republicans are any day better then hard liberals & right-wing conservatives. Now we are seeing that Obama & Tancredo have the same agenda to scr*w us.

Let all the members who are here in USA for more than 9 years without a green card unite and make this as an ACTION ITEM for IV Core to consider this. Others who like this idea are most welcome to support this.
We all need to unite to get this going...
Everyone,
See the May 2009 Visa bulletin and decide yourself. Is it worth just wasting our time on the green card processing?. Let us concentrate on getting the Citizenship soon. Support this idea in mass and make this as a first priority on IV agenda.. It is time to think...

My husband's EB2 Dec 2003 I-485 is at NSC and has been pending. Called customer service using POJ method and got an answer that the application is assigned to IO.
We have replied to RFE two months ago.
Can anyone guess how long it usually takes for IO to actually look at it and approve.
Does it help to file DHS form 7001 or contacting congressman at this point.
Thanks

I would not trust the lawyers in any of this, because their analysis will be superficial and not even close compared to what we see here. We have around 4-5 different folks here doing some really good sound analysis, so unless it's a lawyer known to historically make accurate predictions, I wouldn't care less about their say.
Lawyer is sharing info that some of their client have got fee invoice from NVC. I have done family based application through NVC for my parents and I know you get fees invoice almost 4 months prior to your GC interview date. So lawyer is thinking that NVC is thinking to go upto Nov 2007 in case if CIS fails to act on enough cases in last months.

Why would you say EAD and H1B will be denied??
if one is taunting , " Look FBI bosses , i am stuck in security check, still i am a working with my H1B/EAD . How dare you allow to people remain here - for many years - if you suspect something is fishy with their record "

One idea is to give GC to AOS applicants regardless of namecheck result, if all
other security checks are OK and let the namecheck run in background . If the namecheck turns out critical , cancel the GC & deport the applicant.
But USCIS and lawyers will loose big time , because of reduced demand for APs,EADs etc.
Lets add this in IV action Item.

I had my H1/4 (wife) stamping 2 days ago at Mumbai. No issues what so ever at Stamping. My discussion with the officer was cordial and friendly.
Went in at 9:00 and out by 10:00. Received stamped PP next day.
All docs OK. No job change after H1 transfer 3 years ago
All those going for H1 stamp do NOT worry. Not sure how one gets PIMS but this is just my account

Few responses to Mr. Hunter.
I'm not blind to stereotyping in this forum or elsewhere. It's not you vs. them kinda thing. You ARE stereotyping based upon some TRUE things but it is still stereotyping, isn't it.
Also, you understood some of my comments wrong. All I was saying is that due to big ISV's like TCS/INFY/WIPRO and mushrooms of bodyshops the actual worker gets pennies on a dollar and they keep the booty. So it's not the worker who causes wage depression it's the circumvention of the spirit of law that these companies do which causes it. I say "spirit of law" because they still stay within the legal framework. As far as offshoring is concerned it's a big discussion in itself and forces of capitalism and globalization are at work. None of us can prevent that but we can counter it by moving up in the value chain.
The scenario you described about modus operandi of big Indian ISV's is 100% correct but to generally imply that Indians are 1/5th as good as Americans when it comes to IT (50 member team vs. 10-12 member team) is a supremacist attitude and completely untrue.
It is true that the Indian counterparts are usually of much younger age but rarely substandard for the job. Companies realize that IT is no-longer considered rocket-science and they can save a few bucks. Try to think objectively keeping personal impact aside.
Now regarding overall economic input of immigrants there are issues broader and larger than you mentioned. Some of the smaller points you mentioned are true but you are completely missing the big picture. We can discuss that in a different thread :)
When Bill Gates says best-and-brightest it applies to individuals and not a VISA category, he's not lying. Among the 65K every year you'll find people from all skill levels, cream-of-the-cream to just-about-ok, and a few rotten-apples too. The immigration system is not designed to test skill level. Overall it's old, irrelevant and doesn't help anyone. It needs to be re-designed but unfortunately people are divided on fake lines and ignore the real issues or rather real solutions.
Although you have said it differently but you are right that solution to mine and your problems lie at the same spot, a modern, common-sense, immigration system that promotes best-and-the-brightest (Indian and American) and discourages exploitation.

05/17/2007: USCIS Terminates 05/18/2007 PPS for Labor Certification Substitution I-140 Petitions
USCIS announced today that beginning on Friday, May 18, 2007, it will terminate Premium Processing Service for Form I-140 petitions that request labor certification substitution. USCIS anticipates a substantial increase in the number of petitioning employers that will file Form I-140 petitions requesting Premium Processing Service and seeking labor certification substitution prior to July 16, 2007. The volume of such petitions filed requesting Premium Process Service is expected to exceed USCIS capacity to provide the Premium Process Service according to the program guidelines. For the announcement, please click here.

Well, bad news for those looking for labor substitution. But I believe you can still file I-140 with premium processing if you have your own labor.

EB 3 India PD : 21 July 2003
I-140 (Premium) Approved : 15 May 2007

How about, they are expecting so many application 140 plus 485...that THEY DO NOT WANT TO PROCESS ANY APPLICATION...like always - THEY WILL SIT and EAT BURGERS and dont WANT TO DO ANY WORK...nothing new here folks...
On Monday I upgraded my I-140 at NSC to Premium Processing category. It got approved in just 3 days. It is not as if they are not doing any work. In fact I checked that the TSC I-140 dates (my successor in interest I-140 is pending here) have moved forward too.
I think they stopped premium processing I-140's now as they know there will be a flurry of AOS apps, which they would want to look at.
For the same reason, I think the AILA thing about a new interim bulletin is also a rumour.
Given a chance though, I would want to file ASAP... who won't?
